Petitioner is requesting a Special permit from 4.122.22 of the Zoning bylaw to build a Family Suite of 590 square feet (kitchen, bedroom, bathroom and living room) on the back of house in an R-4 Zoning District. Legal notices were sent to all names on the abutter's list and hearing was published in the Eagle -Tribune, a newspaper of general circulation in the Town of North Andover, on January 26, 2010 & February 2, 2010. The following voting members were present: Ellen P. McIntyre, Richard J. Byers, Joseph LaGrasse and Richard M. Vaillancourt. The following associate members were present: Thomas Ippolito and Michael Liporto. Albert P. Manzi III was not present at time of voting. Upon a motion by Richard Byers and 2"d by Joseph LaGrasse, the Board voted to GRANT the Special Permit to allow a Special permit from 4.122.22 of the Zoning bylaw to build a Family Suite of 590 square feet (kitchen, bedroom, bathroom and living room) on the back of house in an R-4 Zoning District. The Board finds that this use, as developed by the building & site plans, will not adversely affect the neighborhood. There will be no nuisance or serious hazard to vehicles or pedestrians since there is provision, for the required off-street parking. Adequate and appropriate facilities are provided to the existing residential dwelling and will be provided for the proper operation of a Family Suite. The Board finds that the Family Suite will not be substantially more detrimental than the existing single-family dwelling to the neighborhood and that this use, a Family Suite addition to a single family dwelling, is in harmony with the general purpose and intent of this Bylaw Site: Section 4.122.22of the Zoning Bylaw in order to build a Family Suite Plan(s) Title: 1) `Birdseye Rendered View" dated July 14, 2003, containing seven (7) sheets and eight (8) sheets dated November 20 2009. 2) Drawing of Site Layout Plan dated January 8 2010 Voting in favor: Ellen P. Failure to submit the required information within the time periods prescribed may result in a dismissal by the Zoning Board of an application as incomplete. The petitioner is notified that the legal notice has been prepared and the cost of the Party in Interest fee. STEP 7: DELIVERY OF LEGAL NOTICE TO NEWSPAPER The petitioner picks up the legal notice from the Office of the Zoning Board of Appeals and delivers the legal notice to the local newspaper for publication. STEP 8: PUBLIC HEARING BEFORE THE ZONING BOARD OF APPEALS: The petitioner should appear in his/her behalf, or be represented by an agent or attorney. The following voting members were present: Ellen P. McIntyre, Richard J. Byers, Joseph LaGrasse and Richard M. Vaillancourt. The following associate members were present: Thomas Ippolito and Michael Liporto. Albert P. Manzi III was not present at time of voting. Upon a motion by Richard Byers and 2nd by Joseph LaGrasse, the Board voted to GRANT the Special Permit to allow a Special permit from 4.122.22 of the Zoning bylaw to build a Family Suite of 590 square feet (kitchen, bedroom, bathroom and living room) on the back of house in an R-4 Zoning District. The Board finds that this use, as developed by the building & site plans, will not adversely affect the neighborhood. There will be no nuisance or serious hazard to vehicles or pedestrians since there is provision, for the required off-street parking. Adequate and appropriate facilities are provided to the existing residential dwelling and will be provided for the proper operation of a Family Suite.
