On August 26, 2005 I received a called from Nanci Williams, owner of a 2-
apartment dwelling. This is the second time I have spoken to Mrs. Williams.
I made a run to 106A Beverly Street on the above date. Mrs. Williams and I had
decided that I would inspect after the tenant had move out due to multiple issues
with this particular women for fear of some type of retribution.
Upon my arrival to the property, I could smell a very strong urine odor in the
driveway of the house. I did a complete inspection of the apartment. The odor in
the house was overwhelming, to the point of burning eyes and throat. In the
basement apartment there were stains throughout the room. There was a well-
stained carpet, rolled up on the floor.
The second floor of the dwelling has much of the same problems. The carpet is
still in place with multiple stains throughout the first floor as well as a very strong
urine odor. I pulled up the carpet in the bedroom and there was another layer of
carpet underneath which was well stained.
I believed the homeowners will do their best to relieve the apartment of odor. The
homeowner and I have had many conversations regarding future rentals. I've been
guaranteed that the apartment will not be inhabited until the problems have
rectified.

Please accept this letter in response to your query on the ongoing construction of your home. I
have researched the files and have the following comments in regards to the project.
1) A building permit was issued on June 14, 2001 for the completion of the 2d floor of
the dwelling.
2) The work has been ongoing since this time albeit ever so slowly which is common in
cases where homeowners have obtained their own permit and especially when
contractors are working on their own home!
3) The appropriate inspections have been completed up to the last inspection for the
insulation of the dwelling. The next phase of inspections will be the final inspections
from the electrical, plumbing, fire and then building inspector, in that order.

Health problem with the electrical circuits and to which unit they serve. Due to the nature of this
Department complaint the Health Department will need to access your portion of the building as well as

the inspection as well.

Nurse Please be advised that having reviewed the open Building Department file, this office
(978)688-9543 is aware of the existing issues between the parties that reside at this address, however, this is
the first time any party has contacted this office. A formal request for an inspection to the
Planning Health Department requires action by this office. Our inspectional authority is stated in the
Department State Sanitary Code, CMR 400.100, as are the penalties to obstruct the carrying out of our

(A) Inspection Authority. In order to properly carry out their respective responsibuides
under the State Sanitary Code and properly to protect the health and well-being of the people
of the Commonwealth, the board of health and the Deparmcnt of Public Health or the
authorized agent or representative of either are authorized to enter,examine, or survey at any
reasonable time such places as they consider necessary, and otherwise to conduct such
cxaminadon or survey as is expressly provided in any other chapter of the State Sanitary
Code.

(B) Systematic Area inspections. The board of health and the Depanrnent of Public Health
or the authorized agent or representative of either are authorized to dcvc!oo and adopt plans
for the systematic,periodic arca inspection of dwellings,dwelling units, :coming houses,and
rooming units.
(C) Interference. If any owner, occupant, or other person refuses, impedes, inhibits,
interfcres with, restricts, or obstructs entry and free access to evert pan of the structure,
operation or premise where inspection authorized by the State Sanitary Code is sought, the
board of health or the Commissioner of Public Health or the authorized agent or
rcpresentadve of either may:
(1) seek in a court of competent jurisdiction a search warrant so as to apprise the owner,
occupant or other person concerning the nature of the inspection and justification for it
and may seek the assistance of police authorities in presenting said warrant and/or
(2) revoke or suspend any license, permit or other permission regulated under the State
Sanitary Code where inspection of the structure, operation or pre.^,uses is sought to
determine compliance with the State Sanitary Code.
400.200: Local Enforcement
(A) General Procedures. Unless otherwise expressly provided in any article of the State
Sanitary Code, each board of health may enforce the State Sanitary Code by fine in
accordance with 105 CMR 400.700, or otherwise at law or in equity in the same manner that
local rules and regulations are enforced; except however, 105 CMR 400.000 does not
authorize a bill in equity in lieu of 105 CMR 400.100(C).
(B) Emergency Procedures.
(1) Whenever an emergency exists in which the interest of protecting the public health
requires that ordinary procedures be dispensed with, the board of health or its authorized
agent, acting in accordance with the provisions of M.G.L. c. 111, § 30, may, without
notice or hearing,issue an order reciting the existence of the emergency and requiring that
such action be taken as the board of health deems necessary to meet the emergency.
Notwithstanding any other provision of the State Sanitary Code,any person to whom such
order is directed shall comply therewith within the time specified in the order. Each
day's failure to comply with the order shall constitute a separate offense. Upon
compliance with the order and within seven days after the day the order has been served,
he may file a written petition in the office of the board of health requesting a hearing.
He shall be granted a hearing as soon as possible but not later than ten days after the
t filing of the petition. The procedures for such hearing shall otherwise conform with the
nearing requirements which would have existed had the order been issued under
non-cmergency circumstances.

area of the property.
In my opinion,the work V*needs to be done in the garage ares is not of an in... nature. This
job should not be attempted urrffl the current tanarrts of 106 Beverly Steet lave moved off of tho
property. There is an ongoing dispute between the tenant and landlord and unfinished electrical al work
Inside the property. Thee sre no working smoke de*ctom and taws is open wiring. The job is in e
state of incompletion and if f wem to attempt to work on the property, even though it is in the garage
area l feel that 1 would be opening myself up to potentialy being held liable for the state of unfinished
work Inside the property.

