The Board of Appeals held a public hearing on 'Tuesday evening,
MAY 149 1991 and June 111 1991 upon the application of Nancy and
Massimo Pellegrini requesting a Variance from the requirements of
Section 4, paragraph 4. 122 (7) of the Zoning By-Law so as to per-
mit construction of a swimming pool too close to the lot lines on
two sides on the premises located at 11 Camden Street.
The following members were present and votingo Frank Serio, Jr. ,
Chairman; William Sullivan, Vice--Chairman; Walter Soule, . and Anna
O'Connor.
The he=aring was advertised in the North Andover Citizen on
April 24 and May 19 1991 and all abutters were notified by
regular mail.
Upon a motion made by Mrs. O' Connor and seconded by Mr.
Sullivan, the Board voted, unanimously, to GRANT Variance as
requested.
The Beard find that owing to circumstances relating to the size
and shape of the petitioner' s lot, a literal enforcement of the
By-Law will involve hardship to the petitioner. By locating the
pool at any other location, the configuration of the improvements
would all be located on one (1) portion of the lot, depriving
petitioner of any rear yard directly behind the main structure.
The rear projection of land is a natural location for the pool,
and will create no detriment to the public good of any nature
whatsoever. The Board finds the request to be reasonable, and
the granted relief does not constitute a substantial derogation
from the intent or, purpose of the By-Laws of the town.
