CALL TO ORDER: Chairman Tracy M. Watson called the meeting to order at 7:00 PM at Town Hall Meeting
Room.
ATTENDANCE: The following were present: Tracy M. Watson, Chairman; Daniel P. Lanen, Vice Chairman;
Rosemary Connelly Smedile, Clerk; Richard A. Nardella, Licensing Chairman; William F. Gordon; Mark Rees,
Town Manager; Ray Santilli, Assistant Town Manager.
EXECUTIVE SESSION:
Rosemary Smedile made a MOTION, seconded by William Gordon, to move into Executive Session to discuss
Collective Bargaining and Real Estate Matters. Vote approved 5-0.
PLEDGE OF ALLEGIANCE
COMMUNICATIONS,ANNOUNCEMENTS, AND PUBLIC COMMENT:
The Town Manager added two additional items to the Agenda: The Closing of Windrush Farms and a Report
from the Town Clerk on the upcoming State Election.
APPROVAL OF MINUTES:
Rosemary Smedile made a MOTION, seconded by William Gordon, to approve the following Open Session
Minutes from November 9, November 23, December 4, December 8, and Executive Session Minutes from
November 9, 2009. Vote approved 5-0.
Rosemary Smedile made a MOTION, seconded by Daniel Lanen, to approve the Executive Session Minutes
from November 18, 2009. Vote approved 4-0-1. William Gordon abstained.
Announcements
There will be a Live Nativity on the North Andover Common on Tuesday, December 22, 2009 from
6:00 a.m. — 10:00 p.m. and Caroling from 6:00 p.m. to 8:00 p.m. Accepting donations will be distributed to the
Lazarus House and A Women's Concern.
School Committee Chairman Stan Limpert thanked the Police Department for handling the emergency on
Mass Avenue and the Department of Public Works for their excellent work cleaning up the snow for the town
over the past week.
Town Clerk Joyce Bradshaw announced that absentee ballots will be available for the State Election on
January 19„ 2010. Last day to register to vote is December 30, 2009. Voting will be held at North Andover
High School.
Windrush Farm Acquisition
Rosemary Smedile made a MOTION, seconded by Richard Nardella, to approve the Purchase and Sale
Agreement between the Trust for Public Land as Seller and the Town of North Andover as Buyer for the
purchase of 160 Acres in Fee (the "Fee Parcel") and a Conservation Restriction (the "CR") over approximately
26 Acres of land known as Windrush Farm and shown on Assessor's Map 105A, Parcels 9, 10, 12, 14 and 16
and as also described in a deed recorded at North Essex District Registry of Deeds in Book 940, Page 382,
and in Registered Land Certificate of Title Number 5096, Book 34, Page 385, but excluding the property
transferred by Marjorie M. Kittredge, Trustee, to Windrush Farm Therapeutic Equitation ("WFTE") Inc., by deed
dated August 26, 2005 and recorded as Registered Land Document Number 90198;
To accept the deed from TPL or Marjorie M. Kittredge, Individually and as Trustee ("Kittredge"), to the Town
for the 160 Acre Fee Parcel;
To accept the Conservation Restriction (CR) from Kittredge on the 26 Acre Parcel ("Restricted Parcel") to be
acquired by WFTE;

