The North Andover Board of Appeals held a public hearing at its regular meeting on Tuesday,the 9h of
September,2003 at 7:30 PM in the North Andover Middle School Auditorium,495 Main Street,North
Andover upon the application of Andre&Kathleen Farah,1116 Salem Street,North Andover requesting a
Variance from Section 7,Paragraph 7.3 and Table 2 for,for relief of side setbacks;and a Special Permit from
Section 9,Paragraph 9.2 in order to construct an addition to a pre-existing structure on a pre-existing non-
conforming lot. The said premise affected is property with frontage on the East side of Salem Street within
the R-1 zoning district.
The following members were present: William J. Sullivan,Walter F. Soule,John M.Pallone,Ellen P.
McIntyre,Joseph D.LaGrasse,and Joe Edward Smith.
Upon a motion by Joseph D.LaGrasse and 2d by John M.Pallone,the Board voted to GRANT a
dimensional Variance from Section 7,Paragraph 7.3 and Table 2 for relief of 23' south side setback;and
GRANT a Special Permit from Section 9,Paragraph 9.2 in order to construct a deck,family room and garage
to a pre-existing structure on a pre-existing non-conforming lot per Plot Plan of Land,location 1116 Salem
Street,North Andover,MA,prepared for Andre&Kathleen Farah,date:December 4,2002,revisions:
August 25,2003,Frank S.Giles II,P.L.S.#45493,Scott L.Giles,Frank S.Giles Surveying,50 Deermeadow

The Board finds that the applicant has satisfied the provisions of Section 10,paragraph 10.4 of the Zoning
Bylaw and that the granting of this Variance will not adversely affect the neighborhood or derogate from the
intent and purpose of the Zoning Bylaw,and satisfied the provisions of Section 9,Paragraph 9.2 of the
Zoning Bylaw that such change,extension,or alteration shall not be substantially more detrimental than the
existing structure to the neighborhood.

process of scaling back the proposed addition so that we will not need as much relief.

A. The particular use is and shall be Residential and remain as such.
B. The soil conditions, topography shall not be altered or affected.
C. The hardslup exists in 1 pre-existing non-conforming parcel of property with odd
shape with regard to building location. The septic system behind the existing building
and the wetlands on the rear portion of the property prevent the proposed addition to
be placed to the rear of the house. The parcel has plenty of build-able area but exist
as unusable space. The shape of the land prevents creation of an addition to provide
housing at a reasonable and affordable cost.
D. The proposed dwelling and addition shall be consistentt with conditions in the
immediate area.
E. The zoning is meant to protect the public health, safety conditions; traffic-.
overcrowding conditions do not derogate the purpose. This allows a family to
maintain a level of housing for the level of income.
F. There are no wetlands within 100 feet of the proposed addition or any jurisdictional
distance to warrant an RDA, but far to the rear of the property there are wetlands

This document is to address a requirement WRITTEN DOCUMENTATION of Section on page 4 of 4 on the
Special Permit application.
1. The particular uses exist as Residential and remain as such.
2. The neither use nor conditions shall cWaige;however,an addition to the structure consistent with the
neighborhood is being introduced by a size and amount consistent with the other structures in the area.
The placement of the proposed addition to the rear of the building would violate the wetland buffer
zone.
3. The abutters have been informed and do not object to the proposed addition(see attached letter).The
vehicles and pedestrians are in no proximate area to this structure and therefore are of no hazardous
condition.
4. The facilities,such as of any sewer,water,paving or any public facilities and are in place and not
being proposed with this proposed lot and dwelling.
5. The use is to remain the same and is in harmony with the purpose and intent of the zoning bylaw.
6. The criteria being requested for the extension of a structure on a non-conforming lot is basing our
appeal on not being able to purchase property of a similar value and size of which we are in possession
and would suit our special needs.After further consideration and having viewed other homes around
town it is more feasible to add on to our home rather than to move our family.
7. The Farah's have a Handi-capped child schooled in Beverly,which requires special living and busing
conditions.The busing schedule works such that the child is picked up and dropped off in a particular
order and location.
