The North Andover Board of Appeals held a public hearing at its regular meeting on Tuesday, April 9,
2002 at 7:30 PM upon the application of Executive Quarters, LLC (Mesiti Development Corporation),
100 Andover By -Pass, North Andover, MA requesting a dimensional Variance from Section 7, Paragraph
7.3 within Table 2 for relief of a front setback in order to construct a proposed accessory use garage,
deleting four parking spaces presently in existence; within the B-4 zoning district.
The following members were present: Robert P. Ford, Walter F. Soule, Ellen P. McIntyre, George M.
Earley and Joseph D. LaGrasse.
Upon a motion made by George M. Earley and 2nd by Ellen P. McIntyre, the Board voted to GRANT a
dimensional Variance for relief of a front setback (Hillside Road) of 14', as per Variance Plan prepared for
Executive Quarters, by Stephen M. Melesciuc, P.L.S. # 39049, dated 1/8/02, Marchionda & Associates,
L.P., 62 Montvale Ave., Suite 1, Stoneham, MA 02180 and drawing A-1 by David H. O'Sullivan,
Registered Architect #6010, O'Sullivan Architects LLC, 40 Salem Street, Building 2 Suite 2, Lynnfield,
MA 01940 revised 1/24/02. Voting in favor: Robert P. Ford, Ellen P. McIntyre, George M. Earley and
Joseph D. LaGrasse. Walter F. Soule abstained because of March 12, 2002 absence.
The Board finds that the applicant has satisfied the provisions of Section 10, Paragraph 10.4 of the zoning
bylaw and that such change, extension or alteration shall not be substantially more detrimental than the
existing structure to the neighborhood.
Furthermore, if the rights authorized by the Variance are not exercised within one (1) year of the date of the
grant, it shall lapse, and may be re-established only after notice, and a new hearing. Furthermore, a Special
Permit granted under the provisions contained herein shall be deemed to have lapsed after a two (2) year
period from the date on which the Special Permit was granted unless substantial use or construction has
commenced, and may be re-established only after notice, and a new hearing.

STATEMENT OF EXECUTIVE QUARTERS, LLC
IN SUPPORT OF APPLICATION FOR VARIANCE TO THE
NORTH ANDOVER ZONING BOARD OF APPEALS
The applicant, Executive Quarters, LLC ("EQ"), seeks a variance from the
required 50 -foot front yard setback in a Business 4 district (`B-4 District") to 36 feet
pursuant to § 7.3, Table 2, Summary of Dimensional Requirements, of the Town of North
Andover Zoning By-law (the `By-law") and § 10.4, Variances and Appeals, of the By-
law. EQ seeks to construct a 720 square -foot single story wood frame.and brick veneer
garage on property located at 100 Andover By -Pass and identified as Lot 79 on the North
Andover Assessor's Map 25 (the "Locus"). The proposed garage is to be constructed
behind EQ's existing office building on the Locus and set back 36 feet from Hillside
Road.
The By-law
Section 7.3, Table 2, Summary of Dimensional Requirements, of the By-law
requires a front yard setback of 50 feet in a B-4 District.
Section 10.4, Variances and Appeals, of the By-law, authorizes the North
Andover Zoning Board (the "Board") to grant variances from the terms of the By-law.
Zoning Relief
EQ seeks to construct a 720 square -foot single story wood frame and brick veneer
garage at the Locus. The proposed garage is to be located 36 feet from the front yard lot
line, which borders on Hillside Road. The By-law requires a minimum front yard setback
of 50 feet. EQ, therefore, seeks a 14 -foot variance for the construction of its proposed
garage at this location.

