Dear Mr. &Mrs. Clark:
This correspondence is in regards to a complaint received at the Health Department about your
property listed above. The complaint was that there was a health concern because of the
condition of the property, specifically the accumulation of articles on the right side of the home
including but not limited to; hot water tanks,trash,garbage,furniture,car parts etc. As you are
aware this complaint is similar to one filed in November of 2000.
According to the file,last fall the Building Commissioner arraigned for the removal of water
heaters and a refrigerator from your property for safety concerns. All other debris in question
was left for you as the owner to dispose of. As a follow-up to the commissioner's investigation,
an inspection by the Health Director found"no violations of the Sanitary Code"because there
"was no trash on the ground...that might entice animals".
In response to the recent complaint an inspection of the property was conducted by Health
Department personnel on April 19, 2001. An almost identical situation was found as compared
to last year. There again seems to be.an old hot water heater along with other miscellaneous
items,but no unsanitary condition was observed. The hot water heater, as was found before,
could potentially be a safety hazard. We would advise you to properly dispose of any such items
properly before an accident can occur. The DPW may be able to advise you of disposal options.

Dear Mr. &Mrs. Clark:
As by now I believe you are aware that a complaint was lodged on November 14, 2000
concerning your rental property at 119-121 Marblehead Street. A site visit was carried out
today by the Health Department on the alleged health violations.
Upon inspection there was no evidence of wild animal presence. There were two garbage barrels
sitting beside the small porch that had their lids off. However, there was no trash on the ground
around them that might entice animals. Although there is a pooper scooper law in North
Andover it applies to public and other peoples' private property. It does not apply to the
property where the animal lives. Therefore, I am pleased to inform you that there are no
violations of the Sanitary Code at this address. You might want to request that your tenants
keep lids on their trash cans to prevent possible visitations from the local wildlife.

I
As residents and taxpayers of North Andover,we would like to take this opportunity to bring to your
attention the code violations of the real estate property located at 119-121 Marblehead Street,North
Andover. This three-family,rental property which abuts ours is an extreme health hazard and an eye sore
to the community. Our valid concerns are warranted by the enclosed photographs and are defined and
outlined below:
1. INAPPROPRIATE DISPOSAL AND STORAGE OF APPLIANCES:
For a minimum of 9 months,there has been an improperly disposed refrigerator located on the
side of the open porch which is leaking a hazardous cooling chemical known as freon into the
ground. The doors are still affixed to this appliance and is an alluring attraction for small children
to get into and suffocate.

There are two(2),old,antiquated hot water heater tanks along the side of this porch which have
not been disposed of properly which houses insects and rodents and can easily tip over onto a
small infant.
There is an operational,gas-fired, propane cooking grill on the open porch which is centimeters
away from the wood siding when in use. A fire could easily breakout when operated.
2. BUILDING CODE VIOLATION:
There is a wood deck located on the second level, in the rear of therope
p rty;where children play
and have been seen playing. The balusters on this wood deck"are not"within the town building
code. It has been witnessed that children have been playing in between these wide balusters
located on the second level.
3. HEALTH VIOLATIONS:

j Numerous mice, skunks,opossums, and other rodents are evident on the side of the building due
to uncovered garbage barrels and have appeared to have co-habitated there. There are three(3),
large dogs living in the property. Fecal matter is not disposed of properly and is visual in the yard
which results in a foul,an unpleasant,an unhealthy,and continuous unsanitary odor. Children
play in the yard daily.

The current property owners, Kenneth. &Barbara Clark,reside in Windham,New Hampshire. Their
telephone number is(603)893-4629. It is evident that due to this unsightly view and apparent
violations,Mr. Clark is an absentee landlord. He visits his property on occasion only if repairs are
needed and is visibly and physically aware of these obvious violations.
We take pride and ownership in our income property which abuts Mr.&Mrs. Clark's. Ours is well-
kept and maintained on a"daily"basis. We feel our concerns are valid. And once visited by the North
Andover Community Development and Services Board,we are sure that you will be in complete
agreement with us. We would like all the above issues addressed and resolved. We will expect a

Dear Mr. &Mrs. Clark:
A complaint was received in this office on Tuesday the le on the your referred rental property. The
complaint sited the following:
1. Inappropriate Disposal and Storage of Appliances.
2. Building Code Violation.
3. Health Violations.
My comments after investigation of the above items are:
ITEM#1—Two(2)discarded hot water heaters and a refrigerator with the door still attached were
found on the side of the porch The abandoned refrigerator with the door still on posed a safety problem for
the children of the neighborhood and was in violation of the law. The Division of Public Works in
cooperation with the Fire Prevention Officer and the Building Commissioner,for public safety reasons,
removed both the refrigerator and the two hot water heaters from the site. The removal of remaining debris
is your responsibility. See enclosed photograph
ITEM#2: --The wood rails enclosing the outside perimeters of the first floor porch and the second
floor roof deck do not meet the code requirements of the Massachusetts State Building Code. These
perimeters must have 2"x2"minimum vertical balusters six(6)inches on center in order to prevent children
falling throughet their head caught between the balusters. Once again public safety,please comply to

code immediately. A building permit is required prior to performing the work See enclosed photograph.
