The North Andover Board of Appeals held a public hearing at its regular meeting in the Town Hall top floor
meeting room, 120 Main Street,North Andover,MA on Tuesday,April 12,2005 at 7:30 PM upon the
application of Andrew&Maureen Heinze,11 Appleton Street,North Andover requesting a Special Permit
from Section 4 and Paragraph 4.121.17 of the Zoning Bylaw for a Family Suite. Said premises affected is
property with frontage on the South side of Appleton Street within the R-3 zoning district The legal notices
were published in the Eagle Tribune on February 21 &28,2005,and all abutters were notified. The legal
notice was read at the March 8,2005,and the hearing was continued to April 12,2005.
The following members were present: Ellen P.McIntyre,Richard I Byers,Albert P.Manzi,III,and Thomas
D. Ippolito.
Upon a motion by Albert P.Manzi,III and 2°d by Thomas D.Ippolito,the Board voted to GRANT a Special
Permit from Section 4,Paragraph 4.121.17 of the Zoning Bylaw in order to allow a Family Suite to be
constructed at 11 Appleton Street,per Plan of Land in No.Andover,MA,owned by Andrew and Maureen
Heine,Date: 1/20/2004, 1/23/2004,2/16/2005[by]Frank S.Giles,II,P.L.S.#41713,Frank S. Giles
Surveying,50 Deermeadow Road,No.Andover,MA 01845,and Plans for Heinze Residence,Appleton Street,

With the following conditions:
1. The Family Suite shall not be occupied by anyone except Martha Heine,a parent of the residing
owners of the dwelling unit;
2. The Special Permit shall expire at the time that Martha Heine
ceases to occupy the family suite;
3. The Special Permit shall expire at the time the premises are conveyed to any person,
partnership,trust,corporation or other entity;

The Board finds that the applicant has satisfied the provisions of Section 9,Paragraph 9.2 of the zoning bylaw

RE.Request for Road Frontage Variance;Maura.Blundin
A. The Particular use proposed for the land or structure:
We would like to build a one-family house on the four-acre property(lot#7)at the end
of Appleton Street. The home would not exceed the 35-foot height requirement nor
would it be built within 30 feet of property lines. Currently there is no roadway access to
the property. We would like to gain access by building a driveway on the undeveloped
sectionAppleton Street

B. The circumstances relating to soil conditions, shape or topography of such land
or structure especially affecting the property for which the variance is sought which
do not affect generally the zoning district in which the property is located:
We are requesting a variance on the 175' road frontage requirement. Any road or
driveway built on the undeveloped section of Appleton Street would only provide access
to our potential house and wooded property that is not for sale. Considering this, it seems
unnecessary to build a road capable of handling large amounts of traffic. An 18' wide
driveway with a `hammerhead' turn around area should provide sufficient access for
emergency vehicles, if needed, while at the same time maintaining more woodland. The
variance on frontage requirements would not affect the zoning requirements for the
home.
C. Facts that make up the substantial hardship, financial or otherwise,which results
from literal enforcement of the applicable zoning restrictions with respect to the
land or building for which the variance is sought:
In order to comply with the 175' road frontage requirement, a town-quality road would
need to be constructed. This road's length would not only be the 175' required by the
zoning restriction, but also an additional 265' to connect to the existing Appleton Street.
Construction of this 50' wide town-quality dead-end road would be quite expensive and
cause much more land to be cleared. We also consider it to be visually unattractive.
D. Facts relied upon to support a finding that relief sought will be desirable and
without substantial detriment to the public good:
Construction of an 18' driveway would provide a more inconspicuous entryway to the
property. This smaller roadway helps us to preserve the look and feel of the
neighborhood by not having to destroy many of the old trees that would need to be
uprooted to build a town road. Using an 18' wide driveway to access the property would
preserve approximately 16,240 square feet of land. It is understood that maintenance of
the driveway would be our responsibility(i.e. plowing)thus saving the town time and
money. It is also understood that town services, such as trash pick-up and school busing,
would be provided at the end of our driveway. Additionally, we will be keeping the four-

acre lot as a whole, rather than attempting to create two two-acre lots, which will help
prevent the area from becoming over developed.
E. Facts relied upon to support a finding that relief sought may be given without
nullifying or substantially derogating from the intent or purpose of the zoning
bylaw:

town from becoming over-developed and preserve the feel of the neighborhood.

qty special permit request is for a Family Suite as set forth in Section 2.37.1 of the North
Andover Zoning Bylaws. This suite-will be added to-a newly razed two car garage,
compliant with all requirements and architecturally integrated into the structure and
neighborhood. The-purpose o€the Family Suite is for the paternal owner's mother,
Martha Heinze.
TheFamily Suite is-shown-to-be orrthe first level for reason-&-o€inevitable aging by the
occupant. We feel it may be in Martha's best interest in case her physical well being
changes as she ages. The-principal-dwelling-currently resides two adults and three
children, ages 7,5 &2. Martha currently lives alone in Haverhill. We want to bring our
family closer together and-firmly believe it will be beneficial to both parties in the years
to come.
2. The-gwifw site is-an-appropriate location--for such-use, struetare of
condition.
The-specific site is an appropriate location-€4r its-use because the integrity of the home
and neighborhood would not be compromised. The completed structure will fit in with
other homes in.the neighborhood that have Family Suites-as-well as-being architecturally
beautiful. The lot is an oversized lot (1.92 acres) and has gentle grades and no
extraordinary-site alterations-would-be required. All dimensional requirements and
setbacks are complied with. The proposed changes to the property include to raze
existing garage, apartment and connecting structure and to replace that with new garage,
Family Suite and additional living space-for-the-principal-dwelling-as per enclosed plan.
3. There will be no nuisance or serious hazard to vehicles or pedestrians.
The-structure is-nicely set back from,the road, sets in the center-of the 1.92 acre lot and
the entrance to the property will not change nor will the number of usual occupants.
Adequate and appropriatefacilitieswill be provided for the proper operation
of the proposed use.
The property will have full services-including water, sewer and utilities. Vehicular
access is direct over paved driveway to a two car garage and additional parking for at
least b vehicles.
5: The use is-in harm-owy with-.the--purpose-of-the-zoning by-law.
The use is in harmony with the purpose and intent of the Zoning Bylaw because a Family
Suite is an allowable use. We believe the intent of the Bylaw is to encourage families to
stay close together, to help each other out and support each other in a safe family
neighborhood environment.

special permit for which the application is made.
As stated in the North Andover Zoning Bylaw Section 4.121 paragraph 17, we
understand the Family Suite cannot be occupied by anyone other than those stated and in
our case it is by the paternal mother of the principal owner. We also understand, under
this-use, the premises will tie inspected annually by the wilding Inspector for
conformance-to this-section-of the Bylaw and that the Special Permit shall be recorded at
the North Essex Registry of Deeds.
