Andover, MA 01810 Re: Central Stairway Mr. Nicetta, As requested our office has reviewed the issue of the open stairway in the corridor space of the project at 1060 Osgood Street and have found our original conclusions to be correct. The stairway would fall under the classification of `Atrium' as described in the Massachusetts Building Code section 780 CMR 404.0. "The term `atrium' shall mean an occupied space that includes a floor opening or series of floor openings, which connect two or more stories. An atrium shall comply with 780 CMR 404.0 where a shaft enclosure is required by 780 CMR 713.3." Under section 780 CMR 713.3 Floor opening enclosure: Exceptions: 2. A floor opening which: 2.1 Is not part of a required means of egress; 2.2 Is not concealed within the building construction; 2.3 Does not connect more than two stories; 2.4 Is separated from other floor openings serving other floors by construction conforming to 780 CMR 710.3; and 2.6 Is not open to a corridor in occupancies in Use Groups I and R, or is not open to a corridor on a floor not equipped throughout with an automatic fire suppression system in other use groups. Our office has met the requirements of the Building Code and will proceed with the revised plans showing two exit enclosures for means of egress and the central stair shall be an atrium. We will use tempered glass for the entry enclosure for safety upon breakage. In order to meet the requirement of Exception 2.1 a fire rated door will be installed in the corridor to the common toilet and the previous enclosure door to Stair# 3 will be moved down the corridor.
