RE: VIOLATION of the Massachusetts Wetland Protection Act(310 CMR 10.00)and the North
Andover Wetland ByLaw(C. 178 of the Code of North Andover)-#108 Rosemont Drive.
Dear Mr. and Mrs.Augustyn:
This Department has been made aware of a violation of the Massachusetts Wetland Protection Act and
North Andover Wetland ByLaw at the above referenced property.Any activity proposed or undertaken
within a wetland resource area specified in the Act(310 CMR 10.02)(1)(a)which will remove,fill,dredge
or atter that area is subject to regulation under M.G.L.c.131 SAO and requires the filing of a Notice of Intent
with the North Andover Conservation Commission (NACC)and Massachusetts Department of
Environmental Protection (DEP). A,
Furthermore,any activity proposed or undertaken within 100'of a wetland resource area specified in 310
CMR 10.02(1)(a) (hereinafter called the Buffer Zone)which in the judgment of the issuing authority,will
alter an Area Subject to Protection under M.G.L. c.131 SAO is subject to regulation and also requires the
filing of a Request for Determination of Applicability and/or Notice of Intent.
When unauthorized fill is placed within a natural flow path (i.e.wetland/streambed/culvert),the water tends
to back up on adjacent properties; more importantly,wetland resource areas protected under the Act may
be negatively impacted from siltation, turbidity and loss of storage capacity. Vegetated wetlands such as
those on your property are protected because they provide the following functions:
• protection of public and private water supplies;
• protection of groundwater supplies;
• flood control;
• storm damage prevention;
prevention of pollution;
• protection of fisheries and wildlife habitat.
When wetlands are degraded without proper mitigation direct threats to public health may occur. Please
contact this Department so that we can schedule an inspection of the property and mitigate any existing
violations.

RE: Filling of Delineated Wetlands
Dear Mr. Augustyn:
It has recently come to my attention that you have filled some of the wetlands located in the front
yard of your home. As I am sure you are aware, filling of any delineated wetlands is subject to
the approval of the local Conservation Commission.
This letter serves as a formal request that you remove the fill that you have placed in the wetlands
and restore same to its formerly undisturbed condition. If you do not intend to carry through with
the restoration of the wetlands, you may be subject to extensive fines and/or sanctions from the
local commission. Additionally, we are attempting to finalize other aspects of the North Andover
Estates project which involve the Conservation Commission and would not want your actions to
adversely affect our relationship with the Commission.
