A variance on this lot was previously granted for construction
of a single family home on February 14, 1994. Since the grant of
the variance, a question has been raised on the title to the
portion of the lot under the Power easement. The Petitioner seeks
a reissuance of the variance unconditioned by the title conflict.
Local area is essentially fully constructed in one acre or less
lots. The Parcel is divided by the zoning boundary between R1 and
R2 zones due to the shape and size of the existing lot, a financial
hardship exists which could be alleviated by allowing construction
of a single family home. The relief, if granted, would be in
keeping with the intent and purpose of the bylaw and would not
create any serious hazards to pedestrians or vehicular traffic.

The Board of Appeals held a regular meeting on Tuesday evening, February 13,
1996 upon the petition of Arjuna Construction Co., Inc. requesting a Variance
pursuant to Section 7, paragraph 7.1,7.3and Table of the Zoning Bylaw. A
variance for this lot was previously granted on February 14, 1994. Since the grant
of the variance, a questiori has been raised on the title to the portion of the lot
under the New England Power easement.
The following members were present and voting: Walter Soule, Joseph Faris,
John Pallone, Scott Karpinski and Ellen McIntyre.
The hearing was advertised in the North Andover Citizen on 1.24.96 and 1.31.96
and all abutters were notified by regular mail.
Upon a motion by John Pallone, and seconded by Joseph Faris the Board voted
unanimously to Grant 53,000 square feet of the lot dimensional area requirement
of 87,120 square feet, and 25 feet relief from the rear setback requirement of 30
feet.

The Board finds that the petitioner has satisfied the provisions of Section 10,
Paragraph 10.4 of the Zoning Bylaw and that the granting of this variance will not
adversely affect the neighborhood or derogate from the intent and purpose of the
Zoning Bylaw.

Dear Mr. Ncetta:
It has come to our attention that WE Development Corp., or its successor Juna
Construction Co., Inc., intends to obtain a permit to build a single family home on property
located on Salem Street which we believe to have an address of 1075 Salem Street, North
Andover, MA. This property has been represented as Lot B containing 1.244 acres of land on a
plan of land entitled "Plan of Land in No. Andover, MA. owned by WE Development Corp."
which plan was prepared by Scott L. Giles and dated 1-24-94, a copy of which is enclosed. The
plan also shows an easement held by New England Power Company over a considerable portion
of Lot B.
At the present time, there exists a dispute over the fee ownership of the portion of Lot B
shown as an NEP easement. WE Development Corp. claims fee ownership over the entire
portion of Lot B including the portion represented as an easement, and New England Power
Company(NEP) is claiming fee ownership over the portion of Lot B which the plan represents as
only being a New England Power Company easement. NEP presently has lines for the
transmission of electricity running through the parcel in dispute.
NEP's title originates from a deed conveying the parcel in dispute from Thomas J.
Wardwell to Essex Railroad Company, predecessor to the Boston&Maine Railroad Company
(B&M). For your review, I have enclosed a copy of this original deed. B&M subsequently
conveyed certain of its property, including this parcel, to NEP's predecessor, Eastern
APR 1 .9

Massachusetts Electric Company, by an Indenture dated September 30, 1926 which was recorded
with the Essex North Registry of Deeds in Book 527, Page 113.
WE Development Corp.'s title originates from a deed out of Thomas J. Wardwell's estate
to George Wardwell, which conveyed Thomas Wardwell's land on Salem Street, but reserved the
rights of Essex Railroad Company. Since Essex Railroad Company had been conveyed a fee in
the disputed parcel prior to this deed out of Thomas Wardwell's estate, conveyance law dictates
that George Wardwell and all of his successors and assigns(including WE Development Corp.)
could not obtain a fee interest by this subsequent deed out of Thomas Wardwell's estate.
NEP first became involved in this dispute when WE Development's attorney contacted us
in the spring of 1994 about what he perceived as a cloud on the title. WE Development had
purchased the property shown as Lot 48 on Assessors Plat 106A in January, 1994 and intended to
raze the existing house,and subdivide the property into Lot A and Lot B. As a result of their
attorney's inquiry regarding NEP's title to the disputed parcel, I conducted a careful review of our
records and those of the Registry of Deeds. I concluded that all of these records indicate the fee
title in the disputed parcel to be held by NEP. WE Development's attorney is not satisfied with
this conclusion. Thus, this dispute has yet to be resolved.
It is inappropriate for WE Development, or their successor, to be applying for a building
permit when the fee ownership to a portion of Lot B, even according to their own attorney's
opinion, is unsettled. Therefore, I would request that you use discretion in considering whether to
grant any necessary permits for the development of this lot. In addition, as the owners of a
portion of what has been represented as Lot B, I request that NEP receive notification of any
applications or permits pertaining to this lot. I will keep you informed of any further
developments on this matter.

