No system shall receive oil, hazardous materials or waste, medical wastes or radioactive wastes. (8) No person shall discharge or allow the discharge of stabilized recreational vehicle wastes, stabilized boat wastes, wastes from funeral homes, car washes qr buses, or from the backwash of water purification or filtration devices to any system regulated under 310 CMR 15.000. (9) No discharge of sewage to a dry well or open drain shall be permitted pursuant to 310 CMR 15.000. Discharges to dry wells shall be in compliance with the Underground Water Source Protection Control regulations, 310 CMR 27.00. Backwash of water purification or filtration devices may be discharged to a dry well or to the ground. 15.005: Transition Rules (1) Except as explicitly set forth in 310 CMR 15.005, all provisions of 310 CMR 15.000 shall apply to all systems, regardless of date of construction. (2) Applications for Disposal Works Construction Permits filed prior to March 31, 1995. Applications for disposal works construction permits filed prior to March 31, 1995, except applications for systems with design flows of 10,000 gpd or greater that would, if constructed, threaten, public health and safety and the environment as described in 310 CMR 15,304(2) shall be reviewed, and if approved, such systems shall be constructed in accordance with, the 1978 Code requirements and any applicable local requirements. Construction of systems for which such a disposal system construction permit application is granted shall be completed within three years of the receipt of such disposal system construction permit or the provisions of 310 CMR M000 shall apply. (3) Isolated Lot. The owner of a lot duly recorded and not held in common ownership with any adjoining land, as of August 1, 1994and on which construction of such a system in full compliance with 310 CMR 15.000 is not fcasiblc, is entitled to construct a system on that land with a cumulative design flow of up to 330 gpd, provided that all of the following conditions are met: (a) the applicant demonstrates that such a system could have been constructed on that lot in compliance with the 1978 Code, without variances other than varianecs from property line, swimming pool, or cellar wall distances set forth in 310 CMR 15,03(7) of the 1978 Code; (b) the owner of that facility files a valid application for a Disposal System Construction Permit in accordance with 310 CMR 15.000 on or before Ianuary 1, 2000 and (c) the system is constructed in compliance with 310 CMR 15.000 to the maximum extent feasible, as determined by the local approving authority pursuant to 310 CMR 15.404 and 15.405, and in compliance with the Disposal System Construction Permit issued by the local approving authority. Permitted construction shall be completed within three years of the receipt of the Disposal System Construction Permit. (4) Contiguous Lots, Where full compliance with 310 CMR MOW is not feasiblc on one or more contiguous lots which were held in common ownership on August 1, 1994 and which lots arc not subject to a subdivision plan endorsed by a Planning Board pursuant to the Subdivision Control Law, the local approving authority may issue only one Disposal System Construction Permit other than in full compliance with 310 CMR 15.000 for any such lot, authorizing construction of a system with a cumulative design flow of up to 330 gpd, provided that the conditions set forth at 310 CMR 15,005(3xa) through 15.005(3)(c) arc met, All other systems on such contiguous lots in addition to the one -330 gpd system authorized herein shall be constructed in full compliance with 310 CMR 15MO, For purposes of 310 CMR 15,005(4) two lots shall be considered contiguous if they abut on any border or if they arc each contiguous with one or more other lots under common ownership. 12/27/96 310 CMR - 493 310 CMR: DEPARTMENT OF ENVIRONMENTAL PROTECTION 15.027: continued (2) It shall be a violation of 310 CMR 15.000 for any person to add, place or introduce septic system additives to any system without the prior written determination of the Department that the additive has met the criteria set forth in 310 CMR 15.027(3). (3) The Department may allow a septic system additive when it is demonstrated to the Department's satisfaction that the additive will not: (a) harm the components of the system; (b) adversely affect the functioning of the system; or (c) adversely affect the environment. (4) A Department determination that the additive has met the criteria contained in 310 CMR 15.027 shall not constitute an endorsement or approval with respect to the effectiveness or performance of the additive. Representation by any person that such Department determination constitutes such endorsement or approval shall be a violation of 310 CMR 15.000. 