Section 10.4 of the By-law sets forth the criteria for the grant of a variance by the
The Zoning Board of Appeals shall have the power upon
appeal to grant variances from the terms of this Zoning
Bylaw where the Board finds that owing to circumstances
relating to soil conditions, shape, or topography of the land
or structures and especially affecting such land or structures
but not affecting generally the zoning district in general, a
literal enforcement of the provisions of this Bylaw will
involve substantial hardship, financial or otherwise, to the
petitioner or applicant, and that desirable relief may be
granted without substantial detriment to the public good
and without nullifying or substantially derogating from the
intent or purpose of this Bylaw.
EQ meets each of the criteria for a variance under the Bylaw:
(a) "owing to circumstances relating to soil conditions, shape, or topography
of the land or structures and especially affecting such land or structures
but not affecting generally the zoning district in general... "
The Locus is irregular in shape with 10 different boundary lines varying from
26.49 feet to 700.15 feet. The lot shape is best described as an arrowhead, certainly an
uncommon shape justifying a variance. See, e.g., Paulding v. Bruins, 18 Mass. App. Ct.
707 (1984) (uniquely—shaped lot unlike any other in zoning district supports variance).
The Locus also has unique soil conditions. The Locus is approximately 2.58 acres and
contains an existing office building. However, a substantial portion of the Locus consists
of wetlands. In fact, almost the entire undeveloped portion of the Locus is comprised of a
bordering vegetated wetland and wetland buffer zones. Due to the constraints imposed by
the wetlands and the irregular shape of the Locus, EQ is restricted in the location of its
proposed garage. These unique characteristics affect the Locus, but not the zoning

in open view. The garage will, therefore, improve the aesthetics and cleanliness of the
Locus. The proposed garage is in compliance with the purpose of the By-law to promote
the health, safety, convenience, morals and welfare of the inhabitants of the Town of
North Andover by, among other things, encouraging the most appropriate use of land and
conserving the value of the land and buildings. See, e.g., Broderick v. Board of Appeal of
Boston, 361 Mass. 472 (1972)(no substantial derogation where project does not detract
from zoning plan of district).
Conclusion
For the above reasons, EQ is entitled to a variance under §§ 7.3 and 10.4 of the
By-law from the required 50 -foot front yard setback to 36 feet in order to construct a
garage for the storage of equipment and materials at the Locus.

Upon a motion made by Walter F. Soule, and 2nd by John Pallone the Board voted to GRANT a Special Permit for
dimensional relief of 7'in height and 28.5 square feet in area per the 11/6/01 revised plan by Barlo Signs, 158 Greeley
Street, Hudson, NH 03051 The Board finds that the granting of this variance will not adversely affect the
neighborhood or derogate from the intent and purpose of the zoning Bylaw. Voting in favor:
WJS/WFS/JP/EM/GME.
Furthermore, if the rights authorized by the Variance are not exercised within one (1) year of the date of the grant, it
shall lapse, and may be re-established only after notice, and a new hearing. Furthermore, if a Special Permit granted
under the provisions contained herein shall be deemed to have lapsed after a two (2) year period from the date on

reduction attempts to come in closer to the requirements of the Sign Bylaw for B-4 Districts, although it does exceed the
dimensional restrictions allowed without a Special Permit.
Our petition seeks the Board's good graces in considering this request. Under Section 6 F (2) of the Sign Bylaw for Office
Parks a special exception for a larger sign may be granted for properties that front on high-speed, limited access highways if
required for legibility. The posted speed in front of Executive Quarters is 45 MPH. However, from my observation, it is not

dangerous if it is necessan• to slow down abruptly in order to read the Executive Quarters sign in a line of traffic. A larger sign

ZONING BOARD OF APPEALS
PROCEDURE
and REQUIREMENTS
for FILING an APPLICATION for
a SPECIAL PERMIT
Ten (10) copies of the following information must
be submitted thirty (30) days not later than noon
prior to the first public hearing. Failure to submit
the required information within the time periods
prescribed may result in a dismissal by the Zoning
Board of an application as incomplete.
The information herein is an abstract of more specific
requirements listed in the Zoning Board Rules and
Regulations and is not meant to supersede them. Items that
are underlined will be completed by the Town.
STEP 1: ADMINISTRATOR PERMIT DENIAL:
The petitioner applies for a Building Permit and
receivers a Permit Denial form completed by the
Building Commissioner.
STEP 2: SPECIAL PERMIT APPLICATION FORM:
Petitioner completes an application form to petition the
Board of Appeals for a Special Permit. All information
as required in items 1 through and including 11 shall be
completed.
Step 3: PLAN PREPARATION:
Petitioner submits all of the required plan information as
cited in item 10 page 4 of this form.
STEP 4: SUBMIT APPLICATION:
Petitioner submits one (1) original of all the required
information and 10 xerox copies to the ZBA Secretary.
The original will be stamped by the Town Clerk
certifying the time and date of filing. The remaining ten
copies will remain at the office of the Zoning Board of
Appeals secretary.
STEP 5: LIST OF PARTIES IN INTEREST:
Once the petitioner submits all of the required
information, the petitioner requests from the Assessors
Office a certified list of Parties in Interest (abutters).

