RE: Selective cutting of a dying pine tree within the 25' No Disturb buffer zone of a wetland
resource area
This is a follow up letter pertaining to your request to remove one (1) pine tree which is dying
and is within the 25' No Disturb buffer zone to the wetland resource area at 103 Fuller Road.
The tree was identified by me on September 2, 2010 on site. It was determined that the tree,
which is a small/ medium pine, was located within the 25' No -Disturbance Zone pursuant to the
North Andover Wetlands Protection Bylaw (C. 178 of the Code of North Andover). The tree
was observed to be dying and is in close proximity to the house and yard posing a safety
hazard. Removal of vegetation, including pruning and cutting, is prohibited within the No -
Disturbance Zone except in rare circumstances, such as safety. The tree is identified in the
attached photo.
The stump is permitted to be cut off flush with the ground, however the stump and roots must
remain. The tree is permitted to be removed by hand with no machinery allowed in the
resource area or within the 25' No Disturbance Zone. Removal of additional trees is not
permitted at this time. You may request permission from the Conservation Commission to
remove additional trees by obtaining certification from an arborist that the tree or trees are
dying and therefore present a safety hazard.
The approved tree removal will be subject to the following conditions:
❖ The work approved in this letter shall be completed by December 1, 2010.
❖ No machinery shall enter the 25' No -Disturb Zone.
❖ No work shall occur in resource areas.
❖ All tree limbs, brush, and other debris materials shall be taken off site and disposed of
properly.
❖ The stump of the tree shall not be removed and shall be left in place.
❖ Upon completion of the tree removal, all disturbed areas shall be properly stabilized.
❖ The applicant shall notify this department immediately following completion of work for a
final site inspection.
❖ This area shall remain in a natural state and no further vegetation shall be removed.