15.028: Soil Absorption System Restoration (1) It shall be a violation of 310 CMR .15.000 for any approved System Inspector, Soil Evaluator, Licensed Installer or Septage Hauler to introduce or to recommend the use of any physical, chemical or biological treatment process to restore or condition a soil absorption system without the prior written determination of the Department that the proposed treatment process has met the crieria set forth in 310 CMR 15.027(3). Physical treatment is not intended to include pumping, flushing, and routing of pipes or any mechanical methods of repairing existing components. The Department shall maintain and publish a list of allowed treatment processes. (2) It shall be a volation of 310 CMR 15.000 for any person to use any physical, chemical or biological treatment process to restore or condition a soil absorption system without the prior written determination of the Department that the proposed treatment process has met the criteria set forth in 310 CMR 15.027(3). (3) A Department determination that the treatment process has met the criteria contained in 310 CMR 15.027(4) shall not constitute an endorsement or approval with respect to the effectiveness or performance of the treatment process. Representation by any person that such Department determination constitutes such endorsement or approval shall be a violation of 310 CMR 15.000. 15.029: Construction of Wells Near Existing Systems It is a violation of 310 CMR 15.000 for any person to construct or install a water supply well closer to a system component than the relevant setbacks set forth in 310 CMR 15.211. 15.030: Records (1) The local approving authority shall maintain records for each system within its jurisdiction and shall keep on file copies of the following documents: (a) Applications, plans and specifications for the construction, upgrade or expansion of on-site subsurface sewage disposal systems, including all forms and data submitted by the applicant and Soil Evaluator; (b) Disposal System Construction Permits; (c) As -built plans indicating all modifications to the approved plans subsequent to the issuance of a Disposal System Construction Permit; (d) Reports of construction inspections made prior to issuance of a Certificate of Compliance; (e) Certificates of Compliance issued or denied; 12/27/96 310 CMR - 502 Sawyer, Susan i To: carol.kollias@nemoves.com hftp:/twww.mass.gov/dph/beha/beaverstlOeme.pdf hftp:/AAww.mass.gov/dph/beha/beaverstbeavh.htm I spoke with Allison in Conservation, she said there is a large wetland behind you shown on the maps. The MCP requires that the local chief municipal officer and board of health be notified of the completion of a' Response Action Outcome (RAO) Statement for the Site. IRA activities took placezon April 3, 2006, following the release of approximately 11 gallons of non -polychlorinated biphenyl (non -PCB) mineral oil dielectric fluid (MODF) from a pad -mounted electrical transformer stored at the MECo Merrimack Valley District Headquarters (MVDH) located at 1101 Turnpike Street in North Andover, Massachusetts. The release of MODF impacted the asphalt -pavement within a bermed transformer storage area, affecting an area of approximately 330 square feet. The area impacted by the MODF release was limited to the asphalt -paved surface; no environmental media were affected by the release. Granular oil -absorbent material was applied to the affected surfaces. The spent oil -absorbent material was collected into 55 -gallon drums and incorporated into MECo's standard waste disposal program. Based cleanup activities and Ransom's observations, the area impacted by the MODF release has been satisfactorily remediated. (Ransom) has prepared a Phase I Initial Site Investigation (Phase I ISI) Report summarizing the response actions performed following the discovery of a release of approximately 30 gallons of vegetable oil-based hydraulic fluid from a hydraulic piston associated with a lift located inside the MECo Service Center Garage (the Garage) at MECo's Merrimack Valley District Headquarters (the Facility) in North Andover, Massachusetts. For purposes of this Phase I ISI, the Site is defined as the approximately 750 -square -foot portion of the Garage centered on the southernmost hydraulic lift. Pursuant to 310 CMR 40.1403(3)(e), this letter serves to notify the chief municipal officer and board of health of the availability of the Phase I Report. A copy of this letter has also been transmitted to Mr. Mark Rees, Town Manager. On October 29, 2004, MECo discovered that a vegetable oil-based hydraulic fluid had leaked from a hydraulic lift utilized in one of the service bays at the Garage. The vegetable oil-based hydraulic fluid (Mobil EAL 224H) was observed dripping from the top of the hydraulic cylinder into the concrete lift pit. What appeared to be ground water was observed in the bottom of the lift pit. Based on the quantity of hydraulic fluid used to "top-off"the the cylinder, MECO estimated that not more than 30 gallons of hydraulic