The Board of Appeals held a public hearing on Tuesday evening,
October 13 , 1992 upon the application of Paul and Beverly Leclerc
requesting a variation of Section 7, Paragraph 7 .3 and Table 2 of
the Zoning Bylaw so as to permit relief of ten (10) feet for the
rear setback requirement on the premises located at Lot B- #14
Camden Street. The following members were present and voting:
Frank Serio, Jr. , Chairman, William Sullivan, Vice-chairman,
Walter Soule, Clerk, Raymond Vivenzio and Louis Rissin.
The hearing was advertised in the North Andover Citizen on
September 23 and 30, 1992 and all abutters were notified by
regular mail.
Upon a motion by Mr. Sullivan and seconded by Mr. Vivenzio the
Board voted unanimously to GRANT the variance as requested.
The Board finds the petitioner has satisfied the provisions of
Section 10, Paragraph 10.4 of the Zoning Bylaw and that the
granting of this variance will not adversely affect the
neighborhood or derogate from the intent and purpose of the
Zoning Bylaw.

Gentlemen:
This office represents Mr. and Mrs. Paul Leclerc who seek to renew
and modify slightly a variance which was granted to them in 1987.
On behalf of my clients I am enclosing the following:
1. Five copies of the application;
2. Filing fee check in the amount of $25.00; and
3. One print of the 1987 plan.
The mylar is not yet available and will have to be updated. As
shown on the 1987 plan, the existing Leclerc property will be
subdivided into two equally sized lots shown as Lot A and Lot B, each
having a depth of eighty feet and a frontage of seventy-five feet. The
footprint of the so-called proposed dwelling will be changed somewhat
on the new mylar, as the builder proposes a garrison 24' x 34' and not
30' x 35' as on the old plan. We shall do our utmost to have the
revised mylar and prints of the plan available to the Building
Department and to your office well in advance of the scheduled
meeting.

V.F.W. applied in writing for a booth
just like everyone else. The V.F.W. has
run food booths in the past, The only
reason they ran the beer booth was
because they also own and run Club
2104 and h4.ve the connections, man-
power and knowledge on how to run
such a booth.
For the last three years they have had
off-duty state and out of town police of-
ficers standing next to the ticket sellers
at the beer booth, and if a person had
no ID or had too much to drink, they
would not get served and in some cases
were escorted off the common.
If anyone was drunk and rowdy it
was on account of the beer and liquor
which thev hrnnaht with them frnm the

The Board of Appeals held a public hearing on May 12, 1987 on the application
of Paul 3 Beverly Leclerc requesting a variance of Section 7, Paragraph 7.1 and 9
a, Table 2 of the Zoning ByLaws so as to permit splitting of lot for future build-
Ing. The following members were present and voting: Frank Serio, Jr., Chairman
Alfred Frizelle, Vice-chairman, Augustine Nickerson, Clerk, Walter Soule, and
Anna O'Connor. ;
The hearing was advertised in the North Andover Citizen on April 16, and

April 23, 1987 and all abutters were notified by regular mail.
+ The petitioner stated that it is more and more of a chore to take cars of the
extra lot and they would like to split it and build a home on it, fronting on
Lexington Street.
Upon a motion made by Mr. Frizelle and seconded by Anna O'Connor, the Board
VOTED to GRANT the variance as requested, subject to the following conditions

Gentlemen and Anna:
Re: Zoning hearings this date:
1) Paul & Beverly LeClerc - from our examination of the plans it appears
that the LeClerc's also require an additional variance on the lot front-
age and the front setback of the proposed building;
2) Crusader Paper, Inc. - we have examined the plan for Crusader Paper
and find it an excellent plan; however, it does not show the required
15 ft. setback from the lot line of any excavation. Nothing is shown
regarding the burial of stumps or wood on the site. Slopes in excess
of the 2:1 requirement are shown on the plan. There is no estimate
given showing the number of cu. yds. of fill to be removed.
We recommend that there is a signature block affixed to the plan and
that it be signed by the Board, if approved, and made a part of the
decision;
3) Orlando J. Campisi (Mablin Ave. ) - the petition of Orlando Campisi is
properly before the Board having referenced the correct sections of the
By-Law;
4) Unity Realty Trust/Essex (Jilly's) - in examining the plans, we find
that there is no signature block for the Zoning Board of Appeals and that
the floor elevation is not the required 35.2 U.S.G.S. as shown on the
Planning Board's site plan approval. It appears that the applicant is
required to keep the grades around the building to that shown on the
approved site plan and ra% .the building one ft. (all as required by
the Planning Board) ,. thus creating a need for a height variance;