Dear Mr. Nicetta:
It has come to our attention that WE Development Corp., or its successor Juna
Construction Co., Inc., intends to obtain a permit to build a,single family home on property
located on Salem Street which we believe to have an address of 1075 Salem Street, North
Andover, MA. This property has been represented as Lot B containing 1.244 acres of land on a
plan of land entitled "Plan of Land in No. Andover, MA. owned by WE Development Corp."
which plan was prepared by Scott L. Giles and dated 1-24-94, a copy of which is enclosed. The
plan also shows an easement held by New England Power Company over a considerable portion
of Lot B.
At the present time, there exists a dispute over the fee ownership of the portion of Lot B
shown as an NEP easement. WE Development Corp. claims fee ownership over the entire
portion of Lot B including the portion represented as an easement, and New England Power
Company (NEP)is claiming fee ownership over the portion of Lot B which the plan represents as
only being a New England Power Company easement. NEP presently has lines for the
transmission of electricity running through the parcel in dispute.
NEP's title originates from a deed conveying the parcel in dispute from Thomas J.
Wardwell to Essex Railroad Company, predecessor to the Boston&Maine Railroad Company
(B&M). For your review, I have enclosed a copy of this original deed. B&M subsequently
conveyed certain of its property, including this parcel, to NEP's predecessor,Eastern

Massachusetts Electric Company, by an Indenture dated September 30, 1926 which was recorded
with the Essex North Registry of Deeds in Book 527, Page 113.
WE Development Corp.'s title originates from a deed out of Thomas J. Wardwell's estate
to George Wardwell, which conveyed Thomas Wardwell's land on Salem Street, but reserved the
rights of Essex Railroad Company. Since Essex Railroad Company had been conveyed a fee in
the disputed parcel prior to this deed out of Thomas Wardwell's estate, conveyance law dictates
that George Wardwell and all of his successors and assigns (including WE Development Corp.)
could not obtain a fee interest by this subsequent deed out of Thomas Wardwell's estate.
NEP first became involved in this dispute when WE Development's attorney contacted us
in the spring of 1994 about what he perceived as a cloud on the title. WE Development had
purchased the property shown asLot 48 on Assessors Plat 106A in January, 1994 and intended to
raze the existing house and subdivide the property into Lot A and Lot B. As a result of their
attorney's inquiry regarding NEP's title to the disputed parcel, I conducted a careful review of our
records and those of the Registry of Deeds. I concluded that all of these records indicate the fee
title in the disputed parcel to be held by NEP. WE Development's attorney is not satisfied with
this conclusion. Thus, this dispute has yet to be resolved.
It is inappropriate for WE Development, or their successor, to be applying for a building
permit when the fee ownership to a portion of Lot B, even according to their own attorney's
opinion, is unsettled. Therefore, I would request that you use discretion in considering whether to
grant any necessary permits for the development of this lot. In addition, as the owners of a
portion of what has been represented as Lot B, I request that NEP receive notification of any
applications or permits pertaining to this lot. I will keep you informed of any further
developments on this matter.

The Board of Appeals held a r.-Tular meeting on Tuesday evening, February 13.
1996 upon the petition of Arjuna Construction Co., Inc. reauesting a Variance
pursuant to Section 7, paragraph 7.1,7.3-and Table of the Zoning Bylaw. A
variance for this lot was previously granted on February 14, 1994. Since the grant
of the variance, a question has been raised on the title to the portion of the lot
under the New England Power easement.
The following members were present and voting: Walter Soule, Joseph Faris,
John Pallone, Scott Karpinski and Ellen McIntyre.
The hearing was advertised in the North Andover Citizen on 1.24.96and 1.31.96
and all abutters were notified by regular mail.
Upon a motion by John Pallone, and seconded by Joseph Faris the Board voted.
unanimously to Grant 53,000 square feet of the lot dimensional area requirement
of 87,120 square feet. and 2-5 fee: relief from the rear setback requirement of 30
feet.
The Board finds that the petitioner has satisfied the provisions of Section 10,
Paragraph 10.4 of the Zoning Bylaw and that the granting of this variance will not
adversely affect the neighborhood or derogate from the intent and purpose of the

