These are the notes from the minutes of the last meeting if you want to call or send him a letter to follow-up. IIl. OLD BUSINESS A. 115 Sherwood Drive—continuation to review items previously requested by the Board of Health of Mr. Canellakis,homeowner,regarding the septic system at his property. Mr. Canellakis was present and distributed copies of information regarding his septic system. Ms. Sawyer reviewed a Title 5 report that was submitted this evening, and it looks okay. Mr. Canellakis states that this is his third time appearing before the Board. His goal is to provide a playroom within the existing footprint of the home, in the basement. Mr. Canellakis states that he was advised that he needed to upgrade the septic system. He provided the Title 5 and a statement of cost to bring the system up to code in terms of the local regulations. He requests a deed restriction on the property that will limit the home to no more than 4 bedrooms. Additional rooms will not be allowed without modification to the septic system. Ms. Sawyer stated that a document needs to be submitted to pursue the deed restriction if that is what the Board of Health decides. In the Town of North Andover,other properties have been granted variances due to physical or other types of constraints,but not financial. Mr.Fixler stated again to the other Board of Health members that they need to be careful in terms of how to determine what is considered a hardship. Ms. Sawyer stated that most people upgrade their septic systems because most people do not want a deed restriction on their property,as it is considered a detriment to the future sale of the property,and a hindrance to future homeowners. The system at 115 Sherwood Drive was initially installed in 2002. Motion: Mr.McCarthy made a motion to accept the deed restriction to limiting the house to a 4 bedroom house. Mr.Pease seconded the motion. Mr.Fixler was opposed. The majority were in favor. Mr.Canellakis's engineer will submit a formal copy of the Title 5 Report to the Health Department. Mr. Canellakis was told that he needs to work out the form and details of the deed restriction with the Health Department staff.