After inspecting the electrical panels at the above address,I found two(2)violations,which must
be corrected immediately.
The National Electrical Code 1999
1. Article 100—Definitions Section A General states:
Accessible,readily(readily accessible)capable of being reached quickly for operation
renewal,or inspections without requiring those to whom ready access is requisite to climb
over or remove obstacles or to resort to portable ladders,etc.
2. Article 230 Section 72 Access to Occupant
In a multiple occupancy building, each occupant shall have access to the occupant's service
disconnection means.
Please have your electrician apply for a permit at the building department and call for an
inspection when the work is complete.Call me at 688-9545.

became a major issue last year, and formed the basis of many
allegations and claims by your client against my own.

you to handle this issue, and you rejected my attempt's to
schedule a date for the work to be done .
My clients will not extend themselves again for the purpose
of having that box moved. Further, based on these events, I will
not entertain future complaints and accusations from your client
about her inability to access that box in the event of a power
failure .

requiring the electrical panels be moved from the tenant side of the building. Its has been three(3)months
since this letter was sent. This issue must be taken care of. Therefore, I'm requiring that this work be
completed in 60 days. You have until May 15,2000 to finish the work or the Town will seek court action
against you.

410.351: Owner's Installation and Maintenance Responsibilities , � ;
The owner shall install in accordance with accepted plumbing, gasfitting and electrical
wiring standards, and shall maintain free from leaks, obstructions or other defects, the
following:
(A) all facilities and equipment which the owner is or may be required to provide including,
but not limited to,all sinks,washbasins,bathtubs,showers,toilets,waterheating facilities,gas
pipes,heating equipment.water pipes,owner installed stoves and ovens,catch basins,drains,
vents and.other similar supplied fixtures; the connections to water, sewer and gas lines; the
subsurface sewage disposal system, if any; all electrical fixtures, outlets and wiring, and all
heating and ventilating equipment and appurtenances thereto; and
(B) all owner-installed optional equipment, including but not limited to, refrigerators,
dishwashers, clothes washing machines and dryers, and garbage grinders.
410.352: Occupant's Installation and Maintenance Remonsibilities
(A) The occupant shall install in accordance with accepted plumbing, heating, gas fitting,
and electrical wiring standards, and shall maintain free from leaks, obstructions and other
defects,all occupant owned and installed equipment such as,but not limited to,refrigerators,
clothes washing machines and dryers, dishwashers, stoves, garbage grinders and electrical
fixtures.
(B) Every occupant of a dwelling unit shall keep all toilets, wash basins, sinks, showers,
bathtubs,stoves,refrigerators and dishwashers in a clean and sanitary condition and exercise
reasonable care in the proper use and operation thereof.
410.353: Asbestos Material Used as Insulation or Covering on Pipes Boilers or Furnaces
Every owner shall maintain all asbestos material which is used as insulation or covering
on a pipe, boiler or furnace, in good repair, and free from any defects such as holes, cracks,
tears, or looseness which may allow the release of asbestos dust or which may allow the
release of any powdered,crumbled or pulverized asbestos material. Every owner shall correct
.any violation of 105 CMR 410.353 in accordance with 310 CMR 7.00 (Department of
Environmental Protection)and 453 CMR 6.00(Department of Labor and Industries)and with
any other applicable statutes or regulations.
410.354: Metering of Electricity and Gas
(A�. The owner shall provide the electricity and gas used in each dwelling unit unless
(1) Such gas or electricity is metered through a meter which serves only the dwelling
unit, except as allowed by 105 CMR 410.254(B); and
(2) The rental agreement provides for payment by the occupant.
(B) If the owner is required,by 105 CMR 410.000 or by a rental agreement consistent with
105 CMR 410.000, to pay for the electricity or gas used in a dwelling unit, then such
electricity or gas may be metered through meters which serve more than one dwelling unit.
(C) If the owner is not required to pay for the electricity or gas used in a dwelling unit,then
the owner shall install and maintain wiring and piping so that any such electricity or gas used
in the dwelling unit is metered through meters which serve only such dwelling unit, except
as allowed by 105 CMR 410.254(B).
410.355: Provision of Oil
The owner shall provide the oil used for heating and/or hot water in each dwelling unit
unless such oil is provided through a separate oil tank which serves only that dwelling unit,
provided however, that 105 CMR 410.000 shall only apply to tenancies created or renewed
after fuly 1, 1994.

