The Board of Appeal's held a regular meeting on Tuesday evening, September 12, 1995

applicant, Ten Forte Mme Realty Trust is requesting Variances pursuant to Section 7,
Paragraph 7. L, 7.3 and Fable 2(Lot and Zoning Dimensions) of the Zoning Bylaw, The
applicant is also requesting a special permit pursuant to Section 9, paragraph 9.2(1)(-Non-
conforrring structures) of the Zoning Bylaw.
The following members were present and voting: William Sullivan, Raymond Vivenzio,
Walter Soule, Scott Karpinski and Joseph Faris.
The hearing was advertised in the North Andover Citizen on 8.2 3.95 and 8.30.95 and all
abutters were notified by regular mail.
Motion by Raymond Vivenzio to Grant the Special Permit for the alteration of a norl-
cor,forn, ing structure as indicated on plans revised 9-15-95 prepared for Colonial Village
Development Corp. by Merrimack Engineering, subject to the applicant submitting a
written request to withdraw his request for the variances, seconded by Scott Karpinski.

The Board finds that the applicant has satisfied the provisions of Section 9, para. 9.1 of

Subject:MS Allicon Property, 1049 Turnpike (St) Realty Trust Public Hearing

Dear Chairman:
in the Notice my mom received it did not mention Foot Note 1.1 or FN1.1 (1) of
the zoning bylaw. Further the 35' should read 85' and the 50' should read
1001. Also it is not clear what the petitioner's intended use is. I am
guessing residential. If it is for residential use the Notice should include
9.2 (3), 9.2 (4) and 9.4. UNDER SECTION 9 - Non -Conforming uses it states that
no changes, extended or altered shall be permitted unless there is a finding by
the BOA that such changes, extensions, or alterations shall not be
substantially more harmful (Ref. 9.1). Substantial alterations have been
ongoing since March of this year.
Why include 9.2 (3)? The original living space will be doubled if granted.
This expands it 100%. Bylaw states expansion not to exceed 25%.
Why include 9.2 (4)? Existing house has exceeded its economic life including
its original amortization (see att'd exhibit "A"). MS Allicon was its only
occupant and little or no upkeep for 65 years, as proof by the premature
alterations being done now.
Why include 9.4? Since 1992 the house has been unoccupied. this exceeds the
two year discontinued period. This can be verified.
General. We had heard that the alterations presently going on was for office
use (heresay). We have no problem with an office use as it complies with uses
allowed, and it appears to be the same size. If the intent is to double the
non -conforming residential use and further, do it in an "unbuildable Buffer
zone", then we wish to go on record as opposed.
Reason Opposed. If for residential use, 1. Abandonment for over two years
verifiable. 2. House exceeds its life expectancy (as proof, purchase price on
Feb. 23, 1995 reflects land value only, $49,875 - ref. Bankers & Tradesman).
3. Exceeds 25% increase, is 100% increase request. 4. For the best interest of
the townspeople this petition to vary our bylaws and to provide a SP should be
denied.
Summary. Both bordering properties do not encroach Rte. 114 highway as
harshly, that is, 1001 Turnpike St. (Agnes Kmiec) and 1101 Turnpike St. (John
Hancock who rents to Mass Electric Co.). Even the Mini Storage and ABC Bus Co.
exceed the 100' setback. Please do not practice in allowing improper uses to
expand in non -residential districts. This should be discouraged more so in a
buffer zone which this is in. Sensitive Rte. 114 needs the protections set in
place by two town master plans and two past town planners. If this is granted,
it can only produce long -run problems. This petitioner has ample building area
behind the 100' setback and for uses allowed in present zone. Preserving the
buffer zone is necessary to keep the corridor un -jammed and provide an
attractive appearance form the highway and future widenings. For the 29,000
driving 114 today and the best interest of the citizens of North Andover, I
