Dear Mr. Deprizio: On November 12,2003 this department observed recent work activities at the front of your property within 100 feet of a protected wetland resource area directly across the street. Recent activities may have also included filling and grading, as a small bobcat was being stored on the property. The property appears to have been freshly loamed. The wetland resource area is approximately 60 to 80 feet from the activities and a catch basin is located at the end of the driveway,which discharges runoff from the site directly to the resource area. Since the site is unstable, impacts to the resource area are a major concern. At the time of my inspection it had been raining and it was evident that mitigation measures,to prevent further impacts, should be addressed immediately. Please be aware that any land altering activities proposed or conducted within 100 feet of a wetland resource area is subject to a permit filing with the North Andover Conservation Commission pursuant to the Massachusetts Wetland Protection Act(MGL c.131 s. 40) and the North Andover Wetlands Protection Bylaw (Section 1.3). Specific wetland resource areas affected by the activities include the following: • 100-Foot Buffer Zone(NACC Bylaw Section 1.3); ORDER: Acting as an Agent of the Commission under MGL C.40,S.21D and the Act(310 CMR 10.08(3)), enclosed please find an Enforcement Order mandating mitigation and site stabilization methods. Mitigation measures shall be conducted in accordance with the conditions described below and implemented immediately. Additional mitigation/site stabilization methods may be necessary as deemed by the Conservation Department at any time. 1. Haybales shall be placed around the catch basin surrounded by no less than a 10" width of pea stone rip-rap. 3. Hay mulching shall be spread over the entire disturbed area to deter erosion. 4. A minimum of 15 additional haybales shall be kept on site for emergency erosion control purposes. 5. Upon completion of the above, the Conservation Department shall be contacted for a site inspection to ensure that proper implementation had been secured. 6. As soon as weather permits the site shall be properly seeded and stabilized. The violations as documented herein are subject to a$300 per day penalty until such time as the impacted resource areas have been mitigated. Each day or portion thereof during which this violation continues shall constitute a separate offense. At this time the Conservation Department has elected to levy a fine in the amount of$100. .We reserve the right to take additional action in the future should this Enforcement Order not be complied with retroactive from the date we were first made aware of the violations. Failure to comply with this Order and the deadlines referenced herein will result in the issuance of additional penalties. MGL C.131 5.40 and the North Andover Wetland Bylaw, C.178 authorizes the Conservation Commission to seek injunctive relief and civil penalties per day of violation. In addition, a violation of the Massachusetts Wetland Protection Act and the North Andover Wetland Bylaw constitutes a criminal act, which is subject to prosecution and the imposition of criminal fines, also per day.
