Andover, MA 01845* ********************* TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS Petition: 4140-90 DECISION The Board of Appeals held a public hearing on Tuesday evening, March 12, 1991 at 7:30 p.m. upon the application of Sewi S. Yu requesting a variation of Section 4.135, Paragraph 2-b(I) of the Zoning Bylaw so as to permit construct ion of addition of 10' to closed -in porch with wrap around deck within 100' of a tributary in the Watershed District on the premises located at 104 Bonny Lane. The following members were present and voting: Frank Serio, Jr., Chairman, Walter Soule, Clerk, Raymond Vivenzio, Anna O'Connor and Louis Rissin. The hearing was advertised in the North Andover Citizen on February 20, 1991 and February 27, 1991 and all abutters were notified by regular mail. Upon a motion made by Mr. Vivenzio and seconded by Mr. Soule, the Board voted, unanimously, to GRANT the variance as requested provided a plot plan be given to the Board prior to issuance of a building permit. The Board finds that the petitioner has satisfied the provisions of Section 10, Paragraph 10.4 of the Zoning Bylaws and the granting of this variance in particular will not derogate from the intent and purpose of the Zoning Bylaw now will it adversely affect the neighborhood.
