As residents of 1063 Salem Street, we are in a position to comment on the effect of this business on our neighborhood. Because Margot's Gallery is open only by appointment or during previously announced open houses, there is very little noticeable increase in traffic during its' hours of operation. 1070 Salem Street has adequate off-street parking to handle most of the customers during these times. On those infrequent occasions when cars are parked on the street, there are not very many and not for a very long period of time. The affect is not unlike having a neighbor who enjoys entertaining. Margot's Gallery does not add any commercial feel to the neighborhood. The only indication that it is there is a very discreet sign that is not very different from signs found on many residences.. Because Margot has operated her business very responsibly and with a great deal of sensitivity to the needs and concerns of her neighbors, we have no hesitation whatever in recommending that she be permitted to continue to operate Margot's Gallery in our neighborhood. The Town of North Andover Zoning By Laws Section 4.121, clearly states that in an R-1 Residential District, for use of a dwelling in any residential district or multi-family district for a home occupation,the following conditions shall apply: "a. Not more than a total of three(3)people may be employed in the home occupation, one of whom shall be the owner of the home occupation and residing in said dwelling; b. The use is carried on strictly within the principal building. c. There shall be no exterior alterations, accessory buildings, or display which are not customary with residential buildings. d. Not more than twenty-five (25)percent of the existing gross floor area of the dwelling unit so used, not to exceed one thousand(1000) square feet, is devoted to such use. In connection with such use,there is to be kept no stock in trade, commodities or products which occupy space beyond these limits. e. There will be no display of goods or wares visible from the street; f. The building or premises occupied shall not be rendered objectionable or detrimental to the residential character of the neighborhood due to the exterior appearance, emission of odor, gas, smoke, dust,noise, disturbance, or in any other way become objectionable or detrimental to the residential use within the neighborhood; g. Any such building shall include no features of design not customary in buildings for residential use." c. Margot's Gallery clearly falls with the aforementioned definition of"home occupation" and therefore is a permissible use under North Andover Zoning By Laws, as outlined below: ' a. Margot Lindau does not employ any persons to assist her with Margot's Gallery at 1070 Salem Street,North Andover. She herself does some work to maintain the business. ,Her primary residence is the site of the home business. (See Exhibit B, affidavit of Margot Lindau.) b. The use is carried on strictly within the principal building, which is located at 1070 Salem Street,North Andover. (See Exhibit B, affidavit of Margot Lindau.) c. There are no exterior alterations, accessory buildings, or displays which are not customary with residential buildings. (See Exhibit B, affidavit of Margot Lindau, See also Exhibit C,photograph of exterior of 1070 Salem Street,North Andover.) d. Less than 25%of the existing floor area of the dwelling unit is devoted to use for the home business. Specifically, only the living room is devoted to Margot's Gallery,which is less than 25%of the gross floor of the dwelling unit and less than 1000 square feet. No stock in trade, commodities, or products occupy space beyond these limits. Persons come to Margot's Gallery by invitation only and therefore the home occupation is not a retail business. The home occupation has no impact on the residential character of the neighborhood. j. Moreover, Margot's Gallery clearly falls within the North Andover Zoning By Laws definition of"home occupation"and therefore is a permissible use. The Town of North Andover Zoning By Laws Section 4.121, clearly states that in an R-1 Residential District, for use of a dwelling in any residential district or multi-family district for a home occupation, the following conditions shall apply: "a. Not more than a total of three (3)people may be employed in the home occupation, one of whom shall be the owner of the home occupation and residing in said dwelling; i b. The use is carried on strictly within the principal building. c. There shall be no exterior alterations, accessory buildings, or display which are not customary with residential buildings. d. Not more than twenty-five (25)percent of the existing gross floor area of the dwelling unit so used, not to exceed one thousand (1000) square feet, is devoted to such use. In connection with such use, there is to be kept no stock in trade, commodities or products which occupy space beyond these limits. e. There will be no display of goods or wares visible from the street; f. The building or premises occupied shall not be rendered objectionable or detrimental to the residential character of the neighborhood due to the exterior appearance, emission of odor, gas, smoke, dust, noise, disturbance, or in any other way become objectionable or detrimental to the residential use within the neighborhood; g. Any such building shall include no features of design not customary in buildings for residential use." c. Margot's Gallery clearly falls with the aforementioned definition of"home occupation" and therefore is a permissible use under North Andover Zoning By Laws, as outlined below: a. Margot Lindau does not employ any persons to assist her with Margot's Gallery at 1070 Salem Street,North Andover. She herself does some work to maintain the business. I do not keep any stock in trade,commodities or products that occupies the space beyond the aforementioned limits. 10, No display of goods or wares is visible from the street. 11.
