The Board of Appeals held a public hearing on June 14, 1988 on the application
of Tyler Monroe as a Party Aggreived for a review of a decision made by the
Building Inspector or other authority on the premises located at(10-0__Foste.r
Street. The following members were present and voting: Frank Serio, Jr.,
Chairman, Augustine Nickerson, Walter Soule, Anna O'Connor and Lou Rissin.
The hearing was advertised in the North Andover Citizen on April 21 and
April 28, 1988 and all abutters were notified by regular mail.
Upon a motion made by Mr. Soule and seconded by Ms. O'Connor, the Board,VOTED
to GRANT the Party Aggreived and hereby authorizes the' Building Inspector to
reinstate building permit #448, initially issued on 12/7/87 for a 30" x 40"
building. The following members voted in favor of this petition: Mr. Serio,
Mr. Soule, Ms. O'Connor and Mr. Rissin. Mr. Nickerson voted in opposition
to this petition.

This letter is in regard to the public hearingheld
on May 10,1988 relative to the appeal of Tyler Munroe 100
Foster St. I am an abutter who was notified but was unable to
attend the meeting.. Since this case is under advisement I felt
compelled to write and express my opinion on this matter.
Tyler and Kris Munroe,since the day they moved in,are
and have been excellent neighbors.As their closest abutter
I have never been disturbed or had my peace breeched by them
in any way. It is upsetting to me to learn that even though
their land complies with all applicable zoning by laws,their building
permit is now under scrunity. I wish to inform you that as their
closest abutter I am completely in favor of the construction
of a new garage and am in favor of the dimensions Munroe has
proposed.I feel the new building wi 11 enhance our neighborhooA
which consists of single family dwellings,cattle,sheep,and hay
storage facilities of all shapes and sizes. None of these buildings
pose a problem and neither will Munroes garage. Also for your con-
sideration,I built a new cattle barn on my property in August
of 1987•• This barn is 30' by 45' by 21' high,with ten foot
doors. You are free to visit my building and see the type of
building he wants to build,they are similar in size and style.

SECTION 8 SUPPLEMENTARY REGULATIONS
8.1 Off Street Parking
1. Whenever a building is erected, reconstructed, moved
or expanded or if a change in use occurs so as to
increase its floor area and/or design capacity, there
shall be provided on the same lot with such building
or on a lot contiguous thereto (or within 100 feet
thereof) in the same ownership as the parcel
containing the primary use, a sufficient number of
open or covered parking spaces to; satisfy the
requirements of the following schedule for the new
building or increased design capacity of floor area:
Use
One or two-family residence
Multi -family residence
Minimum Spaces Required
One space per dwelling unit
1.50 spaces per dwelling unit
for two or more bedrooms. 1.25
spaces per dwelling unit of
less than two bedrooms. 0.50
spaces per dwelling unit for

2. The required parking for any two (2) or more uses or
structures may be provided by the allocation of the
total of the various spaces required for each use or
structure in a common parking facility, cooperatively
established and operated.
3. The regulations of this section shall not apply to
non-residential uses or structures whose minimum
parking under the above schedule would amount to five
(5) parking spaces or less or residential uses or
structures whose minimum parking would amount to two
(2) parking spaces or less.
4. If the Building Inspector is unable to identify a use
with one (1) or more of the uses in the above
schedule, application shall be made to the Board of
Appeals for the purpose of determining a sufficient
quantity of parking spaces to accomodate the
automobiles of all customers, employees, visitors,
occupants, members or clients consistent with the
provisions contained in the above schedule.
5. The Board of Appeals may by variance make exceptions
to the provisions of this section and, upon a written
request of the owner and after a public hearing,

authorize the Building Inspector to issue permits for
buildings and uses having less off-street parking
than specified herein, whenever the Board of Appeals
finds that under normal circumstances such lesser
off-street parking area would adequately provide for
the needs of all persons using such building. Such -
exceptions may be limited as to time, use or
intensity of use.
6. A parking space shall mean an area of not less than 9
x 18 feet accessible over unobstructed driveways.
These spaces shall be graded and paved for all except
one or two family residential uses.
7. For multi -family dwellings the front yard shall not
be used for parking for accessory uses.
8. In all residential districts the front yard shall not
be used for parking for accessory uses.
9. In residence districts parking or outdoor storage of
one (1) recreational vehicle (camper, etc.) and one
(1) boat per dwelling unit may be permitted in an
area to the rear of the front line of the building.
All other recreational vehicle and boat storage (if
any) shall be within closed structures.
10. Loading facilities provided for any use shall be
sized, located, arranged, and of sufficient number to
allow service by the type of vehicle customarily
expected for the use while such vehicle is parked_
completely clear of any public way or sidewalk.
11. In residence districts garaging or off-street parking
of not more than four (4) motor vehicles per dwelling
unit may be permitted, of which four (4) motor
vehicles, not more than two (2) may be commercial
vehicles other than passenger sedans and passenger
station wagons, but not counting farm trucks nor
motor -powered argicultural implements on an
agriculturally active farm or orchard on which such
vehicles are parked. Commercial vehicles in excess
of one (1) ton capacity shall be garaged or screened
from view of residential uses within three hundred
(300) feet by either:
a) A strip at least four (4) feet wide, densely
planted with trees or shrubs which are at least
four (4) feet high at the time of planting and
which are of a type that may be expected to form a
year-round dense screen at least six (6) feet high

9. The principal points upon which I base my application
are as follows:
The applicant seeks relief from a decision of the
Building Inspector dated March 22, 1988 (confirmed in
writing by letter dated March 25, 1988; copy of letter
attached hereto). The decision of the Building
Inspector purports to rescind a Permit to Build issued
to the applicant on December 7, 1987 (copy of Permit to
Build attached hereto).
On December 7, 1987, the applicant was issued a
valid and lawful Permit to Build by the then duly
empowered Building Inspector. The permit grants
permission for the applicant to erect a 30 foot by 40
foot wood frame garage on the premises owned and
occupied by him at 100 Foster Street, North Andover.
The proposed garage conforms in all respects to the
provisions of the North Andover Zoning Bylaw. The
Building Inspector, in purporting to rescind the permit,
has not, and cannot, cite any zoning violation or
building code violation.
Apparently, the Building Inspector.has decided
that the size of the garage is such that it would be
able to accommodate more than four (4) vehicles, and on
that basis alone has instructed the applicant not to
commence building the structure. The applicant believes
that such a decision is improper and not within the
authority of the Building Inspector. The Builder
Inspector simply has no right or authority,to rescind a
permit where the proposed structure conforms in all
respects to applicable laws and regulations. The
Building Inspector has told the applicant that since
the Zoning Bylaw permits the garaging of no more than
four (4) motor vehicles per dwelling in a residential
district, the applicant cannot build a garage which has
the potential of accommodating more than four (4)
vehicles. The applicant believes that the reasoning of
the Building Inspector is patently wrong, and that his
actions have exceeded his authority as the zoning
enforcement official. There simply is no violation of
the Zoning Bylaw, and therefore no basis for the
decision.
Wherefore, the applicant requests that this Board
validate the Building Permit dated December 7, 1987 (No. 448).
