Hoyt ** Petition: #108-89 109 Sullivan St. * N. Andover, MA 01845 * DECISION * The Board of Appeals held a public hearing on Tuesday evening, May 1, 1990 upon the application of Walter P. Hoyt requesting a variance from the requirements of Section 7, Paragraph 7.3 and Table 2 of the Zoning Bylaw so as to permit a garage built in 1983, to stay 13.5' from the side lot line, not 30' as required, on the premises located at 109 Sullivan Street. { The following members were present and voting: Frank Serio, Jr. , Chairman, Augustine Nickerson, Clerk, Walter Soule, Raymond Vivenzio and Louis Rissin. The hearing was advertised in the North Andover Citizen on April 12, 1990 and April 19, 1990 and all abutters were notified by regular mail. Upon a motion made by Mr. Vivenzio and seconded by Mr. Nickerson, the Board voted, unanimously, to GRANT the variance as requested. The Board finds that this is a justifiable request because the petitioner tried to meet all the requirements of the bylaws and obtained a valid Building Permit from the Town at the time the garage was built in 1983. The Board finds that the petitioner has satisfied the provisions of Section 10 Paragraph 10.4 of the Zoning Bylaw and that leaving the garage in its present location will not derogate from the intent and purpose of the Zoning Bylaw nor will it adversely affect the neighborhood.
