Notice is hereby given that the BOARD OF APPEALS will give a
hearing at the Town Building, North Andover, on Monday evening,
June 11, 1984 at 7: 30 p.m. to all parties interested in the appeal
of DONALD F. AND NANCY A. JOHNSTON requesting a Special Permit
under Section 4 . 121 (7) of the Zoning By Law so as to permit
the construction of a swimming pool beyond the front line of
a dwelling on premises located on the East side of Boston Street
known as 114 Boston Street.

Dear Mr. Long: -
The Board of Appeals held a public hearing on Monday evening,
June 11, 1984. upon the application of Donald and Nancy Johnston..
The hearing was advertised in the North Andover Citizen on May 24
and 31, 1984 and all abutters were notified by regular mail. The
following members were present and voting: Alfred E. Frizelle,
j Vice-Chairman; William J. Sullivan; Augustine W. Nickerson; Walter
Soule; and Maurice S. Foulds
The- petitioners seek a Special Permit under Section 4. 121 (7) of
the Zoning By Law so as to permit the—construction of a swimming--
pool beyond the front line -of - the--dwelling-on premi-ses located= -
at 114 Boston Street.
Mr.- Johnston testified that- the proposed 18' -x 36-' --in=ground—swkmming=-
pool would be set back 73 feet from the front lot line..but would be
beyond the front of his dwelling. The Zoning By Law requires a Special
! Permit from the Board of Appeals to place a pool beyond the front of
I a dwelling.
The petitioners ' lot contains 4 .64 acres , a portion of which is
fenced in for pasture. The - lot contains a barn and work shop in
addition to the dwelling.
No objection was voiced at the hearing and two neighbors were present
to support the petition.

# A motion was made by Mr. Soule and seconded by Mr. Sullivan to grant
the Special Permit subject to thecondition that the front line of
the pool be no closer to the road than the corner of the residence
nearest the pool. The motion failed to carry, with Members Soule
and Sullivan voting in favor and Members Frizelle , Nickerson , and
Foulds voting in opposition.
Pursuant to M.G.L. Chapter 40-A and the North Andover Zoning By Law,
-e.
Section 10 , Paragraph 10 . 4 (2) , the petition is denied.

Sec. 1 APPLICATION FORM --
Every application for action by the Board shall be made on a form
approved by the Board. -Th ese 'forms shall be furnished by the clerk
upon request . Any communication purporting to be an application
shall be treated as mere notice of intention to seek relief until
such time as it is. made on the official application form. All in-
formation called for by the form shall be furnished by the applicant
in the manner therein prescribed.
Every application shall be -submitted with a list of "Parties in
Interest" which list shall _.include the petitioner , abutters., owners
of land directly .opposite -on any public or private street or way ,
and abutters to the -abutters within three hundred feet of the property
line of the petitioner as they appear on the most recent applicabl-e
tax list , notwithstanding that the land of any such owner is located
in another city -or, to-wn,-the--.Planning - Board of the -city or town , and
the Planning Board of every abutting city or town .
* Every application shall be submitted with an application charge cost