Arjuna Construction Co. , Inc. Application for relief from the
requirements of the Zoning Ordinance relative to Salem Street
property.
A variance on this lot was previously granted for construction
of a single family home on February 14, 1994. Since the grant of
the variance, a question has been raised on the title to the
portion of the lot under the Power easement. The Petitioner seeks
a reissuance of the variance unconditioned by the title conflict.
Local area is essentially fully constructed in one acre or less
lots. The Parcel is divided by the zoning boundary between Rl and
R2 zones due to the shape and size of the existing lot, a financial
hardship exists which could be alleviated by allowing construction
of a single family home. The relief, if granted, would be in
keeping with the intent and purpose of the bylaw and would not
create any serious hazards to pedestrians or vehicular traffic.

Dear Mr. Nicetta:
It has come to our attention that WE Development Corp., or its successor Tuna
Construction Co., Inc., intends to obtain a permit to build a single family home on property.
located on Salem Street which we believe to have an address of 1075 Salem Street, North
Andover, MA. This property has been represented as Lot B containing 1.244 acres of land on a
plan of land entitled "Plan of Land in No. Andover, MA owned by WE Development Corp."
which plan was prepared by Scott L. Giles and dated 1-24-94, a copy of which is enclosed. The
plan also shows an easement held by New England Power Company over a considerable portion
of Lot B.
At the present time, there exists a.dispute over the fee ownership of the portion of Lot B
shown as an NEP easement. WE Development Corp. claims fee ownership over the entire
portion of Lot B including the portion represented as an easement, and New England Power
Company(NEP) is claiming fee ownership over the portion of Lot B which the plan represents as
only being a New England Power Company easement. NEP presently has lines for the
transmission of electricity running through the parcel in dispute.
NEP's title originates from a deed conveying the parcel in dispute from Thomas J.
Wardwell to Essex Railroad Company, predecessor to the Boston&Maine Railroad Company
(B&M). For your review, I have enclosed a copy of this original deed. B&M subsequently
conveyed certain of its property, including this parcel, to NEP's predecessor, Eastern

Massachusetts Electric Company, by an Indenture dated September 30, 1926 which was recorded
with the Essex North Registry of Deeds in Book 527, Page 113.
WE Development Corp.'s title originates from a deed out of Thomas J. Wardwell's estate
to George Wardwell, which conveyed Thomas Wardwell's land on Salem Street, but reserved the
rights of Essex Railroad Company. Since Essex Railroad Company had been conveyed a fee in
the disputed parcel prior to this deed out of Thomas Wardwell's estate, conveyance law dictates
that George Wardwell and all of his successors and assigns (including WE Development Corp.)
could not obtain a fee interest by this subsequent deed out of Thomas Wardwell's estate.
NEP first became involved in this dispute when WE Development's attorney contacted us
in the spring of 1994 about what he perceived as a cloud on the title. WE Development had
purchased the property shown as Lot 48 on Assessors Plat 106A in January, 1994 and intended to
raze the existing house and subdivide the property into Lot A and Lot B. As a result of their
attorney's inquiry regarding NEP's title to the disputed parcel, I conducted a careful review of our
records and those of the Registry of Deeds. I concluded that all of these records indicate the fee
title in the disputed parcel to be held by NEP. WE Development's attorney is not satisfied with
this conclusion. Thus, this dispute has yet to be resolved.
It is inappropriate for WE Development, or their successor, to be applying for a building
permit when the fee ownership to a portion of Lot B, even according to their own attorney's
opinion, is unsettled. Therefore, I would request that you use discretion in considering whether to
grant any necessary permits for the development of this lot. In addition, as the owners of a
portion of what has been represented as Lot B, I request that NEP receive notification of any
applications or permits pertaining to this lot. I will keep you informed of any further
developments on this matter.
