Per our calculations of the proposed addition to the Eichler Residence at I 1 Tyler Road, North Andover,
Massachusetts, we feel that we have met the requirements of the following Town ofNorth Andover
Zoning Regulations:
2.37.1 Family Suite (1987/22)
A separate dwelling unit located within a single family dwelling subordinate in size to the principal unit
and separated from it in a manner, which maintains the appearance of the building as a single-family
dwelling. The size of the family suite is not to exceed 1200 square feet or not more than 25% of the
gross floor area of the principal unit, whichever is lesser_ The family suite may only be occupied by
brothers, sisters, maternal parents and grandparents, in-laws and or children of the residing owners of
the principal dwelling unit. In no case shall an apartment be smaller than the minimum required by
health and building codes.
The existing residence contains 1326 SF of main floor finished living space and 300 SF of lower
level\basement finished living space. It also contains approxmately 426 SF of finshed living spac.eon
the 2nd floor_
The total amormt of finished space totals 2052 SF. 2052\4 (or 25%) = 513 SF of Family Suite
Allowable Space.
The proposed Family Suite in the proposed project is less than the allowable amount of 513SF at 450
SF_

This G: nstruction Contract (hereinafter the "Contract")is hereby made

LLC of 18 & Rdemy Avenue, Haverhill, MA 01835 (hereinafter "Contractor)
collectively n: ferred to herein as the "Parties".
ARTICLE 1
A. Contre %tor shall provide the following Construction Services (the
"Projei: t"), as agreed to in a signed Proposal related to said scope.
B. Client +:ngages Contractor and Contractor agrees to provide to Client
all nec,:ssary service , materials, and labor necessary for the
compk lion of the Project including, but not limited to, all building and
constri action materials outlined in the signed scope. Material estimate
and all necessary tools and machinery needed for Project completion.
All cor!struction materials should be new and of the highest quality,
unless, previously specified by the Client. (re- V.,;&
C. Contn ctor shall provide the construction services for the Project at