fluid had been released from the cylinder over an unknown period of time. Due to the presence of what appeared to be ground water in the base of the lift pit, MECo notified the Massachusetts Department of Environmental Protection (MA DEP) to report a potential Condition of Substantial Release Migration (CSM). Ms. Susan Sawyer North Andover Health Director On October 29, 2004, Ransom was present at the Site to observe initial IRA activities which included the removed approximately 550 gallons of the hydraulic fluid and hydraulic fluid -impacted water from the lift pit. During the week of February the interior of the lift pit was cleaned and an attempt to seal the lift pit with hydraulic cement was made. During the cleaning of the interior of the lift pit, water was observed to enter the pit. No evidence of light non -aqueous phase liquid (LNAPL) was observed on the water entering the pit. Attempts to seal the cracks in the pit were unsuccessful, as the pressure of the water entering the pit was sufficient to dislodge the hydraulic cement before it could cure. In an effort to assess the impacts to soil and/or ground water, Ransom performed a limited subsurface investigation (LSI) at the Site on February 25, 2005. The LSI included the advancement of four soil borings which were completed as ground water monitoring wells, gauging of the monitoring wells for the presence of light non -aqueous phase liquid (LNAPL), and the collection and chemical analysis of soil and ground water samples. The results of the Phase I ISI indicate that vegetable oil-based hydraulic fluid - impacted soil and ground water is present below the concrete floor of the Garage, the vertical and horizontal extent of which has not been completely defined. In addition, LNAPL is currently present on ground water in an on-site monitoring well. In addition, a second and currently unknown source of petroleum hydrocarbons may have been present at one corner of the Site. Based on the results of the Phase I ISI, Ransom concludes that additional response actions are necessary at the Site to further define the nature and extent of the hydrocarbon contamination and to address the presence of LNAPL. Because the Numerical Ranking System (NRS) score for the Site was below the Tier II cutoff score of 350, it is Timothy J. Snay's opinion as a Licensed Site Professional (LSP) that the Site meets the conditions of a Tier II site in accordance with the MCP. A Tier II ranking is the lowest possible ranking and indicative of a lower priority site and least risk due to environmental conditions. Notification of the completion of the Phase I Report and Tier Classification is also required to be published in a newspaper that circulates in the community where the Site is located. The Department has reason to believe that the release/threat of release which was reported is or may be a disposal site as defined in the Massachusetts Contingency Plan (MCP), 310 CMR 40.0000. The Department also has reason to believe that you (as used in this letter "you" refers to Mass Electric Company) area Potentially Responsible Party (PRP) with liability under Section 5A.of M.G.L. c. 21 E. This liability is "strict" meaning that it is not based on fault but solely on your. status as owner, operator, generator; transporter, disposer or other person specified in Section 5A. This liability is also "joint and several", meaning that responsible parties are liable for all response costs incurred ata disposal site even if there are other liable parties. The Department encourages parties with liabilities under M.G.L. c. 21 E to take prompt action in response to releases and threats of release of oil and/or hazardous material. By taking prompt action, you may significantly lower your assessment and cleanup costs and avoid the imposition of, or reduce the amount of, certain permit and annual compliance fees for response actions payable under 310 CMR 4.00. In addition, the MCP requires persons undertaking response actions at disposal sites to perform Immediate Response Actions (IRAs) in response to "sudden releases", Imminent. Hazards and Substantial Release Migration. Such persons must continue to evaluate the need for IRAs and notify the Department immediately if such a need exists. You must employ or engage a Licensed Site Professional (LSP) to manage, supervise or actually perform the necessary response actions at the subject site. In addition, the MCP requires persons undertaking response actions at a disposal site to submit to the Department a Response Action Outcome Statement (RAO) prepared by an LSP in accordance with 310 CMR 40.1000 upon determining that a level of No Significant Risk already exists or has been achieved at a disposal site or portion thereof. [You may obtain a list of the names and addresses of these licensed professionals from the Board of Registration of Hazardous Waste Site Cleanup Professionals at (617) 