Elaine Dallaire-Donegan Freelance Paralegal Business Office 10 Walker Road., Suite #2 North Andover, Massachusetts, 01845 978-387-6135 Elainelegal@yahoo.com ORIGINAL March I, 2013: Complaint Issued Against Meadow View & Shawmut Management Multiple Sewer Damage Sustained In Unit Owner: Is Elderly & Disabled Dear Building Inspector(s): I am filing this Complaint for the benefit of my neighbor, Mrs. Mueller, who is unable to speak for herself. She sustained plumbing damage to her unit which is adjacent to the laundry room. The laundry room facility is located on the first floor of every building; a common element within the control of Meadow View's board. The laundry room's plumbing and sewer system have compromised the surrounding structure(s) within it's location: I DO HEREBY STATE, on November 22, 2012, my neighbor knocked on my door in a highly agitated state of mind. She sought my immediate assistance which I rendered without hesitation. Inside her unit, I witnessed water, sewage and feces: located on the wall(s),bathroom and rug(s). Mrs. Mueller's kitchen is adjacent to the laundry room. Her bathroom is adjacent to the sewer line, located outside her bathroom window. I witnessed: I . A Serve -Pro employee, say he was instructed by Shawmut, not to remove her rug(s), the night of the incident: contaminated with human feces and sewage. 2. A Serve -Pro employee, collected all personal item(s)damaged by the water which was in plain sight. No offer(s) of monetary reimbursement were ever made to this owner. 3. A Serve -Pro employee, indicated Shawmut left instruction(s) not to offer her with hotel accommodation: the night of the flooding event with sewage and human feces. . 4. The Serve -Pro employee, left loud dehumidifier(s) in each room of her unit; drying rug(s) soaked with contaminated human feces and sewerage. My neighbor filed a claim with her condominium insurance company. The insurance company found that the associated contamination and flooding had happened before. And during their investigation, made a determination , the board was not going to rectify the source of the her flooding or contamination. The board is liable to decontaminate and repair her unit and the proximate cause of same: 5. Meadow View is under a contractual obligation to maintenance their common element(s). 6. The sewer and feces contamination originated in the laundry room which is a common area falling within the jurisdiction of the board and their agent(s). 7. The condominium document(s); make this board liable for damage(s) sustained; when it originated from a common element. If you should require access to her unit for inspection purposes; you must contact me; she will not acknowledge stranger(s) by means of the phone or the buzzing system up front. Joe, long term non -owner living with an on-site owner Cathy- Observation(s): Kevin peppered Shawmut with question(s) but was told to wait - Richard attempted to ask Shawmut question(s) and was told to wait - MATT: SHAWMUT POWER POINT PRESENTATION Shawmut meets with the board once a month to discuss issues - Deciding whether to use a gold, bronze or silver solution(s)- Election results did not provide an outcome requiring a quorum- Shawmut waiting for further ballots before announcing a winner - RICHARD: What is a quorum? MATT: 51 % of the total units here. RICHARD: How many units are here? MATT: 168 - The total votes were 31- -1- BALLOT MANIPULATION & INSURANCE ELAINE: That is because she was the only person on the ballot - There were many who were going to vote for me - Which explains why there is no quorum - MATT: Discussed his online services - Payment Options - Pay buy the month, quarterly or annually - Issues or repairs go to his online site under work orders - To go to him - Or go to Carl - The site is just another communication(s) tool - RICHARD: Was upset over his building's laundry room but was told to wait - MATT: Discussed the balance sheet item(s)- Cash account(s)- RICHARD: What is a cash account? Mr. Kevin Oakley: What about the reserves? What about the $100,000.00, in unpaid fees? RICHARD: Richard stopped Kevin and told him if he could not talk - Then Kevin could not talk - The same rules applied to Kevin - Richard apologized to Kevin for interrupting him- Observation(s): Kevin wanted to work with the board to find a solution that night - Matt kept stopping question(s) from being asked - Matt acted as a forensic accounting fire -wall - MATT: Started his financial debt figure(s), via the power point presentation - Insurance is $60, 535.00 - KEY Admitted that this insurance is high- ITEM(S) Due to water and fire damage - And complaint(s) issued- -2- NO RESERVE(S), HIGH CONDO FEE(S) AND CONDEMNED BALCONIES Said the work done in laundry room # 14, was substandard - Said Matt would not want to have this kind of work done in his own home - Richard had to fight for talk time with Kevin; got frustrated and left - KEVIN: Said he owned a unit for about 20 -years and left to buy a house - Said he had knowledge and experience in management years ago - Said he wanted to work with the board that night and find answers - Said he knew several companies who gave money in return for leasing - Said these companies will update the laundry room(s) and machines - Said this would save money; we do not have any