410.251: Kitchen Lighting and Electrical Outlets ,� t
The owner shall provide for each kitchen:
(A) one electric light fixture; '
(B) two wall-type convenience outlets located in convenient locations; and
(C) For each ldtchen over 70 square feet,transparent or translucent glass which admits light
from the outdoors and which is equal in area to no less than 8% of the entire floor area of
that]dtchen.
410.252: Bathroom Lighting and Electrical Outlets
The owner shall provide in each room containing,a toilet,bathtub,or shower one electric
light fixture. (See 105 CMR 410.150(A)(1) and 410.150(B).)
410.253: Light Fixtures Other than in Habitable Rooms or Kitchens
(A) The owner shall provide and so locate electric light switches and fixtures in good
working order so that illumination may be provided for the safe and reasonable use of every
laundry,pantry,foyer,hallway,stairway,closet,storage place,cellar,porch,exterior stairway
and passageway.
(B) The owner shall provide working incandescent light bulbs or fluorescent tubes in all
required light fixtures in all common areas of any dwelling.
410.254: Light in Passageways Hallways and Stairways
(A) The owner shall at all times provide,except as allowed in 105 CMR 410.254(B), light
in every part of all interior passageways,hallways,and stairways used or intended for use by
the occupants of more than one dwelling unit or rooming unit so that illumination, alone or
in conjunction with natural lighting, shall be at least three foot candles, measured at floor
level.
(B) In a dwelling containing only three or fewer dwelling units, the light fixtures used to
illuminate a common hallway may be wired to the electric service serving a dwelling unit on
the same floor provided that if the occupant of such dwelling unit is responsible for paying
for the electric service to such dwelling unit, then:
1 (1) the rental agreement shall state that the occupant is responsible for paying for light
in the common hallway; and
(2) the owner shall notify the occupants of the other dwelling units.
410.255: Amperage
The electrical service supplying each dwelling, dwelling unit, rooming house and/or
rooming unit shall supply sufficient amperage to meet the reasonable needs of the occupants.
Should the amperage be determined to be inadequate it shall be corrected so that it meets the
amperage requirements of 527 CMR 12.00: The Massachusetts Electrical Code.
410.256: Temporary Wiring
No wiring shall lie under a rug or other floor convening, nor shall any extend through a
doorway or other opening in a structural element. No temporary wiring shall be used or
made available for use by any owner or occupant; provided, that extension cords which
connect portable electric appliances or fixtures to convenience outlets shall not be considered
temporary wiring.

On August 26, 2005 I received a called from Nanci Williams, owner of a 2-
apartment dwelling. This is the second time I have spoken to Mrs. Williams.
I made a run to 106A Beverly Street on the above date. Mrs. Williams and I had
decided that I would inspect after the tenant had move out due to multiple issues
with this particular women for fear of some type of retribution.
Upon my arrival to the property, I could smell a very strong urine odor in the
driveway of the house. I did a complete inspection of the apartment. The odor in
the house was overwhelming, to the point of burning eyes and throat. In the
basement apartment there were stains throughout the room. There was a well-
stained carpet, rolled up on the floor.
The second floor of the dwelling has much of the same problems. The carpet is
still in place with multiple stains throughout the first floor as well as a very strong
urine odor. I pulled up the carpet in the bedroom and there was another layer of
carpet underneath which was well stained.
I believed the homeowners will do their best to relieve the apartment of odor. The
homeowner and I have had many conversations regarding future rentals. I've been
guaranteed that the apartment will not be inhabited until the problems have
rectified.

Beverly Street.The Health Department has received the following information from the North Andover Building
Department concerning the dumpster.
1) There is a building permit open on the property,for homeowner renovation,that has been in effect for
several years
2) There have been no recent requests for an inspection to be conducted by the building department to
confirm the continued progress in your renovation
3) The Building Inspector observed that materials that were in the dumpster on October 13,2004 which did
not appear to be the same type that is being used at the site.I.e.Remnants of siding that did not match the
home.
These facts indicate that the dumpster is being used as a transfer station,rather than solely for the disposal of items
from the home.A Transfer Station is not an allowed use in a residential area.In addition,if it were allowed,you
do not have a permit from the Health Department for the keeping of a dumpster on your property.This is a
violation to the Town of North Andover regulations regarding Dumpsters.
The construction dumpster must be removed within seven days of the receipt of this letter.Please contact the
Health Department directly if you wish to appeal this removal order or if you wish to discuss this issue further.An
inspection to establish compliance in this matter will be conducted on October 27,2004.Failure to comply may
result in the issuance of monetary fines.
