CALL TO ORDER: Chairman Rosemary Connelly Smedile called the meeting to order at 7:00 PM at Town Hall Meeting
Room.

ATTENDANCE: The following were present: Rosemary Connelly Smedile, Chairman; Mark J.T. Caggiano Clerk; Daniel P.
Lanen; Tracy M.Watson; Mark Rees, Town Manager; Ray Santilli, Assistant Town Manager.
Note: Richard Nardella was absent
EXECUTIVE SESSION:
Mark Caggiano made a MOTION, seconded by Tracy Watson, to move into Executive Session to discuss Collective
Bargaining. Vote approved 4-0.
APPROVAL OF MINUTES:
Mark Caggiano made a MOTION, seconded by Tracy Watson, to approve the Open Session minutes as Amended of
November 17, 2008. Vote approved 4-0.
Mark Caggiano made a MOTION, seconded by Tracy Watson, to approve the Open Session minutes of December 1,
2008. Vote approved 4-0.
Mark Caggiano made a MOTION, seconded by Tracy Watson, to approve the Executive Session minutes of November 17,
2008 and December 1, 2008. Vote approved 2-0-2. Mark Caggiano and Daniel Lanen abstained.
COMMUNICATIONS,ANNOUNCEMENTS,AND PUBLIC COMMENT:
The Board announced that the Town has reached contract agreements with two more unions, the IBPO Local 454 Police
Lieutenants and the AFSCME Clerical Union.
Mark Caggiano made a MOTION, seconded by Tracy Watson to ratify and sign the AFSCME Clerical Union contract. Vote
approved 4-0.
Note: Daniel Lanen recused
Mark Caggiano made a MOTION, seconded by Tracy Watson to ratify and sign the IBPO Local 454 Police Lieutenant
Union contract. Vote approved 3-0.

Trails Kiosks
Jack Mabon, Chair of the Conservation Commission presented the Board with their project to install Trails Kiosks on nine
trails located in the Town. These are outdoor structures that serve an important public service for recreational users with
trail maps, route data and site-specific historical and environmental information. Funding for this project came from
Community Preservation funds($39,000)and an Eagle Scout Garrett Galvin will assist in installing the Kiosks.
Certificates of Appreciation
Two Businesses were presented Certificates of Appreciation for locating their businesses in North Andover. Lily's
Boutique and Mediterranean Villa recently opened on Main Street.
Certificate of Recognition
The Board recognized George Koehler, chair of the Town's Housing Partnership Committee with a Certificate of
Recognition for his work and dedication to the Town and being awarded the Citizen Planner of the Year by the
Massachusetts Chapter of the American Planning Association.
Chanukah Family Celebration
On Monday, December 22, 2008 starting at 3:30 p.m. there will be a Chanukah family celebration at the Museum of
Printing, 800 Massachusetts Avenue. Grand Menorah lighting will be at 5:00 p.m. at the Town Common.

CONSENT ITEMS:
Acceptance of Donations
Edgewood Retirement
Edgewood Retirement Community made a contribution to the Town towards affordable housing in lieu of the housing units
based on the size of the project. The first installment was$347,163 and the second payment is due within 24-months.
The Board was asked to accept the donation.
Mark Caggiano made a MOTION, seconded by Tracy Watson, to accept the donation of$347,163 from Edgewood
Retirement towards affordable housing in the Town. Vote approved 4-0.
Brooks School
John Packard, Head Master of Brooks School presented the Town with a donation of$12,000 towards the 4t" of July
fireworks display. The Board was asked to accept the donation.
Mark Caggiano made a MOTION, seconded by Tracy Watson, to accept the donation of$12,000 from Brooks School
towards the 4t"of July fireworks display. Vote approved 4-0.
Pentucket Medical
Pentucket Medical has contributed $10,000 to the Town, $5,000 to the School Department and $5,000 to the Municipal
Department. These funds will be used for athletics and field maintenance. The Board was asked to accept part of this
donation of$5,000.
Mark Caggiano made a MOTION, seconded by Daniel Lanen, to accept the donation of$5,000 from Pentucket Medical
towards field maintenance. Vote approved 4-0.
Schneider Electric
Schneider Electric has donated $1,000 to the Fire Department to be used for departmental equipment and supplies. The
Board is asked to accept the donation of$1,000.
Daniel Lanen made a MOTION, seconded by Mark Caggiano, to accept the donation of$1,000 from Schneider Electric to
the Fire Department. Vote approved 4-0.
The Leland Family
Edmund and Nancy Leland donated $200 to the Fire Department for departmental equipment. The Board was asked to
accept the donation of$200 from the Lelands.
Daniel Lanen made a MOTION, seconded by Mark Caggiano, to accept the donation of$200 from the Lelands to the Fire
Department. Vote approved 4-0.

