The North Andover Board of Appeals held a public hearing at its regular meeting on Tuesday, May 8, 2001
at 7:30 PM upon the application of Mark & Amy Mellman,103 Vest Way, North Andover, MA
requesting a dimensional Variance from Section 7, Paragraph 7.3 of Table 2 for relief of a right side & rear
setbacks and for a Special Permit from Section 9, Paragraph 9.2 to allow for the extension of a proposed
one story great -room on a non -conforming lot within the R-1 Zoning District.
The following members were present: William J. Sullivan, Walter F. Soule, Raymond Vivenzio, Ellen
McIntyre, George Earley.
Upon a motion made by Raymond Vivenzio and 2nd by Walter F. Soule the Board voted to GRANT a
dimensional Variance for relief of 5' for a side setback, and relief of 23' for a rear setback and that the
granting of these variances will not adversely affect the neighborhood or derogate from the intent and
purpose of the Zoning Bylaw. The Board voted to GRANT a Special Permit to allow for the extension of
a proposed one story great -room on a non -conforming lot. In accordance with the Plan of Land by: Scott
L. Giles, PLS, #13972, 50 Deermeadow Rd., North Andover, MA, dated: 3/29/2001. Voting in favor:
WJS/WFS/RV/EM/GE.
The Board finds that the applicant has satisfied the provisions of Section 9 Paragraph 9.2 of the zoning
bylaw and that such change, extension or alteration shall not be substantially more detrimental than the
existing structure to the neighborhood.
Furthermore, if the rights authorized by the Variance are not exercised within one (1) year of the date of the
grant, it shall lapse, and may be re-established only after notice, and a new hearing. Furthermore, if a
Special Permit granted under the provisions contained herein shall be deemed to have lapsed after a two (2)
year period from the date on which the Special Permit was granted unless substantial use or construction
has commenced, it shall lapse and may be re-established only after notice, and a new hearing.

Principle Points of Application
We are requesting a variance to build an addition to our existing home. We
have a growing family that requires more first floor living space. As you
can see on the subdivision plans, the lot configurations on Vest Way are
rather unusual. Due to the way that our house is situated on our lot, the only
possible place to expand is to the proposed area. The front and rear of the
existing structure have a grade pitch of 3:1. To the opposite side of the
house is the garage and driveway, running along the opposite side property
line.
We have made our home in North Andover for 10 years and are well
established in the community. Our children have attended North Andover
Public Schools throughout their entire school careers, one currently
attending the North Andover Middle School and one attending the High
School. We have been extremely active in many organizations, including
Girl Scouts, various school PTO's, Joseph N. Hermann Youth Center
committees and leadership roles, school and Youth Center technology
committees, school redistricting committee and the North Andover
Women's Club.
We have looked at other homes in North Andover in an attempt to obtain the
additional space required. The cost of a comparable home with the
additional space is prohibitive, so we would like to obtain the variance, build
the proposed addition, which will increase our property value and better our
neighborhood.
