Relative to the enclosed correspondence I received from your office
dated April 11, 1988. This problem was originally thought to be caused by
a loose pipe under the kitchen sink. However, I have since learned that there
was a rotted drain pipe underneath the bath tub. This situtaion has been
corrected and I don't expect any further problems. Also, I have been in contact
with the owner of unit #10 and offered to resolve any insurance matters that
may arise.

PRELIMINARY NOTICE
Dear Mr. McLaughlin and Ms. Nazzaro,
It is the duty of the Board of Health to inform the
owners of rental units of any code violations. It appears,
after an inspection by an agent of this office, that an
apartment you own is in violation of CMR: 410.351: Owner's
Installation and Maintenance Responsibilties (copy
enclosed). Apartment 12, at Heritage Green, 105 Farrwood
Ave. is the source of a leak which is noxioius to the
habitant of Apartment 10, located directly below Apartment
12. The owner of Apartment 10 has been notified of this
problem. Your prompt atttention to correcting this matter
is appreciated.

Dear Mr. McLaughlin:
This is to inform you of the problem that my tenant, Marie McOwen, at
105 Farrwood Road, Apt. 10, North Andover, has been experiencing.
Since January, her bathroom ceiling, directly below your unit's bath-
room, has been leaking right over her toilet, causing her a great deal
of aggravation. She is elderly and does not aiway feel well. It was
so bad at one point that her daughter called me because she was so con-
cerned for her mother. After a good deal of calling to have this prob-
lem corrected, it now seems as if the leak has finally been taken care
of.
As your unit is a Heritage package and under warrantee, I was told to
contact you so that you would call Nancy Jones in the office at Heri-
tage Green to request that Mrs. McOwen's ceiling be replaced and any
other damage be repaired or replaced.
I would appreciate your immediate response to what has been a very
annoying situation.

I have finally received a copy of your letter dated May 6, 1988, which
was initially sent to me at the wrong address. I want you to know that I immediately
made contact with my insurance agent--McDuffee Insurance Agency --Tel 617-433-2728.
I have been informed by them and have subsequently reasearched the condominium documents
to find that your claim of damage would be with the insurance company that insures the
condominium. I refer you to the Condo documents and have enclosed a copy of Section
5.8.1. (A) which indicates that it covers all of the common areas and facilities excluding
the personal property of the unit owner (which my policy covers). Please call me if I
can be of any further assistance.

P Section 5.7 Managing Agent The Trustees may, at their discretion,
appoint a manager or managing agent to administer the management and opera-
tion of the Condominiu,., including the incurring of expenses, the making of
disbursements and the keeping of accounts, as the Trustees shall from time
to time determine. :ne Trustees or such manager or managing agent may
appoint, employ and remove such additional agents, attorneys, accountants
or employees as the Trustees shall determine.
Section 5.8 Insurance
Section 5.8.1 Coverages The Trustees shall obtain and maintain, to
the extent available at reasonable cost, in their name as insurance
trustees for the Unit Owners, master policies of insurance of the following
kinds insuring the interests of the Trust, the Trustees, all Unit Owners
and their mortgagees as their interests may appear:

A. Casualty Insurance Casualty and physical damage insurance on
the building and all other insurable improvements forming part of the
Condominium (including all of the common areas and facilities and all
of the Units and excluding only personal property of the Unit Owners
be altered by
therein), now existing or as they may from time to time
amendment to the Master Deed, together. with the service machinery,
apparatus, equipment, personal property and supplies of the Condominium
Trust, and installations located in the Condominium and existing for
the provision of central services or for common use, in an amount not
less than 100% of their full replacement value (exclusive of land,
footings, excavations, foundations and such other like items as are
damage by fire

normally excluded.from coverage), against (1) loss or
ana other hazards covered by the standard extended coverage endorsement
and the standard "all risk" endorsement, and (2) such other hazards and
risks as the Trustees from time to time in their discretion shall
determine to be appropriate, including but not limited to sprinkler
leakage, debris removal, cost of demolition, vandalism, malicious
mischief, windstorm and water damage and plate glass damage. All
policies of casualty and physical damage insurance may, and insofar as
required by the Federal National Mortgage Association or the Federal
Home Loan Mortgage Corporation shall, also include standard so-called
"construction endorsements" including, if available, a Demolition
code
Cost Endorsement, Contingent Liability from Operation of Building Laws
Endorsement, and Increased Cost of Construction Endorsement, or their
equivalent and Replacement Cost, Inflation Guard and Agreed Amount
endorsements or their equivalents. All policies of casualty and
physical damage insurance shall provide (to the extent such clauses are

reasonably obtainable) (1) that such policies may not be cancelled or
substantially modified without at least thirty days' prior written
notice to all of the insureds and each Unit mortgagee, and (2) that the
coverage thereof shall not be terminated for nonpayment of premiums
without thirty days' notice to all of the insureds and each Unit
mortgagee. Certificates of such insurance and all renewals thereof,
together with proof of payment of premiums, shall be delivered by the
Trustees to Unit Owners and their mortgagees upon request at least ten
days prior to the expiration of the then current policies.