556-1091.] There are several other submittals required by the MCP which are related to release notification and/or response actions that may be conducted at the subject site in addition to an RAO, that, unless otherwise specified by the Department, must be provided to DEP within specific regulatory timeframes. The submittals are as follows: (1) If information is obtained after making an oral or written notification to indicate that the release or threat of release didn't occur, failed to meet the reporting criteria at 310 CMR 40.0311 through 40.0315, or is exempt from notification pursuant to 310 CMR 40.0317, a Notification Retraction may be submitted within 60 days of initial notification pursuant to 310 CMR 40.0335; otherwise, (2) If one has not been submitted, a Release Notification Form (RNF) [copy attached] must be submitted to DEP pursuant to section 310 CMR 40.0333 within 60 calendar days of the initial date of oral notification to DEP of a release pursuant to 310 CMR 40.0300 or from the date the Department issues a Notice of Responsibility (NOR), whichever occurs earlier; (3) Unless an RAO or Downgradient Property Status Submittal is provided to DEP earlier, an Immediate Response Action (IRA) Plan prepared in accordance with 310 CMR 40.0420, or an IRA Completion Statement (310 CMR 40.0427) must be submitted to DEP within 60 calendar days of the initial date of oral notification to DEP of a release pursuant to 310 CMR 40.0300 or from the date the Department issues an NOR, whichever occurs earlier; and Mass Electric Company Page -3- (4) Unless an RAO or Downgradient Property Status Submittal is provided to DEP earlier, a completed Tier Classification Submittal pursuant to 310 CMR 40.0510, and, if appropriate, a completed Tier I Permit Application pursuant to 310 CMR . 40.0700, must be submitted to DEP within one year of the initial date of oral notification to DEP of a release pursuant to 310 CMR 40.0300 or from the date the Department issues an NOR, whichever occurs earlier. i (5) Pursuant to the Department's "Timely Action Schedule and Fee Provisions", 310 CMR 4.00, a fee of $750 must be included with an RAO statement that is submitted to the Department more than 120 calendar days after the initial date of oral notification to, DEP of a release pursuant to 310 CMR 40.0300 or after the date the Department issues an NOR, whichever occurs earlier, and before Tier Classification. It is important to note that you must dispose of any Remediation Waste generated at the subject location in accordance with 310 CMR 40.0030 including, without limitation, contaminated soil and/or debris. Any Bill of Lading accompanying such waste must bear the seal and signature of an LSP or, if the response action is performed under the direct supervision of the Department, the signature of an authorized representative of the Department. Massachusetts Electric Company (hereafter referred to as "you/your") retained the services of Ransom Environmental Consultants, Inc. (Ransom) of Newburyport, Massachusetts to perform the spill cleanup. According to the report prepared by Ransom dated ,7anuary 20, 1992, five "post cleanup" soil samples were collected within the excavation for total petroleum hydrocarbon (TPH) analysis. Sample WW -2, collected from the west wall of the excavation, had the highest TPH concentration of 1,400 parts per million (ppm). Further excavation in this area was limited by a natural gas utility line. Consequently, since this excessive TPH concentration remains in the soils, the Department is requiring one monitoring well be installed in close proximity to the west end of the excavation to determine if groundwater has been impacted by this release of oil. Pursuant to the Department's authority to perform information -gathering activities and its authority to investigate, sample and inspect records, conditions, equipment, practices or property under M.G.L. C.21E sections 2, 4 and 8, you are directed to provide to the Department, within twenty-one (21) days of the date of this letter, an incident report to include (a) TPH data on the groundwater, analyzed according to EPA Methods 503B & E; and (b) depth at which "post cleanup" soil samples were collected within the excavation on November 30, 1991. This information is required by the Department in order to ascertain that cleanup was performed consistently with Departmental guidelines and standards for cleanup activities. G.L. c.21E section 4. Moreover, the collection of such information constitutes an assessment action under Sections four and eight of the statute comprised of information -gathering activities needed to better evaluate the need for further emergency response actions at this site of a release of oil (see G.L. c.21E Section 1, "assessment"). The Department's investigation has found that a sweeper was cleaning the parking lot in front of the office entrance to the facility when a