NORTH ANDOVER Zoning Board of Appeals, hereby certifies that the following is a detailed record of
the board's proceedings and decision regarding the above captioned application regarding the property
located at Map='l04.D' and Block='0031' which property is affected by this decision.
The above captioned application requests a(n) Variance from 7.3 of the North Andover Code to allow
Variance from 7.3 & Table 2 for side lot line in order to continue the existing barn..
A True copy of the application is on file in the Office of the City Clerk.
A notice of public hearing on this application, a true copy of which is on file in the office of the City Clerk

The Board of Appeals held a public hearing on Monday evening,
September 17, 198.4._ u-pon._the application. of Andrew F. Cashman.
The hearing was advertised in the North Andover Citizen on August
30 and September 6, 1984 and all abutters were notified by regular
mail. The following members were present and voting:, Alfred E.
Fri.zelle, Esq., Vice Chairman; Richard J. Trepanier, Esq.,.Clerk;
William J. Sullivan; Augustine W. Nickerson; and Associate Member
Walter F. Soule.
The petitioner seeks a variance from the provisions of Section 7,
Paragraph 7.3 and Table 2 of the Zoning By Law so as to permit
relief from the side setback requirement to allow the continued
existence of a barn on premises located at 1004 Salem Street,
located in the Residential -2 (R-2') zoning district.
The petitioner's agent testified that a .recent plot plan drawn for
conveyance purposes revealed that the, barn located on the property
is in violation. Since the lot was formed prior to 1957, the
sideline requirement is 12.feet and the structure is 8 feet from
the side lot line. The structure 'in violation was constructed
prior to the petitioner purchasing the property. Denial of the
variance would create.a financial hardship to the petitioner.
No opposition was voiced at the hearing.''

Upon a motion made by Mr: Trepani'er and seconded by Mr. Sullivan,
the Board voted unanimously to grant the variance as requested.
In granting the variance, the Board finds that Section 10.4 of the
Zoning By Law has'been satisfied. In particular, the Board finds
that a literal enforcement of the provisions of the By Law would
create a financial hardship to the petitioner since the barn would
have to be removed. Further, the Board finds that said variance
.will not substantially derogate from the intent and purpose of the
By Law nor will it create a detriment to the public good.

Every application for action by the Board shall be made on a form
approved by the Board. These 'forms shall be furnished by the clerk
upon request. Any communication purporting to be an application
shall be treated as mere notice of intention to seek relief until
such time as it is made on the official application form. All in-
formation called for by the form shall be furnished by the applicant
in the manner therein prescribed
Every application shall be submitted with a list of "Parties in
Interest" which list shall include the petitioner, abutters, owners_
of land directly opposite on any public or private street or way,
and abutters to the abutters within three hundred feet of the property
line of the petitioner as they appear on the most recent applicable -