STEP 6: SCHEDULING OF HEARING AND
PREPARATION OF LEGAL NOTICE:
The Office of the Zoning Board of Appeals schedules
the applicant for a hearing date and prepares the legal
notice for mailing to the parties in interest (abutters) and
for publication in the newspaper. The petitioner is
notified that the legal notice has been prepared and the
cost of the Party in Interest fee.
STEP 7: DELIVERY OF LEGAL NOTICE TO
NEWSPAPERIPARTY IN INTEREST FEE:
The petitioner picks up the legal notice from the Office
of the Zoning Board of Appeals and delivers the legal
notice to the local newspaper for publication.
STEP 8: PUBLIC HEARING BEFORE THE ZONING
BOARD OF APPEALS:
The petitioner should appear in his/her behalf, or be
represented by an agent or attorney. In the absence of
any appearance without due cause on behalf of the
petitioner, the Board shall decide on the matter by using
the information it has otherwise received.
STEP 9: DECISION:
After the hearing,..a copy of the Board's decision will be
sent to all parties in interest. Any appeal of the Board's
decision may be made pursuant to Massachusetts
General Laws ch. 40A sec. 17, within twenty (20) days
after the decision is filed with the Town Clerk.
Step 10: RECORDING CERTIFICATE OF DECISION
PLANS.
The petitioner is responsible for recording certification of
the decision and any accompanying plans at the Essex
County North Registry of Deeds, Lawrence
Massachusetts, and shall complete the Certification of
Recording form and forward it to the Zoning Board of
Appeals and the Building Department. Office.

9. WRITTEN DOCUMENTATION
Application for a Special Permit must be supported by a
legibly written or typed memorandum setting forth in .
detail all facts relied upon. This is required in the case
of a Special Permit when the following points, based on
MGLA ch. 40A, sec. 9 of the North Andover Zoning By -Law
and P 9.2 Special Permit Granting Authority shall be clearly
identified and factually supported: Addressing each of the
below points individually is required with this
application.
1. The particular use proposed for the land or structure.
2. The specific site is an appropriate location for such
use, structure or condition.
3. There will be no nuisance or serious hazard to
vehicles or pedestrians.
4. Adequate and appropriate facilities will be provided for
the proper operation of the proposed use.
5. The use is in harmony with the purpose and intent of
the zoning by-law.
6. Specific reference and response.to the criteria
required by the particular special permit for which this
application is made (i.e. Earth Removal Special
Permit respond to criteria and submittal
requirements).
10. Plan of Land
Each application to the Zoning Board of Appeals shall be
accompanied by the following described plan. Plans must
be submitted with this application to the Town Clerk's
Office and ZBA secretary at least thirty (30) days prior to
the public hearing before the Zoning Board of Appeals.
10 A. Major Projects
Major projects are those which involve one of the following
whether existing or proposed: a) five or more parking
spaces, b) three or more dwelling units, and
c) 2000 square feet of building area.
Minor projects that are less than the above limits shall
require only the plan information as indicated with
asterisks (*) In some cases further information may be
required.
10 B. Plan Specifications:
a) Size of plan: Ten (10 ) copies of a plan not to exceed
11"x17", preferred scale of 1"=40'
b) Plan prepared by a Registered Professional Engineer
and or Land surveyor, with a block for five (5) ZBA
signatures and date on mylar.
10 C. FEATURES TO BE INDICATED ON PLAN:
A. Site Orientation shall include:
1. North point
2. zoning district (s)
3. names of streets
4. wetlands to be shown on plan (if applicable)
5. abutters of property, within 300 foot radius
6. location of buildings on adjacent properties within
50' from applicants proposed structure
7. deed restrictions, easements
B. Legend & Graphic Aids:
1. Proposed features in solid lines & outlined in red
2. Existing features to be removed in dashed lines
3. Graphic Scales
4. Date of Pian
5. Title of Plan
6. Names addresses and phone numbers of the
applicant, owner of record, and designer or
surveyor.
10 D. FURTHER REQUIREMENTS:
Major Projects shall require that in addition to the above
features, plans must show detailed utilities, soils, and
topographic information. A set of building elevation and
interior of building plans will be required when the
application involves new construction/conversion and/or a
proposed change in use. Elevation plans for minor
projects including decks, sheds, & garages shall be
included with a side view depicted on the plot plan,
which include a ground level elevation
11. APPLICATION FILING FEES
A. Notification Fees: Applicant is to send by certified
mail all legal notices to all abutters, and then
supply proof of mailing to ZBA secretary. Applicant is
to supply stamps (appropriate current postage) for
mailing of decisions to all parties of interest as
identified in MGLA ch. 40A in sec. 11 as listed on the
application. ZBA Secretary will compute number of
stamps.
B. Applicant is to supply one (1) set of addressed
labels of abutters to ZBA Secretary who will mail
decisions to abutters and parties in interest.
C. Administrative fee of $50.00 per application.
A Special Permit once granted by the ZBA will lapse
in two (2) years if not exercised and a new petition
must be submitted.