hydraulic line ruptured. This caused approximately 10 gallons of oil to be released to the parking lot surface. Such incident is governed by The Massachusetts. Contingency Plan (MCP), 310 CMR 40.000 and Chapter 21E of the General Laws of Massachusetts (hereinafter "M.G.L. Chapter 21E"), the Massachusetts Oil and Hazardous Material Release Prevention and Response Act, which was enacted on March 24, 1983. Chapter 21E and the MCP identify as responsible parties the current owner or operator of a site at which there has been a release or threat of release of oil or a hazardous material; the past owner or operator of asite where a release of hazardous material has occurred; any person who directly or indirectly arranged for the transport, disposal, storage or treatment of hazardous materials to or at such a site; and any person who caused or is legally responsible for a release or a threat of release of oil or a hazardous"material at such a site. Such parties are liable without regard to fault; the nature of this liability is joint and several. (M.G.L. Chapter 21E, Section 5a). This letter is to inform you in writing that: (1) The Department has determined that a release or threat of release of hydraulic oil has occurred at the subject site. The debt, together with interest, creates a lien on all your property in the Commonwealth. Lien placement will increase your administrative cost liability. This liability will further increase if the Department is required to go to court to recover its costs. In addition to the foreclosure remedy provided by the lien, the Attorney General of the Commonwealth may recover that debt or any part of it in an action against you. You may also be liable under M.G.L. CHAPTER 21E and 310 CMR 40.000 On July 1.2, 1990, Department personnel investigated reports concerning the release of diesel fuel at the above referenced location. One 10,000 gallon underground diesel storage tank failed tightness testing on July 1.1 with a leakage rate of 0.24 gallons per hour. The tank's piping was then exposed and the vent pipe discovered as the cause of the leak. The tank was retested and passed. Such incident is governed by the Massachusetts Contingency Plan (MCP), 310 CMR 40.000 and Chapter 21E of the General Laws of Massachusetts (hereinafter "M.G.L. Chapter 21E"), the Massachusetts Oil and Hazardous Material Release Prevention and Response Act, which was enacted on March 24, 1983. Chapter 211E and the MCP identify as responsible parties the current owner or operator of a site at which there has been a release or threat of release of oil or a hazardous material; the past owner or operator of a site where a release of hazardous material has.occurred; any person who directly or indirectly arranged for the t.ransport,'disposal, storage or treatment or hazardous materials to or at such a site; and any person who caused or is legally responsible for a release or a threat of release of oil or a hazardous material at such a site. Such parties are liable without regard to fault; the nature of this liability is joint and several. (M.G.L. Chapter 21E, Section 5a) . This letter is to inform you in writing that: (1) The Department has determined that a release of diesel fuel has occurred at the subject site. (2) Information available to the Department indicates that you as owner of the subject site, are a liable and "responsible" party pursuant to Section 5(a) of Chapter 21E. Department personnel notified Robert Hughes, Transportation Superintendent, verbally of your responsibility on July 16, 1990 and he accepted such responsibility at that time. If the public funds are expended under such conditions, Chapter 21E, Section 11 stipulates that the Attorney General of the Commonwealth of Massachusetts may initiate legal action against the responsible party(s) to recover all costs incurred by the Department in the assessment, containment, and removal of any release or threat of release of oil or hazardous material. (5) The Liability of responsible parties in (4) above includes: a. Administrative costs incurred by the Department in handling this matter. b. Interest charges on the total liability at the statutory rate of 12% compounded annually; and C. Treble costing (i.e., three (3) times the total amount of response costs the Department incurs); and d. All damages for the injury, destruction or loss of: natural resources due to the release. This liability constitutes a debt to the Commonwealth. The debt, together with interest, creates a lien on all your property in the Commonwealth. Lien placement will increase your administrative cost liability. This liability will further increase if the Department is required to go to court to recover its costs. Administrative and legal costs for simple spill cases which reach this stage total at least $3,300.00. In addition to the foreclosure remedy provided by the lien, the Attorney General of the Commonwealth