Said premise affected is property with frontage on the South side of Osgood Street within the GB zoning district Legal notices were sent to all names on the abutter's list and were published in the Eagle -Tribune, a newspaper of general circulation in the Town of North Andover, on February 25 & March 3, 2008. There was no quorum at the March 11, 2008 meeting. Richard J. Byers read the legal notice to open the hearing during the April 8, 2008 meeting. The following voting members were present: Ellen P. McIntyre, Richard J. Byers, Albert P. Manzi, III, Thomas D. Ippolito, and Daniel S. Braese. Upon a motion by Richard J. Byers and 2nd by Ellen P. The proposed sign shall be located on 1005-1025 Osgood Street [Map 35, Parcel 201 as shown on the above -sited Plan #15535 and in accordance with the conditions in the Planning Board Site Plan Special Permit dated September 5, 2006 and the Planning Board Watershed Special Permit dated September 5, 2006. 2. External illumination shall focus on the sign face, only. If ground lighting is provided, the light source shall be screened from oncoming traffic. Voting in favor: Ellen P. McIntyre, Richard J. Byers, Albert P. Manzi, III, Thomas D. Ippolito, and Daniel S. Braese. The Board finds that the applicant has satisfied the provisions of Section 6, Paragraph 6.6.D.2 of the Zoning Bylaw and finds that the granting of this Special Permit for a ground sign larger than 25 sq. ft. and higher than 8' at 1005- 1025 Osgood Street (State Routes 125 & 133) is an appropriate location for a maximum 13'x11.5' ground sign frame with a maximum 48 sq. ft. sign face. The Board finds that the proposed sign is not incongruous with other State Route 125 business district ground signs. The Board finds that this ground sign, as constructed under the above conditions, with enduring materials color -matched to the 1005-1025 structures as depicted in the above cited sign drawings help provide for the proper operation of the site, will not adversely affect the neighborhood, nor be injurious to traffic and safety conditions therein, nor be a nuisance or serious hazard to vehicles or pedestrians by providing an unobstructed sight line below the sign face. The Board finds that this Special Permit is in harmony with the general purpose and intent of Section 6, Paragraph 6.2.3. "to encourage signage and lighting which aid communication, orientation, identify activities...". The purpose of the proposed sign is to identify the 1005-1025 occupants to vehicles on state routes 125 &133; especially, to identify the lower level occupants, which are not visible from the road. Note: 1. This decision shall not be in effect until a copy of this decision is recorded at the Essex County Registry of Deeds, Northern District at the applicant's expense. 2. The granting of the Variance and/or Special Permit as requested by the applicant does not necessarily ensure the granting of a building permit as the applicant must abide by all applicable local, state, and federal building codes and regulations, prior to the issuance of a building permit as required by the Inspector of Buildings. Furthermore, if the rights authorized by the Variance are not exercised within one (1) year of the date of the grant, it shall lapse, and may be re-established only after notice, and a new hearing. Furthermore, if a Special Permit granted under the provisions contained herein shall be deemed to have lapsed after a two (2) year period from the date on which the Special Permit was granted unless substantial use or construction has commenced, it shall lapse and may be re-established only after notice, and a new hearing. 1 North Andover Zoning Board Appeals Albert P. When requesting a Special Permit from the requirements of MGLA ch. 40A, and the North Andover Zoning By-laws, all dimensional requirements shall be clearly identified and factually supported.