Acceptance of Grants
Police Department: Community Policing
The Massachusetts Executive Office Public Safety awarded a grant of$89,221.06 to the North Andover Police Department
for Community Policing Grants. The Board was asked to accept the donation.
Mark Caggiano made a MOTION, seconded by Tracy Watson, to accept a Grant from the state of Massachusetts in the
amount of$89,221.06 to the North Andover Police Department. Vote approved 3-0.
Police Department: Underage Alcohol Enforcement Program
The North Andover Police Department was awarded a$9920.00 Massachusetts Department of Public Safety grant for
"Under-aged Alcohol Enforcement Program". The Board was asked to accept the grant in the amount of$9920.
Mark Caggiano made a MOTION, seconded by Tracy Watson, to accept the grant of$9920. for Under-aged Alcohol
Enforcement Program. Vote approved 3-0.

Fire Department: S.A.F.E. grant
The Fire Department was awarded a grant from the state for Student Awareness of Fire Education (SAFE) in the amount
of$4,464.62. The Board was asked to accept this grant.
Mark Caggiano made a MOTION, seconded by Daniel Lanen, to accept the grant for(SAFE) in the amount of$4,464.62.

Fire Department: Firefighter Equipment Grant
The Fire Department was awarded a grant from the state for Firefighting Equipment in the amount of$7,792. The Board
was asked to accept this grant.
Mark Caggiano made a MOTION, seconded by Daniel Lanen, to accept the grant in the amount of$4,464.62. Vote
approved 4-0.
Public Works Department: Enhance recycling at Multi-Family Housing
The Massachusetts Department of Environmental Protection awarded North Andover a grant of 40 hours of hands on
assistance for the project entitled "Developing a Strategy to Increase Recycling at Multi-family Residential Buildings". The
Board was asked to accept this grant.
Mark Caggiano made a MOTION, seconded by Tracy Watson, to accept the grant from the DEP. Vote approved 4-0.

Appointments
Police Sergeant(Temporary)
Chief Richard Stanley asked the Board to appoint a candidate from the Civil Service list to fill the temporary appointment of
Police Sergeant.
Mark Caggiano made a MOTION, seconded by Tracy Watson, to appoint the highest ranked candidate Officer Eugene
Salois as a temporary Sergeant. Vote approved 3-0.

Capital Planning Building Committee:
The Board was asked to appoint David Breen to the Capital Planning Committee as recommended by Richard Nardella.
Mark Caggiano made a MOTION, seconded by Tracy Watson, to appoint David Breen to the Capital Planning Committee
as recommended. Vote approved 4-0.
Town Election Calendar
Town Clerk Joyce Bradshaw presented the Town Election Calendar, which will be held on Tuesday, March 31, 2009. The
following seats are open: two seats Board of Selectmen; two seats School Committee; and one seat for the Housing
Authority. Nominations papers have to be filed with the Town Clerk by February 24, 2009.
Mark Caggiano made a MOTION, seconded by Daniel Lanen, to approve the Town Election Calendar. Vote approved 4-0.
PUBLIC HEARINGS:
Pole Petition—National Grid-Pond Street Plan#5578872, install one pole#1833-84
Daniel Lanen made a MOTION, seconded by Mark Caggiano, to open the Public Hearing.
Vote approved 4-0.
David Boucher representative of National Grid requested the Board's approval to install one pole#1833-84 on Pond Street
plan#5578872.
Mark Caggiano made a MOTION, seconded by Daniel Lanen, to close the Public Hearing. Vote approved 4-0.
Daniel Lanen made a MOTION, seconded by Mark Caggiano, to approve National Grid pole petition to install one pole
#1833-84 on Pond Street plan#5578872. Vote approved 4-0.
LICENSING:
Daniel Lanen made a MOTION, seconded by Tracy Watson, to move into Licensing. Vote approved 4-0.
In the absence of Licensing Chairman Richard Nardella, Mark Caggiano acted as Licensing Chairman and recommended
that the Board approve the renewal licenses.
2009 License Renewals
Mark Caggiano requested the Board to authorize the Acting Chair to withhold issuance of a license until such time as a few
businesses come into compliance with town regulations. He is given these businesses until December 31, 2008.
Tracy Watson made a MOTION, seconded by Rosemary Smedile, to waive the renewal fee when an establishment opens
after September for the following establishments: for High Street Grill, Stachey's Pizza, Mediterranean Villa and Gourmet
Grille Express. Vote approved 4-0.