may recover that debt or any part of it in an action against you. You may also be liable for each violation of C.21E as well as for additional penalties or damages pursuant to other statutes or common law. Your acceptance of responsibility for such release means that : (1) You have entered into a contract with an environmental consultant named, Ransom Environmental Consultants, Inc. of Newburyport, Massachusetts to (a) perform the spill cleanup as deemed necessary by the Department; (b) perform necessary analyses of the waste material and make arrangements for its appropriate treatment/disposal; (c) perform analysis of the soil/water/groundwater impacted by the release to determine contaminant conditions at the site after the initial response to the incident; and (d) submit a report of their findings for review by the Department. C.21E Sections 2,4 and 8, you are directed to provide to the Department, within seven (7) days of the date of this letter, an incident report to include the following information: (1) a brief account of why, how and where such release occurred; and (2) a brief description of all emergency.remedial actions that have been and/or will be taken relative to such release; please include field screening data and/or analytical data (soil/groundwater) describing contaminant conditions at the site; and (3) an estimate, to the best of your knowledge, of the quantity of oil released; and (4) photocopies of all waste manifests for the oil released; and (5) laboratory results of soil/water samples taken from the "cleaned up" environmental media impacted by the release. Youare whereby notified that failure to respond to this letter in a timely manner, is a violation of 310 CMR 40.008 and the submission of false and inaccurate information is a violation of 310 CMR 40.009 and 40.011. GENERAL RESPONSE ACTION REQUIREMENTS The subject site shall not be deemed to have had all the necessary and required response actions taken unless and until all substantial hazards presented by the site have been eliminated and a level of No Significant Risk exists or has been achieved in compliance with M.G.L. c._. 2 1 E and the MCP. Such persons must continue to evaluate the need for IRAs and notify the Department immediately if such a need exists. You must employ or engage a Licensed Site Professional (LSP) to manage, supervise or actually perform the necessary response actions at the subject site. In addition, the MCP requires persons undertaking response actions at a disposal site to submit to the Department a Response Action Outcome Statement (RAO) prepared by an LSP in accordance with 310 CMR 40.1000 upon determining that a level of No Significant Risk already exists or has been achieved at a disposal site or portion thereof. [You may obtain a list of the names and addresses of these licensed professionals from the Board of Registration of Hazardous Waste Site Cleanup Professionals at (617) 556-1145.] There are several other submittals required by the MCP which are related to release notification and/or response actions that may be conducted at the subject site in addition to an RAO, that, unless otherwise specified by the Department, : must be provided to DEP within specific regulatory timeframes. The submittals are as follows: (1) If information is obtained after making a oral or written notification to indicate that the release or threat of release didn't occur, failed to meet the reporting criteria at 310 CMR 40.0311 through 40.0315, or is exempt from notification pursuant to 310 CMR 40.0317, a Notification Retraction must be submitted within 60 days of initial notification pursuant to 310 CMR 40.0335; otherwise, (2) If one has not been submitted, a Release Notification Form (RNF) must be submitted to DEP pursuant to section 310 CMR 40.0333 within 60 calendar days of the initial date of oral notification to DEP of a release pursuant to 310 CMR 40.0300 or from the date the Department issues a Notice of Responsibility (NOR), whichever occurs earlier; (3) Unless an RAO is submitted earlier, an Immediate Response Action (IRA) Plan prepared in accordance with 310 CMR 40.0420, or an IRA Completion Statement (310 CMR 40.0427) must be submitted. to DEP within 60 calendar days of the initial date of oral notification to DEP .of a release pursuant to 310 CMR 40.0300 or from the date the Department issues an NOR, whichever occurs earlier; and (4) Unless an RAO is submitted earlier, a completed Tier Classification Submittal pursuant to 310 CMR 40.0510, and, if appropriate, a completed Tier I Permit Application pursuant to 310 CMR 40.0700, must be submitted to DEP within one year of the initial date of oral notification to DEP of a release pursuant to 310 CMR 40.0300 or from the date the Department issues an NOR, whichever occurs earlier. Ms. Beecy: on March 4, 1996, at 1:20 PM, you notified the -Department of Environmental Protection (the Department) that