The reason for my visit was to advise on a job in the garage emu of the property. M my opinion.the work Vest needs to be dome in tris garage area is not of an imneedisft natum. This job should not be attempted unto the current tenarft of 106 Beverly Street have moved off of tho property. There is an ongoing dispute between tree tenant and landlord and unfinished electrical work inside the property. There sre no working smoke detectors and there is open wSring. The job is in a Mate of incompletion and if f were to attempt to work on the property,even though if is in the garage area 1 feel that 1 would be opening myself up to potentially being held liable tot the state of unfinished work lnslde the property. 1 would.be more than happy to cornpWo the job requested of me as soon as the cwrerrt tenents move out. The location of this box became a major issue last year, and formed the basis of many allegations and claims by your client against my own. The complaint alleges that there is a Health problem with the electrical circuits and to which unit they serve. Due to the nature of this Department (978)688-9540 complaint the Health Department will need to access your portion of the building as well as the tenants. In response to our request the electrical inspector will accompany this office on Publthe inspection as well. Nurse Health Please be advised that having reviewed the open Building Department file, this office (978)688-9543 is aware of the existing issues between the parties that reside at this address, however, this is the first time any party has contacted this office. A formal request for an inspection to the Planning Health Department requires action by this office. Unless otherwise expressly provided in any article of the State Sanitary Code, each board of health may enforce the State Sanitary Code by fine in accordance with 105 LNR 400.700, or otherwise at law or in equity in the same manner that local rules and regulations are enforced; except however, 105 C-MR 400.000 does not authorize a bill in equity in lieu of 105 CMR 400.100(0). (B) Emergency Procedures. (1) Whenever an emergency exists in which the interest of protecting the public health requires that ordinary procedures be dispensed with, the board of health or its authorized agent, acting in accordance with the provisions of M.G.L. c. 111, § 30, may, without notice or hearing,issue an order reciting the existence of the emergency and requiring that such action be taken as the board of health deems necessary to meet the emergency. Notwithstanding any other provision of the State Sanitary Code,any person to whom such order is directed shall comply therewith within the time specified in the order. Each day's failure to comply with the order shall constitute a separate offense. Upon compliance with the order and within seven days after the day the order has been served, he may file a written petition in the office of the board of health requesting a hearing. He shall be granted a hearing as soon as possible but not later than ten days after the t filing of the petition. The procedures for such hearing shall otherwise conform with the nearing requirements which would have existed had the order bccn issued under non-emergency circumstances.