Rosemary Smedile made a MOTION, seconded by Tracy Watson, to send letters to License holders to become TIPS
Certified or recertified by the deadline of March 31, 2009. Vote approved 4-0.
Rosemary Smedile made a MOTION, seconded by Tracy Watson, to approve the Common Victualler's—all Alcohol
Licenses. Vote approved 4-0.
Rosemary Smedile made a MOTION, seconded by Tracy Watson, for the Owners of Val's Restaurant to contact the Town
Manager and Licensing Chairman agreeing to make arrangements to a payment plan. The Town Treasurer/Collector will
monitor this payment plan. Vote approved 4-0.
Mark Caggiano also said that there is one business, Val's Restaurant, that has not met all of its obligations to the Town
and requested that the Board not grant a renewal license until this matter is cleared up.
Rosemary Smedile made a MOTION, seconded by Daniel Lanen, to approve the Class II Licenses. Vote approved 4-0.
Tracy Watson made a MOTION, seconded by Rosemary Smedile, to approve the Class III License. Vote approved 4-0.
Daniel Lanen made a MOTION, seconded by Tracy Watson, to approve the Automatic Amusement Device Licenses. Vote
approved 4-0.
Daniel Lanen made a MOTION, seconded by Tracy Watson, to approve the Entertainment Licenses and approve the
request by the Vineyard to have a guitar player 2-3 times a year. Vote approved 4-0.

OLD BUSINESS:
Transportation Improvement Protects
The Merrimack Valley Planning Commission is in the process of developing its Transportation Improvement Plan for the
region. Community Development Director Curt Bellavance gave the Board a list of potential projects for the Board. The
Board was asked to give some input as to a priority list of various projects. The Board asked that the Director of Public
Works,the Director of Community Development and the Town Manager to identify projects that should be considered.

Underground Protect at Old Center
The Town Manager reported that National Grid and Comcast would complete their work by Spring/Summer of 2009.
Verizon has stated that consistent with State law, they will not spend on annual basis more money then what the 2%
surcharge brings in, approximately$105,000. The cost to complete the project is estimated to be$850,000. A possible
solution to this problem is to do what the Town of Norfolk did,which was to ask for special legislation to borrow the funds
and to pay back the principal and interest using the 2%surcharge.
Selectmen agreed that this should be on the Annual Town Meeting Warrant and the Town Manager should ask for the

NEW BUSINESS:
4 of"July
Selectman Daniel Lanen announced that a meeting was held to plan an old fashioned 4t" of July celebration on the Town
Common. Preliminary plans will include a Turkey Trot Road Race, a cookout manned by the Lions Club, a beer tent
manned by the VFW, a concert on the Town Common, children's relay races, and a fireworks display. Selectman Lanen
suggested the Board appoint the Patriotic Observance Committee and the Festival Committee as Co-Chairs of the 4t"of
July Celebration.

Observance Committee as Co-Chairs of the 4t of July Celebration. Vote approved 4-0.
Regional Dispatch Grant Application
2007 Annual Town Meeting voted to support studying the feasibility of a regional emergency dispatch operations center in
Essex County and authorized $5,000 to be used for that purpose. A study was conducted and distributed to the Board.
The next step is to apply for a grant to construct a regional dispatch center under the auspices of the Essex County
Sheriff's Department.
TOWN MANAGER'S REPORT:
The Town did an excellent job in responding to the ice storm emergency and subsequent power outage. Emergency
Management, Fire, Police and DPW departments all worked tirelessly during this difficult situation in a well-coordinated
and effective fashion. Special appreciation should also be extended to National Grid for their diligent work in restoring
power to the Town, the Red Cross for helping us set up an Emergency Shelter and Main Street Hardware for staying open
throughout the emergency. Because the Governor declared a State of Emergency there is a possibility that the Town may
be partially reimbursed by the Federal and State Governments for our costs in responding to the storm.
Due to the ice storm emergency, the Town Manager was not able to complete work on the FY10-14 Capital Improvement
Plan or the five-year financial projection for this meeting. Once this work is completed, it will be distributed to the
Selectmen, Finance Committee and School Committee.
The Board of Selectmen and the Town Manager wished everyone a safe and happy holiday season.
