* DECISION
The Board of Appeals held a public hearing on August 8, 1989, June 13, 1989 and
May 9, 1989 upon the application of Elbridge Leland requesting as a Party Aggreived
review of the decision made by the Building Inspector regarding operating a con-
tracting/glazing business on the premises located at 11 Marbleridge Road. The
following members were present and voting: Frank Serio, Jr. , Chairman, Raymond
Vivenzio, Anna O'Connor and Louis Rissin.
The hearing was advertised in the North Andover Citizen on April 20, 1989 and
April 27, 1989 and all abutters were notified by regular mail.
Upon a motion made by Mr. Vivenzio and seconded by Ms. O'Connor, the Board voted,
unanimously, to accept the documents submitted by Mr. Leland as proof that a
business has been on that site prior to 1972, therefore qualifying it as a non-
conforming use under Section 9 of the Zoning Bylaws. The Board determined that
the use was in existence prior to the enactment of the -
P R 1 zoning restrictions.

The Board of Appeals held a regular meeting on Tuesday evening, October 10,
1995 and continued to November 14, 1995 upon the application of Elbridge O.
Leland requesting a Variance pursuant to Section 4.121 and Paragraph 18 of the
Zoning Bylaw.
The following members were present and voting: William Sullivan, Raymond
Vivenzio, Walter Soule and Joseph Faris.
The hearing was advertised in the North Andover Citizen on 9.20.95 and 9.27.95
and all abutters were notified by regular mail.
The applicant has submitted a written letter requesting to withdraw the petition
without prejudice.
Upon a motion by Raymond Vivenzio and seconded by Walter Soule, the Board
voted unanimously to allow the applicant to withdraw his request without
prejudice. Voting in favor: William Sullivan, Raymond Vivenzio, Walter Soule,
and Joseph Faris.
