TOWN OF NORTH,ANDOVER OCT 23 9 20 A" MASSACHUSETTS I BOARD OF APPEALS NOTICE OF DECISION 29 North Main St. NAME: Ray Finocchiaro DATE: 10/20/97 ADDRESS: 29 North Main St. PETITION: 035-97 North Andover, MA 01845 HEARING: 10/14/97 The Board of Appeals held a regular meeting on Tuesday evening, October 14, 1997 upon the application of Ray Finocchiaro, requesting a Special Permit under Section 4, paragraph 4.135 (8) in order to lease premises as a motor vehicle service station without storage or sale of motor fuel, of the Zoning Bylaws which is in I-S Zoning District. The following members were present Witham J. SuPffvart, Walter F. Soule, Robert Ford, John Pallom, Ehen McIntyre. The hearing was advertised in the Lawrence Tribune on 9/30/97 and 10/6/97, and all abutters were notified by regular mail. Upon a motion made by Ellen McIntyre and seconded by Walter Soule, the Board of Appeals unanimously voted to GRANT relief of requirement Section 4, paragraph 4.135, (8), of the Zoning Bylaws, with the condition that there be no parking on the street, and the condition that there will be no fuels of any kind stored at this location, and no storage of any replacement parts be stored on the property . Voting in favor: William J. Sullivan, Walter F. Soule, Robert Ford, John Pallone, Ellen McIntyre. The petitioner has satisfied the provision of Section 10, paragraph 10.4 of the Zoning Bylaw and that the granting of these variances will not adversely affect the neighborhood or derogate from the intent and purpose of the Zoning Bylaw. Note: The granting of the Variance and/or Special Permit as requested by the applicant ' does not necessarily ensure the granting of a Building permit as the applicant must abide by all applicable local, state and federal and building codes and regulations, prior to the issuance of a building permit as requested by the Building Commission. Over the last few years, my agency has referred numerous customers to Automobile Technology. Everyone of them who had work done by Mr. Fennell was more than pleased with his workmanship, prices and excellent service. My family and I, as well as many of my employees here at the agency, have trusted our cars to Mr Fennell for a number of years now. From an insurance standpoint, the insurance company has already inspected the premises Mr. Fennell intends to lease and has found them to be in excellent condition and free of any hazard that might give rise to a claim. Over the past few years I have come to view Mr. Fennell as a professional who operates an exceptionally well managed business. Please be advised that Guilford Transportation Industries, Inc. manages real estate matters for several corporations. This response is sent on behalf of the following corporations in reply to your notice which was received on October 7, 1997 ° Boston and Maine Corporation; ° Maine Central Railroad Company; ° Portland Terminal Company; ° Springfield Terminal Railway Company; ° Hudson River Estates, Inc.; ° Delaware River Estates, Inc.; or ° DH Estates, Inc. (formerly Delaware and Hudson Railroad). As you may well be aware, the railroads listed above receive numerous notices on a daily basis.
