The current exemption for "homeowners" was extended to include owner -occupied dwellings
of six units or less and to allow such homeowners to engage an individual for hire who does
not possess a license, provided that the owner acts as supervisor. (State Building Code Section 109.1.1)
DEFINITION OF HOMEWOWNER:
Person(s) who owns a parcel of land on which he/she resides or intends to reside, on which
there is, or is intended to be, a one to six family dwelling, attached or detached structures ac-
cessory to such use and and/or farm structures. A person who constructs more than one home in a
two-year period shall not be considered a homeowner. Such "homeowner" shall submit to the Building Official,
a form acceptable to the Building Official, that he/she shall be responsible for all such work performed under the
building permit. (Section 109.1.1)

The Board of Appeals held regular meeting on Tuesday evening, April
17, 1997 upon the petition of Pacific Realty Trust requesting a
Variance under Section 7, Paragraph 7.1'and Table 2 of the Zoning By -
Law seeking relief from the required lot dimension. The following
members were'present and voting: Raymond Vivenzio, John Pallone,
Robert Ford, Scott Karpinski, and Joseph Faris. $,
The hearing was advertised in the Lawrence Eagle Tribune on March 26,
1997 6 April 2, 1997 all abutters were notified by regular mail.
Upon a motion by John Pallone, seconded by Raymond Vivenzio to grant
the petition as requested in R-1 Zoning District seeking relief from
the lot dimension area to create two separate lots. It was determined
that the unique shape and topography and wetland on this parcels would
create a hardship for the petitioner. Voting member were: Raymond
Vivenzio, John Pallone, Robert Ford, Scott Karpinski and Joseph
Faris. ,
Petitioner has satisfied the provisions of Section 10, Paragraph 10.4
of the Zoning Bylaw and that the granting of this variance will not
adversely affect the neighborhood or derogate from the intent and
purpose of the Zoning By law. The variance is in keeping with the
general harmony of the area and is compatible with the lot size and
number of homes in the neighborhood.
Note: The granting of the variance and/or Special Permit as requested
by the applicant does not necessarily ensure the granting of a
Building permit as the applicant must abide by all applicable local,
state and federal building codes and regulations, prior to the -
issuance of a building permit as required by the Building
Commissioner.

COMPLIANCE STATEMENT: The proposed building design described here is consistent with the building plans,
specifications, and other calculations submitted with the permit application. The proposed building has been designed to
meet the Massachusetts Energy Code requirements in REScheck Version 3.6 Release 2 (formerly MECcheck) and to
comply with the mandatory requirements listed in the REScheck Inspection Checklist.

Air Leakage:
Joints, penetrations, and all other such openings in the building envelope that are sources of air
leakage must be sealed.
When installed in the building envelope, recessed lighting fixtures
shall meet one of the following requirements:
1. Type IC rated, manufactured with no penetrations between the inside of the recessed fixture
and ceiling cavity and sealed or gasketed to prevent air leakage into the unconditioned space.
2. Type IC rated, in accordance with Standard ASTM E 283, with no more than 2.0 cfin (0.944
L/s) air movement from the the conditioned space to the ceiling cavity. The lighting fixture
shall have been tested at 75 PA or 1.57 lbs/fit pressure difference and shall be labeled.
Vapor Retarder:
[ ] Required on the warm -in -winter side of all non -vented framed ceilings, walls, and floors.
Materials Identification:
[ ] Materials and equipment must be identified so that compliance can be determined.
[ ] Manufacturer manuals for all installed heating and cooling equipment and service water heating
equipment must be provided.
[ ] Insulation R -values, glazing U -factors, and heating equipment efficiency must be clearly marked on
the building plans or specifications.
Duct Insulation:
Ducts shall be insulated per Table J4.4.7.1.
Duct Construction:
All accessible joints, seams, and connections of supply and return ductwork located outside
conditioned space, including stud bays or joist cavities/spaces used to transport air, shall be sealed
using mastic and fibrous backing tape installed according to the manufacturer's installation
instructions. Mesh tape may be omitted where gaps are less than 1/8 inch. Duct tape is not permitted.
The HVAC system must provide a means for balancing air and water systems.
Temperature Controls:
[ ] Thermostats are required for each separate HVAC system. A manual or automatic means to
partially restrict or shut off the heating and/or cooling input to each zone or floor shall be provided.

The majority of the reinforcing was in place as was the form work. All

The contractor was asked how they were going to stabilize the inner

layer of reinforcing against movement during concreting operations.
He stated that these rods would be tied off to the wall ties to prevent
them from moving.

The brick shelves were formed or being formed at the time of the visit

and appeared solid.

Interior footings were already cast and looked to be well constructed

from our vantage point standing on top of the forms. Wall footings
looked uniformly constructed with edges relatively straight.
Construction of the footings was viewed by the building inspector at
an earlier date.

The owner was made aware of the need to keep the walls wet for the

first two days after casting to minimize shrinkage cracking.

Dear Mr. Murphy.
Pursuant to your request modifications have been made with respect to the service at the above
referenced location which includes:
1) Panel Neutrals;
2) Support at the meter socket;
3) Grounding at the water supply (meter not installed);
4) 2" Bonding Bushings at the pole in addition to ground clamps existing;
5) 2" Bushings in the meter socket;
With respect to point 5, please be advised the request has been complied with even though the
National Electrical Code does not call for a bushing on PVC pipe. Pursuant to NEC 300.4 (F) the
installation was compliant in that respect.
Where raceways containing ungrounded conductors 4 AWG or larger enter a cabinet, box enclosure,
or raceway, the conductors shall be protected by a substantial fitting providing a smoothly rounded
insulating surface, unless the conductors are separated from the fitting or raceway b
substantial insulating material that is securely fastened in place. NEC 300.4(F)