up to thirty eight gallons of mineral oil dielectric fluid had been released from a Massachusetts Electric Company pole mounted transformer located at the intersection of Osgood Street and Bradford Street in North Andover when a motor vehicle struck the pole, causing the transformer to be knocked to the traffic island located at the base of the island. This release of oil occurred on March 2, 1996 at 10:30 AM but was not discovered until March 4, 1996 at 12:30 PM when the transformer was found to be empty during an inspection at the Massachusetts Electric maintenance facility. The release occurred during a snowstorm and for this reason, release conditions were not observed during initial cleanup efforts at the site. Stained surficial soils indicative of a recent oil spill were later found in the traffic island where the transformer had landed. This represents a sudden release of oil as defined in 310 CMR 40.0311(1)(a) of the Massachusetts Contingency Plan (The MCP). Based on this information, the Department has reason to believe that the subject property or.portion(s) thereof is a disposal site as defined in the Massachusetts Oil and Hazardous Material Release Prevention and Response Act, M.G.L. c. 21E, and the MCP, 310 CMR 40.0000. For purposes of this notice, the terms and phrases used herein shall have the meaning ascribed to them by the MCP unless the text clearly indicates otherwise. STATUTORY LIABILITIES The Department has reason to believe that you (as used in this letter, "you" refers to Massachusetts Electric Company) are a Potentially Responsible Party (a PRP) with liability under M.G.L. c. 21E, § 5, for response action costs. Section 5 makes the following parties liable to the Commonwealth of Massachusetts: current owners or operators of a site from or at which there is or has been a release/threat of release of oil or hazardous material; any person who owned or operated a site at the time hazardous material was stored or disposed of; any person who arranged for the transport, disposal, storage or treatment of hazardous material to or at a site; any person who transported hazardous material to a transport, disposal, storage or treatment site from which there is or has been a release/threat of release of such material; and any person who otherwise caused or is legally responsible for a release/threat of release of oil or hazardous material at a site. This liability is "strict", meaning it is not based on fault, but solely on your status as an owner, operator, generator, transporter or disposer. It is also joint and several, meaning that you may be liable for all response action costs incurred at the site, regardless of the existence of any other liable parties. The MCP requires responsible parties to take necessary response actions at properties where there is or has been a release or threat of release of oil and/or hazardous material. If you do not take the necessary response actions, or fail to perform them in an appropriate and timely manner, the Department is authorized by M.G.L. c. 21E to have the work performed by -its contractors. By taking such actions, you can avoid liability for response action costs incurred by the Department and its contractors in performing 'these actions, and any sanctions which may be imposed for failure to perform response actions under the MCP. You may be liable for up to three (3) times all response action costs incurred by the Department. Response action costs include, without limitation, the cost of direct hours spent by Department employees arranging for response actions or overseeing work performed by persons other than the Department or their contractors, expenses incurred by the Department in support of those direct hours, and payments to the Department's contractors. (For more detail on cost liability, see 310 CMR 40.1200.) Notice of Responsibility; 3-13522 page 3 Pole 38, Osgood St. @ Bradford St., North Andover The Department may also assess interest on costs incurred at the rate of twelve percent (12%), compounded annually. To secure payment of this debt, the Commonwealth may place liens on all of your property in the Commonwealth. To recover the debt, the Commonwealth may foreclose on these liens or the Attorney General may bring legal action against you. In addition to'your liability for up to three (3) times all response action costs incurred by the Department, you may also be liable to the Commonwealth for damages to natural resources caused by the release. Civil and criminal liability may also be imposed under M.G.L. c. 21E, § 11, and civil administrative penalties may be imposed under M.G.L. c. 21A, § 16 for each violation of M.G.L. c. 21E, the MCP, or any order, permit or approval issued thereunder. NECESSARY RESPONSE ACTIONS The subject site shall not be deemed to have had all the necessary and required response actions taken unless and until all substantial hazards