The house is a modest wood frame split level Cape. The house is set near the center of a 20, 900 square foot lot, back 30 feet from Salem Street . The lot is relatively level at the front and right side of the house, with a gradient away from the house at the rear and left side. Theg radient away from the house on the left side creates a drainage swale along the property line which conveys surface drainage away from the property to the rear onto adjacent property. The original sanitary waste disposal system located to the left rear of the house failed in mid-year 1978. Mr. Cottone sought the help of the North Andover Health Board I to wit : i a. Review the plans and soils data of the failed system in an attempt to see what remedial repairs might correct the problem. b. If- the failed system were beyond repair, to direct him precedential , toward the most economically feasible and expedient installation of a new system. Mr. Cottone recalls that the Health Board through its Health Page Two Officer, Mr. Leonard Phillips , declared the failed system non- repairable and that Mr. Phillips set out a plan for a completely new system to the right side of the house. After perk and soils tests at the new location, Mr. Phillips approved plans for a new system which was installed by Kirsch Construction Company of Salem, New Hampshire, some two and a half years ago. This is the system now in failure. INVESTIGATION Our endeavor on behalf of the Cottone family is to establish why a relatively new system, (some two years new) , designed and installed under the jurisdiction of the Health Board failed, and if indeed the site is capable of supporting an on-site waste disposal system to meet the needs of the Cottone family. We were unable to find Mr. Phillips ' approved plans and perco- lation-soils data for the existing system to assist in our investi- gation and analysis . In a meeting with Mr. Thomas Murphy, the current Health Officer for the Town, I was informed that he was called by Mr. Cottone regarding the failed system. Mr. Murphy stated that he made a pre- liminary soils boring and percolation test close in to the failed system and found the ground water to be approximately 6 feet below the surface and a good perk rate of approximately one minute per inch fall . He further stated that he `advised Mr. Cottone to hire an Engineering firm to do precisely what we are doing. To initiate the analysis of the failed system, our field survey crew provided a topographic survey throughout the general area of the system. The survey data, together with other pertinent data, i. e. , the size, location and depths of the septic tank, the distri- bution box, and. the leaching field are delineated on a plan attached as part of this report . Further, soils classification and percolation data are included on the said plan. ANALYSIS Open excavations using a back hoe provided by the Henderson Brothers Construction Company was used to unearth the septic tank, the distribution box and the four corners of the leaching bed. x► Page Three i To check the gradient throughout the system, survey invert elevations were taken at critical points . The elevations taken revealed that the gradient , although minimum, was adequate to convey flows through the various components of the system. Upon opening the four corners of the leaching bed we found the overall size of the leaching bed was 400 square feet , much too small to serve the needs of the Cottone family. Excavating a section through the leaching bed at the upper right and the lower left corners revealed its composition as follows : a. 6 to 8 inches of sandy loam topsoil . b . A thin layer of straw spread over the entire bed. C. 2 inches of 3/4" to 12" crushed stone , the exact same material used below the leaching pipes for waste water displacement into the soil. Note : In this area, a minimum of 2 inches of pea stone should have been used to provide a safeguard cover over the leaching pipes . This is particularly true with such a shallow depth cover over the bed. d. Perforated 4" P .V. C. leaching pipe imbedded in 14 to 16 inches of 3/4 to lk inch crushed stone. Our field measurements revealed the 3/4 to 12 inch crushed j stone extended below the bottom of the leaching pipe 10 to 12 inches . e . The existing soils lie directly below the crushed stone leaching bed. We observed that flows to the leaching bed were conveyed via three-4 inch diameter perforated pipe laterals set 5 feet apart, extending out from the distribution box and that each lateral was connected to a header, (cross lateral) , at the toe of the bed, providing for a closed circuit system. We further observed that at approximately 8 to 10 inches below the existing grade selected as the bottom of the leaching bed, a strata of impervious organic clay exists over approximately one- third of the leaching bed area. This condition greatly reduces the size of and, of course, the effectiveness of a leaching bed that was too small to begin with. .Upon opening the system we found waste water ponded throughout the bed at a depth one inch below the perforated pipe invert. Inspect= ion of the crushed stone showed it was completely coated with a slip- pery cohesive waste substance. Likewise, the existing soils direct- ly below the crushed gravel were coated with the same slippery co- hesive substance, coupled with small deposits of solids , rendering it totally impervious . The ponded waste revealed small solids in Page Four suspension together with floating oils and waxes . This condition is indicative of a leaching system being awash most of the time during morning and evening peak flow periods , a condition that has sealed all of the original permeable soils of the system. A soils analysis and ground water test together with a percolation test was performed 10 feet from the failed system. The results were quite similar to those found by Mr. Murphy. The soils can generally be classed a sandy-gravelly loam, the ground water at 5 . 5 feet below the surface, and a good perk rate of one minute per inch fall . To establish the permeability of the existing system, we tunneled under the lower left corner of the bed where water ponded 10 inches deep within the system. Excavating to within 6 inches of the bottom of the leaching bed we found no percolation of the ponded water after a 40 minute wait . We then broke through the bottom of the leaching bed to allow the water to drop into our undercut cavity below. A percolation rate of two minutes per one inch fall was observed in the undercut cavity. Our analysis ended at this point. CONCLUSION It should be obvious that the system designed some two and a half years ago was far too small to accommodate the Cottone family. Consider average flows generated by a family of 7 is 700 gallons per day with a peak flow of 2 . 