Box 86, Methuen DATE: 6/11/02 MA 01844 ADDRESS: for properly at: 104 High Street PETITION: 2002-020 North Andover, MA 01845 HEARING s : 4/9/02,6/11/02 The North Andover Zoning Board of Appeals held a public hearing at its regular meeting on Tuesday, June 11, 2002 at 7:30 PM upon the application of Saraceno Construction, for property at: 104 High Street, North Andover, MA requesting a Variance from Section 7, Paragraph 7.2 of Table 2 for relief of street frontage on Lot `B" in order to subdivide an existing lot into two separate lots; one conforming lot and one non -conforming lot. Lot "A" would have sufficient area and street frontage, however, lot `B" would have insufficient street frontage within the R-4 zoning district. The following Board members were present: Robert P. Ford, Walter F. Soule, Ellen P. McIntyre, George M. Earley, & Joseph D. LaGrasse. William J. Sullivan & Scott A. Karpinski were not eligible to vote on this petition Motion was made by Joseph D. LaGrasse and 2nd by Ellen P. McIntyre to grant a variance of 14.67' from the requirements of Section 7, Paragraph 7.2 for relief of street frontage of Lot `B" in order to subdivide an existing lot into one conforming and one non -conforming lot. Voting in favor: None. Voting in opposition: Robert P. Ford, Walter F. Soule, Ellen P. McIntyre, George M. Earley, & Joseph D. LaGrasse on the grounds that substantial detriment to the public good would occur from increased risk to public safety at the intersection of Prescott Street, the only vehicle exit for a high-density residence complex, a multi -tenant commercial complex parking lot, and the proposed driveway on the bend of High Street. The petition would affect the zoning district in general by allowing a two family building at the rear property line overlooking abutter's back yards and breaking the character of an older neighborhood where houses are close to the High Street. BOARD OF HEALTH 120 MAIN STREET NORTH ANDOVER, MASS. 01845 Re: Harriet Mc Questin 104 High St. 12-22-88 TEL. 682-6400 On 11-29-88 I spoke to tenant Nancy Hurley at 98 High St. on the phone. She said there was no heat. I called Harriet at 2:20 pm, exactly 5 minutes after talking to Hurley and she said the heat was on. At 2:30 pm that same day I entered the house to see which party was lying to me. Both floors, numbers 98 and 104, were heated to 78 °F. It is not my belief that the heat could have been off at 2:15 yet heat the house to 781 in that time. I told the tenant not to call me again unless a problem existed. I made the inspection on March 14 as requested. During my insps*ctionv % found a number of violations that will have to be taken cape of before a Certificate can be issued. The violations are as followsx 1) The rear means of egress does not meet the requirements of the Building Code.The egress needs to be a minimum of 32 inches wide and 6 feet 6 inches high. 2) GFI plugs must be installed at the kitchen and the bathroom sinks. 3) Any window closer to the floor than 18 inches will Meed to be either safety glass or have a railing installed. Your contractor will be requirnd to come in and takn out a building permit to do the required work. When the repairs are made we will issue you a Certificate of Occupancy. Your tenant (Nancy Herley) also expressed concern about the possibility of lead paint being present in the apartment. On l informed you I am not qualified to make that determination and I told you to contact one of the testing people listed in the phone book. Alsov you may contact the Lead Paint Clinic at 686-4470. % will be waiting to hear from you about clearing up this matter.