Executive Quarters Special Permit Application

Executive Quarters is a multiple occupant office building approved
through the North Andover Planning Board's Special Permit granting
authority. The sign being requested with this Town of North Andover
Zoning Board of Appeals Special Permit application is the same sign
approved through the Planning Board's Special Permit Approval.
Executive Quarters is built and occupied. The locus has more than the
minimum required parking and is beautifully landscaped. The DeWolfe
Real Estate Company occupies the first floor of the building.
The property fronts on Route 125 (Andover By -Pass), which is a high
speed, divided, limited access highway. As part of the site plan review
conducted by the Planning Board, a 4 -foot tall white picked fence was
spelled out along this frontage. This proposed sign will act to enhance
public safety by being easier to read as cars speed past. There is no
nuisance or serious hazard to vehicles or pedestrians because the sign is
illuminated externally and structurally supported by 2 ten inch steel
columns. Management personnel are on the property daily to maintain
the property both inside and outside. The sign has colors that matchthe
brick of the building and the green trim for the building. This use of this
sign is in harmony with the purpose and intent of the zoning by-law by
the sign's quiet design and comportment.

0 NARRATIVE
The applicant is requesting relief from the North Andover Zoning Bylaw in order
to construct a 24' by 30' single story wood frame and brick veneer garage at the
Executive Quarters office building site located at 100 Andover By -Pass. The
property is located at the corner of Andover By -Pass and Hillside Avenue and
falls within the Business 4 zoning district. It is identified as Lot 79 on the North
Andover Assessors Map 25. The location proposed for the garage will require a
front yard setback of 36' from the street line of Hillside Avenue where 50' is
required.
Points of information;
A. The applicant desires to construct a garage for uses that will be accessory
to the existing office building. The general use of the structure will be to
enclose equipment and materials required to maintain the site.
B. The applicant is restricted in the location of the garage due to the
constraints of the wetland resource areas and the buffer zones associated
with these areas. Almost the entire undeveloped portion of the lot of the
site is comprised of a bordering vegetated wetland and wetland buffer
zones. The North Andover Conservation By -Law prohibits the construction
of any structure within 50' of a resource area. The garage is proposed no
closer than 68' from the nearest resource area.
C. The location is also restricted by the existing conditions of the
development. The garage has been positioned as best as possible
between the office building's HVAC facility and outside the required 25'
parking access aisle along the rear of site. Changing the existing
structures and apurtances on the site would result in substantial economic
cost and would make the project unfeasible.
D. The proposed garage has been designed to be aesthetically pleasing and
unobtrusive to the area. The facade proposed has been chosen to match
the existing structure. It will be buffered on all sides by either the existing
office, natural vegetation, or the landscaping that was installed as part of
the original development. The purpose of the garage is to enclose
maintenance equipment and materials that may other wise be stored
outside in the open. The garage will improve the aesthetics and
cleanliness of the site.
E. The proposed garage will be installed in location that is presently
developed and used for parking purposes. The garage will occupy the
space that is presently used for 4 parking spaces. This will decrease the
total number of parking spaces to 65. This is still 4 above the required 61
!l spaces for the office space square footage of the existing building. It can
be concluded that the proposed garage will not be injurious, noxious, or
0 offensive to the neighborhood and will not degrade the health, safety,
convenience, morals, and welfare of the inhabitants of the Town of North
Andover.
F. The required contiguous buildable area of the lot is not applicable for this
application. However since the location of the proposed garage will be
located within 100' of wetland resource area a Request for Determination
of Applicability would be required to be filed with North Andover
Conservation Commission and the Massachusetts Department of
Environmental Protection before such a project could be constructed.