5 times that amount , or 1650 gallons per day, or 165 gallons an hour based on a ten hour active day. This equates to a percolation rate of 2 . 75 gallons a minute. This is far greater than the available percolation rate of one inch or 2 gallon per minute. Further, consider the leaching bed was rendered permeable for only about 2/3 of its capacity due to the impervious strata of clay found at a shallow depth below the bed, and you have a grossly over- taxed system. Fortunately, given the good soil characteristics over a portion of the system, it managed for a period of time to percolate before slowly sealing itself off due to its small size , creating its over- taxing of flows . As the system sealed more it became surcharged with peak waste flows causing even more solids and greases to be carried through. Currently the system is completely sealed save for its upper reaches around its perimeter. Page Five Our on-site analysis indicates that a properly designed and installed system can function at the site. I was originally contacted by Mr. Cottone on September 19 , 1980; after a preliminary site visit of September 25 , 1980, I agreed to undertake the project. We completed our surveys and on-si,te analysis on November 11, 1980. This report is an objective professional analysis and finding and is not intended to malign an individual or organization. This investi- gation was made at 2:30 P.M., March 6, 19'78. In addition, on June 29, 30 and July 1, 1977 this office conducted dye tests on your premises and. found your sewerage disposal system to be malfunctioning and in violation of Title 5 of the State Environmental Code, Section 2.19-,w-- "Discharge .19:-_="Discharge to Surface of Ground - No sanitary sewage or industrial waste shall be allowed to discharge or spill onto the surface of the ground or to flow into any gutter, street, roadway, or public place; nor shall such material discharge onto any private property." This violation of septic leachate flowing over the ground will not only endanger or materially impair the health, safety and well- being of yourselves., but also your children. your pets and your neighbors and their children and pets. You are hereby ordered to take the necessary steps to alleviate the malfunctioning situation on or before May 30, 1978. The procedure recommended by this board would involve uncovering your septic tank .access, your distribution box, and requesting this board for an inspection to investigate the source of your problems. Once the problem is determined, your options for correction will be explained by this board or its agent. - You are entitled to a hearing, filing, in the Board of Health Office, a request for such hearing within seven days of receipt of this letter, if you feel there is just cause why this order should be modified or v-ithdraT-m. If you do not, request a hearing, or if you fail to appear at a requested hearing, and if you have not corrected this situation by May 30, 1978, in compliance with the rules and regulations of the Board of Health, you shall cease and desist any action which would contrbute to the continuation of this violation. I hereby make application for a permit for a sewage disposal installation at 'alem St. I will install this system in ac- cordance with all the laws of the Commonwealth of Mkssachusetts and regulations of the Board of Health of the Town of North Andover. Further, I will construct the house sewer of bell and spigot pipe, the minimum diameter being 4 inches, and will maintain a minimum grade of 1% until 10 feet pre- ceding the septic tank, where' the grade shall not exceed 2%. I will install a con- crete septic tank of 750 gal* in size. A manhole (s) permitting easy cleaning will be provided with removable cover (s) of iron or concrete within 12 inches of the ground surface. I will provide subsurface disposal field with 4 inch perforated or open jointed pipe and laid in a series of trenches, the bottom of which will pro- vide a minimum of 180 lineal (GAJ feet of effective absorption area. The pipes will be laid on a 6 inch layer of washed gravel or crushed stone ranging in size from 3/4 to 1-1/2 inches (dia.) and the pipes will be surrounded by similar material to a height of 2 inches above the crown of the pipe. The joints of these pipes will be protected from clogging and before filling the trench, 2 inches of gravel or stone 1/8" to 1/4" (dia. ) will be placed over the course gravel or stone. The disposal field will be installed at a grade of 4 to 6 inches/100 feet. No single tile line will exceed 100 feet in length and in any case, two lines of tile will be installed. A minimum of 6 feet will be maintained between the center lines of the disposal field trenches and the average depth of trench shall not exceed 36 inches. No part of the installation will be less than 100 feet from any private water supply, 25 feet from any stream, 20 feet from any dwelling or 10 feet from any property line. I further agree not to cover any portion of this installation until approved by the inspection officer, as provided below, and to incorporate any additional requirements that may be attached to the permit. Vincent S. Cottone, 1062 Salem Street, North Andover, Dass. There are two manners in which a violation of this sort may be abated. The first is a determination that a nuisance exists and a Bill in Equity filed in the Superior Court to enjoin the continuance of the nuisance. This would appear to be a long term situation and perhaps not get you, the immediate relief that you are looking for. Title V of the new Environment Code makes the alleged defense as presented by your letter, a violation of Section 2.19. Enforcement of the regulations of Title V are obtained under Title I. Title I provides under Regulation 7, the method in which you can advise the land owner of his violation or a service of the notice of violation. Regulation 8 provides that the offending party may request a hearing before the Board of Health. 8.3 pro— vides what the Board should do after conducting a hearing. If the offending party fails to appear at the hearing, or does not request a hearing, 8.5 provides that seven (7) days after the service of the order to cease and desist on the offending party, each day' s failure to comply with the order issued, shall constitute an additional offense. Section 10.2 provides for the enforcement of your order by way of fine and it can be either $10.00, but not more than $500.00. Each day's failure to comply constitutes a separate violation. It would be my opinion that if this procedure were followed, the least that could happen is that you would have the offending party before a Court of Competent Jurisdiction. If a fine were issued, or an order given by the Court to correct it, I think you would accomplish your purpose.