A. In cons deration of the performance of this Contract, Client agrees to

C. After ri: iceiving notification by Contractor of each stage of completion,
Client i )r its designee will inspect and approve the work or request
any ne! -lessary adjustments to same. Client agrees to make payments
to Cor, :ractor after approving work. Payment shall only be adjusted
upon tl ie mutual consent of both Parties if due to unseen events or
the parameters of the work are expended materially beyond the terms
of the o;ontract. This Contract and associated fees will be modified
accorclingly in the form of Extra Work Orders which once signed and
witne; 3ped to shall become a part of this Contract.
ARTICLE IV
A. All changes or modifications to the work ordered by Client must be
made in writing, with appropriate adjustments made to total payment
and pa�iment schedule. The approval of both Parties shall be required
in the fr rm of an Extra Work Order for substantial Project changes as
these c� ranges will effect date of completion, Project price, and
notifica-f�: ons of these changes must be made in a timely manner.
B. If these changes should require additional expense to Contractor,
Contra(; for must make a claim for increase in payment, in writing to
Client ir a timely manner. Client must approve this claim for increase
in writir►g prior to any changes to the work, Project or schedule. All
such di: cuments relating to changes to this Project must be signed
and witnessed to and will become a part of this Contract.
ARTICLE V
A. If Conti, actor is delayed from completing required work due too
unavoii; able casualties, Client shall grant Contractor an extension for
the cor ►pletion of work equal to the delay. Unavoidable casualties
includE but are not limited to, fire, flood or natural disasters, delayed
acquisia ion of materials or material delivery, and negligence or non-
paymei )t on the part of the Client.
B. In the Event of unavoidable casualties, Contractor shall properly
docum„nt both the event and the impact of the event on Project
completion. Documentation shall be presented to Client in a timely
manner.
ARTICLE VI
A. If Conti actor fails to correct defective work or persistently fails to
supply materials or equipment in accordance with the Contract
docurr,:nts, Client may order Contractor to stop the work or any
portior thereof, until the cause for such order has been eliminated.
ARTICLE VII
A. Free ac .ess to the work and the Project site shall be granted by
Contra(: for to Client, the designated agents of the Client, and all
necess.Jry public authorities.
B. Contra(: for agrees to keep the premises clean and orderly. Contractor
shall reinove all debris as needed during the hours of work in order to
maintain work conditions free of health or safety hazards.
ARTICLE VII
A. Cont ractor shall conduct its activities in a professional manner and
adhi; re to reasonable wishes of Client in relation to its working
sch(.;dule. Additionally, Contractor's work shall adhere to and be in
compliance with both the Standard Practices of the Trades and
any relevant Manufacturers Specifications.
B. Con ractor shall protect all work adjacent to the Project site from
any, iamage resulting from the work of Contractor and shall repair
or rc place any damaged work at its own expenses. Contractor
shat take all precautions to protect persons from injury and
unnr; �cessary interference or inconvenience.
ARTICLE IX
A. Client grees to hold harmless, indemnify and defend Contractor and
each individual or entity that is an agent, affiliate, partner, officer, or
stockholder of same against any and all claims, losses, liabilities,
damag,;s, and expenses, including legal fees, fines, judgments,
settler, ent amounts all made in connection with , or arising from
errors i i any representation or warranty made by Client under this
Contra. A, any breach of the Contract by Client, or any omission or
neglig(; nt act or error by Client in connection with this Contract,
provide, d by such negligent act, omission, or error was not done at the
directii: n of Contractor.
B. Contrc-Aor agrees to hold harmless, indemnify and defend Client and
each it dividual or entity that is an agent, affiliate, partner, officer, or
stockh,)lder of same against any and all claims, losses, liabilities,
damac1es, and expenses, including legal fees, fines, judgments,
settlemi: ,nt amounts all made in connection with , or arising from
errors ir any representation or warranty made by Contractor under
this Coy -tract, any breach of the Contract by Contractor, or any
omissic. i or negligent act or error by Contractor in connection with
this Con tract, provided by such negligent act, omission, or error was
not done; at the direction of Client.
ARTICLE X
A. Con's actor may be responsible for insurance to protect against any
propi;rty damage, bodily injury, death, or other claims for damages
that i nay result from the commission of the work, including general
liabV ty insurance and workers compensation insurance for its
employees and/or subcontractors.
ARTICLE XI
A. Contra;, for will be responsible for obtaining all the necessary permits
and lic( nses to fulfill the services specified in this Contract.
ARTICLE XII
A. Contral::tor is responsible for maintaining proper work, safety and
environ mental protection standards. Contractor agrees to hold Client
harmle:;s for all fines from federal, state or local agencies and
regulators. Contractor will work in compliance with all standards
requim, J by EPA, OSHA and other applicable federal agencies.
Contra;:tor will be responsible for paying all fines and judgments
levied r y these agencies resultant from the performance of this
Contra i :t.
ARTICLE XIII
A. The re, ationship created between the Parties shall be limited to that
of inde )endent contractors. Neither party shall undertake any actions
that wc; uld imply or seek to establish, any partnership, ownership,
emplo,,, ment, joint venture, or trust relationship between the Parties,
except by amendment to this Contract.
ARTICLE XIV
A. Any dispute or claim related to or arising from this Contract, its
perform ance, breach, interpretation, validity, or enforceability, shall be
exclusil,, ely(except as provided below) resolved by final binding
arbitrate m before AAA American Arbitration Association utilizing AAA
Commc rcial Arbitration Rules.
B. The arbitrator shall be selected using AAA procedures. The arbitrator
shall rei ider a written decision within thirty calendar days of the
hearing The arbitrator may award attorneys' fees or punitive,
incidenl al, consequential, treble, or other multiple or exemplary
damag}::s.
C. Award:°, shall be final, binding, and non -appealable, with the
exception of the grounds for appeal guaranteed by the Federal
Arbitrai on Act and applicable laws. All awards may be filed with one
or more: courts, state, federal or foreign having jurisdiction over the
party a,; lainst whom such award is rendered or its property, as a basis
of judg:, nent and the issuance of execution of its collection.
ARTICLE XV
A. Both P; irties are expressly prohibited from assigning this Contract or
any rigl its or interest flowing therefrom. Assignment will only occur

B. This G: intract contains the entire agreement and understanding
between n the Parties and supersedes any prior or contemporaneous
written or oral Contracts, representations, and warranties between
them r: -specting the subject matter of this Contract.

Procedure & Requirements for
an Application for a Special
Permit
Twelve (12) copies of the following information must be
submitted thirty (30) days prior to the first public hearing
Failure to submit the required information within the
time periods prescribed may result in a dismissal by the
Zoning Board of an application as incomplete.
The information herein is an abstract of more specific
requirements listed in the Zoning Board Rules and
Regulations and is not meant to supersede them. The
Petitioner will complete items that are underlined
STEP 1: ADMINISTRATOR PERMIT DENIAL:
The petitioner applies for a Building Permit and
receivers a Zoning Bylaw Denial form completed by the
Building Commissioner.
STEP 2: SPECIAL PERMIT APPLICATION FORM
Petitioner completes an application form to petition the
Board of Appeals for a Special Permit. All information
as required in items 1 through and including 11 shall be
completed.
STEP 3: PLAN PREPARATION:
Petitioner submits all of the required plan information as
cited in Section 10 page 4 of this form.
STEP 4: LIST OF PARTIES IN INTEREST:
The petitioner requests the Assessors Office to compile
a certified list of Parties in Interest (abutters).
STEP 5: SUBMIT APPLICATION:

STEP 6: SCHEDULING OF HEARING AND
PREPARATION OF LEGAL NOTICE:
The Office of the Zoning Board of Appeals schedules
the applicant for a hearing date and prepares the legal
notice for mailing to the parties in interest (abutters) and
for publication in the newspaper. The petitioner is -
notified that the legal notice has been prepared and the
cost of the Party in Interest fee.
STEP 7: DELIVERY OF LEGAL NOTICE TO
NEWSPAPER
The petitioner picks up the legal notice from the Office
of the Zoning Board of Appeals and delivers the legal
notice to the local newspaper for publication.
STEP 8: PUBLIC HEARING BEFORE THE ZONING
BOARD OF APPEALS:
The petitioner should appear in his/her behalf, or be
represented by an agent or attorney. In the absence of
any appearance without due cause on behalf of the
petition, the Board shall decide on the matter by using
the information it has received to date.
STEP 9: DECISION:
After the hearing, a copy of the Board's decision will be
sent to all parties in interest. Any appeal of the Board's
decision may be made pursuant to Massachusetts
General Law ch. 40A sec. 17, within twenty (20) days
after the decision is filed with the Town Clerk.

STEP 10: RECORDING THE DECISION AND PLANS

9 WRITTEN DOCUMENTATION
Application for a Special Permit must be supported by a
legibly written or typed memorandum setting forth in
detail all facts relied upon. When requesting a Special
Permit from the requirements of MGLA ch. 40A, and the
North Andover Zoning By-laws, all dimensional
requirements shall be clearly identified and factually
supported. All points, 1-6, are required to be
addressed with this application.
1. The particular use proposed for the land or structure.
2. The specific site is an appropriate location for such
use, structure or condition.
3. There will be no nuisance or serious hazard to
vehicles or pedestrians.
4. Adequate and appropriate facilities will be provided
for the proper operation of the proposed use.
3. The use is in harmony with the purpose and intent of t
Zoning Bylaw.
6. Specific reference and response to the criteria
required by the particular Special Permit for which
this application is made (i.e. the Earth Removal
Special Permit has unique criteria and submittal
requirements.).
10. PLAN OF LAND
Each application to the Zoning Board of Appeals shall
be accompanied by the following described plan. Plans
must be submitted with this application to the Town
Clerk's Office and ZBA secretary at least thirty (30) days
Prior to the public hearing before the Zoning Board of
appeals.
A set of building elevation plans by a Registered
Architect may be required when the application
involves new constructionfa conversion/ and/or a
Proposed change in use.
10 A. Major Projects
Major projects are those, which involve one of the
following whether existing or proposed:
I) five or more parking spaces,
Il) three (3) or more dwelling units,
III) 2000 square feet of building area.
Major Projects shall require that in addition to the above
features, plans roust show detailed utilities, soils, and
topographic information.
*10. B. *Plan Specifications:
I) Size of pian: Ten (10 ) paper copies of a plan not
to exceed 11 "x17", preferred scale of v --4o,
SPECIAL PERMIT
Il) One (1) Mylar, with one block for Registry Use
Only, and one block for five (5) ZBA signatures and
date.
III) Plan shall be prepared, stamped and certified by
a Registered Professional Land Surveyor. Please
note that pians by a Registered Professional Engineer,
Registered Architect, and/or a Registered Landscape
Architect may be required for Major Projects.

I) Site Orientation shall include:

3. names of streets
4. wetlands (if applicable)
5. abutters of property, within 300' radius
6. locations of buildings on adjacent properties
within 50' from applicants proposed structure

1. Proposed features in solid lines & outlined in red
2. Existing features to be removed in dashed lines
3. Graphic Scales
4. Date of Plan
5. Title of Plan
6. Names addresses and phone numbers of the
applicant, owner of record, and land surveyor.

10 D. Minor Projects
Minor projects, such as decks, sheds, and garages,
shall require only the plan information as indicated with
an. asterisks (*). In some cases further information may
be required
11. APPLICATION FILING FEES
A. Notification fees: Applicant shall provide a
check or money order to: "Town of North Andover' for
the cost of first class, certified, return receipt x # of
all parties in interest identified in MGLA ch. 40A §11
on the abutter's list for the legal notice check. Also,
the applicant shall supply first class postage stamps
for each address listed on the abutter's list, plus an
additional 2 for the decision mailing.
B. Mailing labels: Applicant shall provide four (4)
sets of mailing labels no larger than 1 "x2 -5/8A (3 copies
for the Legal mailing and one copy for the Decision
mailing).
