NATURE OF THE CASE
1 . This is an appeal of a zoning decision of the Zoning Board
of the Town of North Andover, Massachusetts .
JURISDICTION
2 . This Court has jurisdiction of this action pursuant to
Massachusetts General Law Chapter 40A, Section 17 .
PARTIES
3 . The Plaintiffs , ALBERT WASHINGTON, JR. and JOYCE WASHINGTON,
are husband and wife ; they reside at 15 Camden Street,
North Andover , MA.
4 . The Defendants , MASSIMO PELLEGRINI and NANCY PELLEGRINI ,

6 . The Defendant, TOWN OF NORTH ANDOVER, is a municipal
corporation, organized under the Laws of the Commonwealth
of Massachusetts , with a usual place of business at 120
Main Street, North Andover, Essex County, Massachusetts .

7 . The Plaintiffs and the Defendants each own the premises
situated on Camden Street in which they reside . Said
fpremises contain a common boundary line which runs
approximately 160 feet from Camden Street to Princeton
Street in said North Andover .

8 . The Defendants , Massimo Pellegrini and Nancy Pellegrini ,
want to install an inground swimming pool 16 feet in width
and 32 feet in length. Said pool would be located at
the back of their property.
9 . The Defendants ' pool would have a four ( 4 ) foot setback

on the side lot line which abuts the Plaintiffs ' property
and a five ( 5 ) foot setback on the other side yard lot
line .
10 . The Defendants , MASSIMO PELLEGRINI and NANCY PELLEGRINI , I
filed a written Application with the Zoning Board of Appeals
seeking a Variance from the requirements of Section 4 . 122 ,
Paragraph 7 of the Zoning By-Laws . A copy of said Applica-
tion is attached hereto and marked as "Exhibit A" .
11 . Section 4 . 122 , Paragraph 7 of the Zoning By-Laws provides
in pertinent part that "swimming pools in excess of two ,
( 2 ) feet deep shall be considered a structure and permitted
provided they are` enclosed by a suitable wall or fence i
at least four ( 4 ) feet in height to be determined by the
Building Inspector to prevent the entrance of persons
other than those residing at the pool location. Pools
shall have a minimum ten ( 10 ) foot setback from side and

rear lot lines and be located no nearer the street than
the building line of the dwelling, except by Special
Permit" .
12 . A public hearing was held by the Zoning Board of Appeals
on May 14 , 1991 . Said hearing was continued until June
11 , 1991 .
13 . The Plaintiff , JOYCE WASHINGTON, ' attended both hearings
and spoke in opposition to the Defendants request for
a Variance at the meeting held on May 14 , 1991 .
14 . At the June 11 , 1991 meeting, Defendants SERIO, SULLIVAN,
SOULE, AND O' CONNOR were present and participated in the
meeting.

15 . On June 21 , 1991 , the Board of Appeals voted to grant
the variance requested by the Defendants and to authorize
the Building Inspector to issue a Permit to MASSIMO
PELLEGRINI and NANCY PELLEGRINI .
16 . On June 21 , 1991 , the Decision of the Board of Appeals
was recorded with the Office of the Town Clerk of North
Andover. A certified copy of said Decision is attached
hereto and marked as "Exhibit B" .
17 . The Plaintiffs are persons aggrieved, within the meaning
of Mass . General Law Chapter 40A, Section 17 , by the
Decision of the Board of Appeals to grant the Defendants
Application for a Variance .
18 . The Decision of the Board of Appeals granting the Defendants
Application for a Variance exceeded the authority of the
Board of Appeals .
WHEREFORE, the Plaintiffs respectfully pray that the Court:
1 . Hear all pertinent evidence and determine the facts ;
2 . Determine and adjudge that the Board of Appeals ' Decision
to grant the Defendants ' Application for a Variance was
error as a matter of law and fact and that the Board of
Appeals exceeded its authority ;
3 . Annul the Decision of the Board of Appeals ;

4 . Grant such further relief as justice and the rights of
the parties may require.

NORTH ANDOVER, MA * DECISION
The Board of Appeals held a public hearing on Tuesday evening,
MAY 14, 1991 and June 11 , 1991 upon the application of Nancy and
Massimo Pellegrini requesting a Variance from the requirements of
Section 4, Paragraph 4. 12E (7) of the Zoning By-Law so as to per-
mit construction of a swimming pool too close to the lot lines on
two sides s on the premise's located at 11 Camden Street .
The following members were present and voting : Frank Serio, Jr. ,
Chairman ; William Sullivan, Vice-Chairman; Walter Soule, and Anna
O ' Connor.
The hearing was advertised in the North Andover Citizen on
April 24 and May 11 1991 and all abutters were notified by
regular mail .
Upon a motion made by Mrs. O' Connor and seconded by Mr.
Sullivan, they Board voted, unanimously, to GRANT Variance as
requested.
The Board find that owing to circumstances relating to the size
and shape of the petitioner' s lot, a literal enforcement of the
Py-Law will involve hardship to the petitioner. By locating the
pool at any other location, the configuration of the improvements
would all be located on one ( 1 ) portion of the lot , depriving
petitioner of any rear yard directly behind the main structure.
The rear projection of land is a natural location for the pool ,
and will create no detriment to the public good of any nature
whatsoever. The Board finds the request to be reasonable, and
the granted relief does not constitute a substantial derogation
from the intent or purpose of the By-Laws of the town.
Dated this 21st day of June, 1991 .
