Town of Narth Alidover ZONING BOARD OF APPEALS ;',F [j n JU JAN—J 1 it }' U Mt is i : E ; •, r• , . Town Clerk Time Stamp The Board finds that owing to circumstances relating to the shape of the parcel 100 Old Farm Road, (Map 35, Parcel 62), having both side lot lines at right angles to the street for ca. 45', then both side lot lines turning to the East, the shape and placement of the existing single-family dwelling parallel to Old Farm Road with the attached garage and driveway on the right side to the street especially affects this land and structure but does not affect generally the Residential 1 zoning district in which it is located. The Board finds that a literal enforcement of the provisions of Paragraph 7.3 & Table 2 and Section 10, Paragraph 10.4 would involve substantial hardship, financial or otherwise, to the petitioner. The Board finds that the left side abutters Ann M. and Jeffrey S. Lu, 90 Old Farm Road, spoke for the applicant during the hearing and that there was no written or spoken opposition. The Board finds that desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the North Andover Bylaw. Note: 1. This decision shall not be in effect until a copy of this decision is recorded at the Essex County Registry of Deeds, Northern District at the applicant's expense. 2. The granting of the Variance and/or Special Permit as requested by the applicant does not necessarily ensure the granting of a building permit as the applicant must abide by all applicable local, state, and federal building codes and regulations, prior to the issuance of a building permit as required by the Inspector of Buildings. Furthermore, if the rights authorized by the Variance are not exercised within one (1) year of the date of the grant, it shall lapse, and may be re-established only after notice, and a new hearing. Furthermore, if a Special Permit granted under the provisions contained herein shall be deemed to have lapsed after a two (2) year period from the date on which the Special Permit was granted unless substantial use or construction has commenced, it shall lapse and may be re-established only after notice, and a new hearing. C-3 A variance from 7.3 & Table 2 of the Zoning Bylaw for the left side setback is required by the Zoning Board of Appeals in order to construct the proposed 12'x20' addition to the single family dwelling. Referred To: Fire Health Police X Zoning Board of Appeals Conservation Department of Public Works Planning Historical Commission Other BUILDING DEPT ZoningBylawDenial2000 TO: Town of North Andover Zoning Board of Appeals FROM: Scott Bowman 100 Old Farm Road, North Andover, MA 01845 DATE: November 25, 2007 Subject: Variance Section 9 - Variance Application, Points A -F A. My particular Variance request for the proposed use is extending a living room. B. The particular circumstances of my lot relating to the structure of the lot are not interfering, changing or altering in anyway with any other abutting property and will not alter the soil conditions provided the zoning variance is granted. Moving the proposed addition to any other area of the structure would involve substantial changes to the home. The particular circumstance of my lot relating to shape is that my lot is angled odd in shape with minimum setbacks on the side making the proposed addition 6 feet less than the required 30 feet setback. C. Due to the shape of our lot and the placement of our foundation prior to purchase of the property, placing the addition elsewhere on our lot would involve rearranging the 1st and 2nd floor interiors. D. Granting of the variance will allow a much needed, larger living space for my family and will also enhance the view of our back yard. E. Approval of the proposed addition to the current house structure is desirable as it will entail no removal of trees or extensive site work will be necessary of the surrounding topography and will be more than the required footage from the abutting properties house structure. This will add value to the existing structure and not interfere with abutters support a finding that the relief sought may be given without nullifying or substantially derogating from the intent or purpose the Zoning Bylaw. 81 SEEPLM13 6 274 fie A sG . 20 30 3 .14aa bti 450 44 80 8322 S'p 39 3 466.070 SF 84 21 ` ~44772'3' w 81.273 SF k f 43,17Ss79 Se, 43 A '1 4t 8s b 78 u, N 43728 SF 9.A 40 SBsWs ` ' 46 104 `Z „ 77 86 11 4'id P 437&s.P ! Q g 3 r ., >e 76 u 87 16 'dq4 A, 38 QAC P +4.27us.t• 93 68 40 88 I M SP $1 75 ,, n 4 7, 692 0 41ow r 2 74 'U 89 A. = 4s a -ow sy S%. tiO 31 73 3 n a U* J123 S1 45,owss Q 1 2Sd,{C SP 8 r d a 4u 91 1p " .72 a e 3 43.t22SF r 3u S FREN 2,3 aA 'Z s trr}y 4 -AC 7 per. 14 130' y2 g xi 'l' 3JA 97 G 94 32 3 - 93.4-49 61 k .9 46 EE #10041 7 10 8 7 10s8 6 k 5,. a 13 a s9 21 h 3.0 AC 53 108 b 27 , b # 14 36 s , r 15 r 6`1 45 16,gA m. a` 44 47 49 20 u16UD 6s ono 50 S 33.47 r 29 i CALE 400 FEET=1 INCH S LAT .76 19 SEE PLAT NO. 74 4 4 1q1 Abutter to Abutter ( ) Building Dept.