To grant the Donated Conservation Restriction ("Donated CR") on the 160 Acre Fee Parcel to Essex County
Greenbelt Association, Inc.;
To approve the Order of Taking for the 160 Acre Fee Parcel;
To grant to Windrush Farm Therapeutic Equitation, Inc., ("WFTE") a License for Use of Trails on the Fee Land,
which shall be effective upon acquisition of the Fee Parcel by the Town and acquisition of the Restricted
Parcel by WFTE; and
To authorize the Chairman of the Board of Selectmen to sign any documents required to complete the
transactions herein approved. Vote approved 5-0.
CONSENT ITEMS:
Request to Use Town Common for Display Purposes
Andy Beresford is requesting permission to hang banners on the Town Common from December 22, through
January 7, 2010. The Town Manager recommended approval.
Richard Nardella made a MOTION, seconded by Daniel Lanen, to approve the display of banners on the Town
Common as described in the application from December 22, through January 7, 2010. Vote approved 5-0.
Request to fill Purchasing Director Vacancy
Richard Nardella made a MOTION, seconded by Daniel Lanen, to authorize the Town Manager with the
assistance of the School Superintendent to fill the vacancy in the Purchasing Director position. Vote approved
5-0.
Acceptance of Leak Detection Grant from MA Department of Environmental Protection
The Board was requested to accept a grant from the MA DEP in the amount of$35,000 that will be used
primarily for leak detection/correction and calibration of large meters.
Richard Nardella made a MOTION, seconded by Daniel Lanen, to accept the Leak Detection Grant from the
Massachusetts Department of Environmental Protection. Vote approved 5-0.
LICENSING:
Rosemary Smedile made a MOTION, seconded by Daniel Lanen, to move into Licensing. Vote approved 5-0.
Cedar Crest Restaurant—585 Chickering Road
Mary Claire Kennedy came before the Board as owner of Cedar Crest Restaurant. She requested an all
alcoholic beverages license, common victualler license and entertainment license at the location of 585
Chickering Road. They plan to open around mid January 2010.
Daniel Lanen made a MOTION, seconded by Rosemary Smedile, to approve an all alcoholic beverages
license, common victualler license and entertainment license and wished the owner success in the business.
Vote approved 5-0.
Annual Renewals
Janet Eaton, Clerk to the Licensing Commissioners, with the assistance of the Treasurer/Collector, Building
Inspector, the Police Department and the Fire Department has compiled a list of renewals for various
licensees issued by the Licensing Commissioners. There are a few exceptions listed regarding compliance, or
lack there of, on the Board's policy on TIP's certification. The Chair suggested giving them 90 days to comply.
Rosemary Smedile made a MOTION, seconded by Daniel Lanen, to approve all the license renewals with
proviso that all establishments are in compliance with TIP's certification within 90 days. Vote approved 5-0.

OLD BUSINESS:
Determination to conduct liquor violation hearing; Millennium Eatery, Inc. d/b/a Beijing Restaurant
There have been three incidents of alleged over serving of patrons at the Beijing Restaurant in violation of the
Commissioners Rules and Regulations. The Board was requested, based on the contents of police reports
whether to conduct a liquor violation hearing.
Mr. Victor Ng, a new manager that has been with the restaurant for only three weeks spoke for the owners of
the Beijing Restaurant.
Richard Nardella said that since Mr. Ng had only been with the restaurant for a short time, the Commissioners
would allow him more time to familiarize himself with the security plan, surveillance and ways to improve
securing a safe environment by not over serving patrons for their own safety and the safety of all Town
residents.
The Commissioners said if there are any more infractions during the holidays there would be severe
consequences and a possible loss of license. Selectman Nardella requested that Mr. Ng and the restaurant
owners return on January 25, 2010. The Board would then determine whether to conduct a liquor violation
hearing.
Rosemary Smedile made a MOTION, seconded by Daniel Lanen, to move out of Licensing. Vote approved 5-
0.
NEW BUSINESS:
FY11-15 General Fund Capital Improvement Plan
The Town Manager presented the Capital Improvement Plan FY2011-2015 (CIP) for the General Fund for the
Board's consideration. The Town Manager recommended eleven projects totaling $2,986,000.

The Board was asked to review the recommended CIP and make recommendations to the Town Manager.
The Town Manager and the Board will schedule a workshop meeting in January 2010.
Movie and Film Production Policy
The Police Department drafted a Town of North Andover Movie and Film Production Policy governing filming
on public and private property in North Andover. The Board was asked to review and provide comments.
TOWN MANAGER'S REPORT:
The Department of Revenue certified the Town's Tax Rate for FY2010 at 12.74 for residential
properties and 17.69 for Commercial, Industrial and Personal Property. While approving the tax rate,
the DOR did raise concerns about the Town's negative free cash and deficits in the Water Enterprise
and Stevens Estate Enterprise Funds. Appreciation should be expressed to the Town's Financial
Team; the Town Accountant, the Treasurer/Collector and the Assessors for their hard work in having
our tax rate approved in a timely manner this year.
The Town will be receiving $24,730 from the state as our pro-rated share of$5.5 million dollars
distributed to 165 communities to reimburse the Town for expenses related to the December 11-12,
2008 ice storm. We had previously received $168,665 from the Federal Government for
reimbursement for this storm.
As reported to the Board previously, DPW Director Bruce Thibodeau, acting in his capacity as the
Town's Tree Warden, conducted a public hearing on December 15, 2009 on the removal/pruning of
91 Town owned public shade trees. A report on that hearing is enclosed. Based on the results of that
hearing and feed back from the posting of the individual trees, Mr. Thibodeau will be granting
permission for this work to be done.
The Town Manager gave an update on the work being done at the new police station. Construction
began on November 11, 2009 and completion date is slated for September 11, 2010.
The Town Manager and the Board of Selectmen wished all a Very Merry Christmas and a Happy and
Safe New Year.