money to fix them - Said condominium fee(s), are not supposed to fund the reserve acct - Asked how much money it would cost to fix all the problem(s)- MATT: Said it would cost a million to fix the sewer - $500,000.00, to fix all building(s) balconies- -'PI One, I ran and scanned proof of the sent ballot and would have won - Two, if we need money this badly why did the board reject my $7,000.00 - Three, if we need money this badly why did the board reject my condo fee - Board did not respond but muttered in disagreement together - KEVIN: Wanted to discuss assessment(s) funding our condo reserves - Wanted to know the cost(s) for solution(s) of Meadow View's problem(s)- Said condominium fee(s) are not supposed to fund repair(s) or reserve(s)- Said it is a buyer's market and people are looking to buy - Buyer's will see the high condo fees and go elsewhere - Buyer's will see there are no reserves and go elsewhere - ELAINE: This is why the board should have taken my Offer and Condo Fee(s)- To credit Shawmut, they have processed my fee(s)- KEVIN: Just how many unit(s) are behind on their fee(s)- MATT: topped counting when he reached 60- -3- SEWER, ROOF AND FOUNDATION MATT: Annual sewer cost(s) estimated to be on or around $83,000.00 - Annual assumptive bad debt(s) on or around $20,000.00 - Annual auditing cost(s) estimated on or around $2,000.00 - Annual collection retainer estimated on or around $20,000.00? Cleaning company on or around $11,436.00 MATT: Attic/roof damage caused by aging building(s)- Board solution(s); remove accumulated gravel used to cover damage - Board solution(s); placement of sump pump(s) and hard piping - Board solution(s); placement of underground drain clean-out(s)- Board solution(s); placement of power attic ventilator(s)- Board solution(s; placement of attic hemostats - MATT: Town inspector was horrified by the rot he found in our building(s)- Town inspector found a screw driver embedded in one balcony - Town inspector issued a report that balconies had unsafe condition(s)- Town inspector condemned numerous building(s) and their stoop(s)- Building inspector's solution at that time was to close -down Meadow View - Board solution(s); a written agreement w town to prevent being closed down - Town inspector required an engineer and architect's report - Town inspector made the board promise to have all deck(s) redone - Town inspector requires the work done in three -years - Town building inspector reported all work will be up to code - Board solution(s); another loan for $500,000.00 - Board solution(s); remodel 513, Walker Road - Board solution(s); rent out the clubhouse amenity (condo fees) pay for - Paid for work done on two of six condemned building(s)- MATT: Insurance company walked through the laundry room(s)- To review condition of water heater(s); code requirements- Shawmut is up for insurance renewal- Shawmut solution was creating a bad boy pool to show company there is $- To reimburse foreseeable insurance claim(s)- Board(s) solution is to have a special fund to pay for future claim(s)- Matt said the board did not consider the bottom -floor to be a priority - Matt said fixing of the,sewer problem(s) was not a priority- Shawmut sewer solution is to dig up and snake the system as needed- -3- COLLECTION PRACTICES, BOARD OFFSET(S) OR WRITE-OFF(S) KEVIN: Just what are you going to do about these people who are behind - MATT: Said the board hired an aggressive collector but it takes time - Said the board had collected over seventy -thousand in back fees - Said the board needed to collect at least one -hundred -thousand - ELAINE: Said this was why the board needed to pay back all past exemptions - This would help to receive money to pay for repairs - KEVIN: Said that was in the past but he was very wrong - BOARD: You bring this up all the time - KEVIN: What is the exact number we are behind in fee(s)- MATT: Said $78,439.00, in past due fee(s) for 2012 - Said the board offer(s) owner(s) payment plan(s)- Said the board offer(s) quarterly payment plan(s)- Said the board offer(s) annual payment plan(s)- Said the board understands the growing elderly population - KEVIN: Asked if the board had written -off any back fees - MATT: Yes - KEVIN: MATT: Asked if any back fees had been offset - Yes but not many - se SHAWMUT ENUMERATION OF BOARD & LOAN(S) ELAINE: The board member(s) enumerate themselves $275.00 - They really are not paying any condo fees - With all our loan(s) and accumulated debt(s)- The board should not be getting paid - MATT: We agreed not to bring personal issues into this but you apparently are - Said he found board(s) that get paid work harder - ELAINE: Said that the board deferred maintenance while self-manged- And------ MATT: We are running late; I said the meeting would only be for an hour - ELAINE TO CATHY: I quickly pointed out the new trustee from building 12 - CATHY TO ELAINE: Is that Sue there- ELAINETO CATHY: I pointed to Sue - That Sue approached the new girl from building 12 - That Sue asked her if she would like to be a trustee - CATHY TO ELAINE: Is that how Mark Gilbert got back on - ELAINE TO CATHY: Yes. It was David O'Neil who did the approaching - They worked together in real estate sales and rentals at Meadow View - CATHY TO ELAINE: A serious conflict of interest - ELAINE TO CATHY: Yes.
