The following members were present and voting: Frank Serio, Jr., Chairman, Walter Soule, Clerk, Raymond Vivenzio and Scott Karpinski. The hearing was advertised in the North Andover Citizen on March 23 and 30, 1994 and all abutters were notified by regular mail. Upon a motion by Mr. Vivenzio and second by Mr. Karpinski the Board voted unanimously to GRANT the variance as requested due to wetland configuration affecting soil, condition and topography of this lot. The Board finds that the petitioner has satisfied the provisions of Section 10, Paragraph 10.4 of the Zoning Bylaw and that the granting of this variance will not adversely affect the neighborhood or derogate from the intent and purpose of the Zoning Bylaw. These variances have been requested due to the presence of wetlands in the rear of the lots and the difficulty of meeting both the setback from wetlands and the front yard setback from Route 114. Since this variance request appears to meet the "soils, slope or topography" criteria for a hardship, and since the request is intended to minimize wetland impacts, the Conservation Commission supports the variance request before you.