presented by the site have been eliminated and a,level of No Significant Risk exists or has been achieved in compliance with M.G.L. c. 21E and the MCP. In addition, the MCP requires persons undertaking response actions at disposal sites to perform Immediate Response Actions (IRAs) in response to "sudden releases", Imminent Hazards and Substantial Release Migration. Such persons must continue to evaluate the need for IRAs and notify the Department immediately if such a need exists. The Department has determined that an IRA is necessary at the subject site to respond to the release of approximately three hundred gallons of number four heating fuel. You are authorized to conduct only the specific response actions for which you receive approval from the Department. All Immediate Response Actions require DEP approval in accordance with 310 CMR 40.0420. You are reminded that during telephone conversations between Massachusetts Electric Company Environmental Engineer Maureen Beecy and the Department's representative, Chris Bresnahan at the time of notification and on March 20, 1996, the following activities were orally approved by the Department's representative as an IRA: 1) Cleanup of affected asphalt road surfaces using sorbents. 2) Excavate up to twenty cubic yards of mineral oil contaminated soils. 3) Transport all remediation wastes off-site for proper management on the same day they are generated. 4) Additional assessment to be determined by an LSP. In addition, the MCP requires persons undertaking response actions at a disposal site to submit to the Department a Response Action Outcome Statement (RAO) prepared by an LSP in accordance with 310 CMR 40.1000 upon determining that a level of No Significant Risk already exists or has been achieved at a disposal site or portion thereof. (You may obtain a list of the names and addresses of these licensed professionals from the Board of Registration of Hazardous Waste Site Cleanup Professionals at (617) 556-1145.] There are several other submittals required by the MCP which are related to release notification and/or response actions that may be conducted at the subject site in addition to an RAO, that, unless otherwise specified by the Department, must be provided to DEP within specific regulatory timeframes. The submittals are as follows: (1) If information is obtained after making a oral or written notification to indicate that the release or threat of release didn't occur, failed to meet the reporting criteria at 310 CMR 40.0311 through 40.0315, or is exempt from notification pursuant to 310 CMR 40.0317, a Notification Retraction must be submitted within 60 days of initial notification pursuant to 310 CMR 40.0335; otherwise, (2) If one has not been submitted, a Release Notification Form (RNF) must be submitted to DEP pursuant to section 310 CMR 40.0333 within 60 calendar days of the initial date of oral notification to DEP of a release pursuant to 310 CMR 40.0300 or from the date the Department issues a Notice of Responsibility (NOR), whichever occurs earlier; (3) Unless an RAO is submitted earlier, an Immediate Response Action (IRA) Plan prepared in accordance with 310 CMR 40.0420, or an IRA Completion Statement (310 CMR 40.0427) must be submitted to DEP within 60 calendar days of the initial date of oral notification to DEP of a release pursuant to 310 CMR 40.0300 or• from the date the Department issues an NOR, whichever occurs earlier; and (4) Unless an RAO is submitted earlier, a completed Tier Classification Submittal pursuant to 310 CMR 40.0510, and, if appropriate, a completed Tier I Permit Application pursuant to 310 CMR 40.0700, must be submitted to DEP within one year of the initial date of oral notification to DEP of a release pursuant to 310 CMR 40.0300 or from the date the Department issues an NOR, whichever occurs earlier. A fee is not required for an RAO submitted to the Department within 120 days of the date of oral notification to the Department, or the date the Department issues an NOR, whichever date occurs earlier, or after Tier Classification. It is important to note that you must dispose of any Remediation Waste generated at the subject location in.accordance with 310 CMR 40.0030 including, without limitation, contaminated soil and/or debris. Any Bill of Lading accompanying such waste must bear the seal and signature of an LSP or, if the response action is performed under the direct supervision of the Department, the signature of an authorized representative of the Department. The Department encourages parties with liabilities under M.G.L. c. 21E to take prompt action in response to releases and threats of release of oil and/or hazardous material. By taking prompt action, you may significantly lower your assessment and cleanup costs and avoid the imposition of, or reduce the amount of, certain permit and annual compliance fees for response actions payable under 310 CMR 4.00.