5) Jefferson Children's Center, Inc. , 790 Turnpike Street - we recommend
that there be a signature block on the plan and that the Board sign any
approved plans and make the plans part of the decision;
6) James & Ruth Carabello - James Carabello was refused :a,. Building
Permit because his proposed addition would be too close to the side
line;
7) William Canty - Mr. Canty was refused a Building Permit due to
the fact that his proposed addition is too close to the side line.

PLAN OF LAND TO ACCOMPANY PETITION
Each application and petition to the Board shall be accompanied by �
five ( 5) copies of the following described plan:
The size of the plan shall be 11 x 17, drawn to scale, 1 inch
equals 40 feet ; it shall have a north point , names of streets ,
zoning districts , names and addresses of owners of properties
within a minimum of 200 feet of the subject property, property
lines and location of buildings on surrounding properties . The
location of buildings or use of the property where a variance -is
requested and distances from adjacent buildings and property lines
shall be verified in the field and shown on the plan . The
dimensions of the lot and the percentage of the lot covered by the
principal and accessory buildings and the required parking spaces
shall be shown. Entrances , exits , driveways , etc. that are
pertinent to the granting of the variance shall be shown. All
proposed data shall be shown in red .
Any topographical feature of the parcel of land relied upon for a
variance, such as ledge, rock peat, or natural condition of water ,
brook, or river , shall be shown on the engineering plan . When a
variance is requested to subdivide a parcel of land, the dimen-
sions and area of the surrounding lots may be taken from the deed
or lotting plan for comparison of the size of the lots in the
neighborhood , noted on the plan as such, and marked "approximate" .
The plan, shall be signed and bear the seal of a registered
surveyor or engineer . Any plans presented with the petition shall_
remain a part of the records of the Board of Appeals . .
If living quarters are to be remodeled, or areas are to be
converted into .living quarters , in addition to the plot plan, five
( 5) copies of the following described plans shall be furnished:
1. A floor plan of each floor on which remodeling is to be done
or areas converted into living quarters;
2. A floor plan showing the stairways , halls , doors opening into
the halls , and exit doors of each floor or floors where no re-
modeling or converting is to be done;
3. The plans and elevations shall show all existing work. All
proposed work shall be shown -in red. The size of each plan,
shall be 11 x 17 or 17 x 22; it shall be drawn to scale, 1/4
inch equals one foot.
All plans and elevations presented with the petition shall remain
a part of the records of the Board of Appeals .
For petitions requesting variation(s ) from the provisions of
Section 7, Paragrpahs .7. .1, 7. 2, - 7. 3, and 7. 4 and Table 2 of the
Zoning By Law for conveyance purposes only, a plot plan, certified
by a registered engineer or land surveyor , of the parcel of land
with a structure thereon being conveyed, will be acceptable to the
Board of Appeals provided:
1 . The dwelling (s ) , structure(s ) , or building(s ) were constructed
prior to March 14, 1977 .
2. The petition is not to allow construction or alteration to
the dwelling (s ) , structure (s ) , or building (s ) which will re-
suit in the need for the issuance of a building permit .
3. The size of the. plan shall be no smaller than B 1/2 x 11
inches and must , show the •exi•sti.ng area of the parcel , the
existing frontage, and the existing setbacks of the
dwelling (s ) , structure(s ) , or buildings ) being conveyed.
4•. Proper space is provided on the• plot plan for the Board' s
signatures , as well as adequate space for the following
information: date of filing, date of public hearing , and
date of approval .
