SUBJECT: Planning Board Project Comments
The Conservation Department offers the following comments as it pertains to referenced
projects as listed below:

No wetlands within 100 feet of the proposed work. No filing required with Conservation.

• The wetland boundaries were recently re-confirmed by the North Andover
Conservation Commission(NACC) on 1/29/04 (DEP File #242-1235).
• The project as proposed was first heard by the Conservation Commission at their
meeting of October 13, 2004 and is still being reviewed by the Commission at this time.
All conservation setbacks appear to be met as proposed.
• Only preliminary comments have been made thus far by the Commission, as drainage
of the site has not been reviewed (i.e-the site is extremely tight and the Commission
will most likely require special snow storage requirements).
The applicant has just recently set up an escrow account for the outside drainage
review with the Commission's consultant, Lisa Eggleston.
• The Commission's next meeting will be held on 12/22/04,where I expect the first
round of drainage comments to be presented and discussed.
• I noted the following in my recommendations to the Commission on this project
➢ Project> than 1 acre in size, must meet federal NPDES (National Pollution .
Discharge Elimination System) policy/standards.

➢ Must comply with state and local Stormwater Management Policies (amt
impervious on site to be infiltrated - 17, 350 s.f.)
➢ The stormwater management system consists of a wet detention basin with a
vegetated wet bottom to the rear(north) of the site. BMP's proposed include the
detention basin, drainage swales, and a constructed wetland. Plans do not
clearly define these areas in detail. Stormwater structures should be clearly
marked on the plans.
Please let me know if I can provide further information in this regard.

RE: Special Permit Site Plan Review- 1060 Osgood Street-Pizza Parlor

The applicant is requesting to convert and existing 1176 SF office space to a pizza parlor with a
drive through.
My review is as follows:
SITE PLAN REVIEW:
i. NORTH ARROW/LOCATION MAP: This has been provided on the plan.
ii. SURVEY OF LOT/PARCEL: This has been provided
iii. r NAME/DECRIPTION OF PROJECT: The applicant has provided that the area will
/ be used for a pizza parlor with drive through additional information regarding seating

iv. EASEMENTS/LEGAL CONDITIONS: The area will be leased from the TIAM Realty
LLC. Leased area is 1176 s.f.
v. 'V/ TOPOGRAPHY: This has not been provided, because it is an existing site the
V applicant should request a waiver.

vi. ZONING INFORMATION: This lot has been rezoned from I2 to B2, documentation of
the rezoning has been provided. Eating and Drinking Establishments are an allowed use
in the B2 Zoning District.
Vii. STORMWATER DRAINAGE: The applicant has requested a waiver to this
requirement because it is an existing site.
viii. BUILDING LOCATION: This has been provided.
ix. BUILDING ELEVATION: This has not been provided a waiver should be requested
because it is an existing building. -----_ �_
X. LOCATION OF PARKING/WALKWAYS: Parking has been provided although
confirmation from the Zoning Enforcement Office should be given that the existing
parking is sufficient The plans propose the removal of an existing walkway to make
room for the drive through lane additional detail of the entrance and handicapped
accessibility needs to be provided.
A. LOCATION OF WETLANDS/NOTICE OF INTENT: There are no wetlands
depicted on the plan confirmation from the Conservation Commission would be required
prior to the issuance of an occupancy permit. It would be in the best interest of the
applicant to speak with the Conservation Commission regarding the wetlands.
xii. LOCATION OF WALLS/SIGNS: This information has not been provided.
xiii. LOCATION OF ROADWAYS/DRIVES:No new roads or drives are proposed. Access
to the site will be from existing curb cuts off Osgood Street.
xiv. OUTDOOR STORAGE/DISPLAY AREAS: There is no outdoor storage being
proposed.
xv. LANDSCAPING PLAN: No new landscaping is being proposed.
xvi. REFUSE AREAS: A dumpster is proposed at the northwesterly corner of the lot with a
proposed 6' chain link fence.
xvii. LIGHTING FACILITIES: The site has existing outside lighting.
xviii. DRAINAGE BASIN STUDY: A waiver has been requested.
xix. TRAFFIC IMPACT STUDY: A waiver has been requested with an explanation of the
hours of operation and the expected average of anticipated traffic.
XX. EROSION CONTROLS: None proposed.
xxi. COMMONWEALTH REVIEW: No new curb cuts are proposed.
xxii. UTILITIES: No new utilities are proposed.
xxiii. FISCAL IMPACT: A waiver has been request with the explanation that no increased
demand for public services and infrastructure is required.
xxiv. COMMUNITY IMPACT: A waiver has been requested.
ADDITIONAL ISSUES
The applicant has requested a waiver to outside consulting review. I recommend that the
Planning Board grant this waiver request since the site is existing and there will be no change to
the impervious area.

Item S, Traffic Impact Study:
The business will operate from 10:00 A.M. to 10:00 P.M., Sunday through Thursday;
and, 10:00 A.M. to 11:00 P.M. Friday and Saturday. I expect an average of 10 cars per
hour during the lunch and dinner hours, 11:00 A.M. to 1:00 P.M. and 5:00 P.M. to 8:00
P.M. respectively, to pass through the property. Customers can follow the existing, one-
way traffic pattern around the building for the drive-thru window.

Item V, Fiscal Impact:

Since this business is part of an existing building, there will be no increased demand for
public services and infrastructure. This establishment will provide 3 full time and 5 to 8
part time jobs for the local community and will welcome high school age help for part
time positions. There will not be any impact on adjacent property values or tax
revenues. I hope to gross $300,000 per year.

Item W, Community Impact:
There will be no changes made to the overall structure of the building therefore there
will be no impact on the community with regard to architectural consistency, pedestrian
movement and historic structures. The character of the business will meet or exceed
the character of the surrounding neighborhood. It is compatible with the existing local
businesses since there are other food establishments but no other pizza businesses
within a one mile radius of the site.
