115 Sherwood Drive—Variance request to allow utilization of the basement space without
the addition of a bedroom
This should really say "without the upgrading of the septic system..."
Background on homeowner additions:
Our usual procedure upon application for increase in flow i.e. adding a room above the number
originally approved by the BOH.
1) Applicant submits the project information—in this case a building permit to finish the
basement.
2) We check the file for review of any conditions.
3) Compare the# of total rooms before the addition to the total after the proposed addition
and as they relate to the approved number of rooms per Title V
4) If the room#is ok we ask for a Title V inspection to be conducted. If passing ok to
approve. If failed, owner must upgrade anyway.
5) Then the project is likely approved in writing and the building dept. is notified.
In the case of 115 Sherwood Drive.
This file review found the original building permit signed by the Health Director, specifically
stated in writing that the basement was not to be finished without the upgrading of the system per
code. The homeowner was told this detail and has requested a hearing to allow a deed restriction
be placed on the property to limit it to 4 bedrooms without the required upgrade of the system.
To approve the concept of allowing the deed restriction many factors should be taken into
account including setting precedence. Currently,there are a few items that may be necessary
before granting this variance outright. The applicant has not given reasons for hardship therefore
I recommend no action or denial depending on the presentation.
1) The applicant should provide an actual floor diagram showing the premise. (I really don't
know how many rooms they have)
2) The applicant should provide a Title V inspection done within the past 5 years to show
the system is in good working order.
3) Other than stating there is a hardship,the applicant should provide details as to how the
upgrading of the system is a true hardship such as; cost estimates for the upgrade or
engineer problems with the site that prohibit expansion without problems.
