'On August 22; 2001; GSE requested that rile cott<tactor IitY UST #4 so titefCSE could observe the condition. of the, groundwater in this vicinity of the disposal site. Although CSE diel not observe LNAPL:on top of the watertable beneath :UST#4, CSE did observe a petroleum sheen in this location. Shortly after this observation an ignition source (Le:; press= washer) ignited petroleum vapors that had accumulated in the excavation causing a `flash' (i.e., vapors caught on fire). The Sash started a fire which burned UST #1, a former gasoline UST located at the disposal site. The North Andover Fire Departnmd (NAFD) responded t0 anis fire. The NAFD watched the fine and allowed the fiberglass UST#1 to bum making sure the other USTs did not also catch fire. Once the fire was under control the NAFD dowsed the remaining fire with some water. A shat while later the contractor removed the remaining portions of the UST and backfilled the excavation at the disposal site. Therefore, the petroleum-cmttamiaated soil or pea stone that was once located above and along the sidewall areas of the removed USTs was placed on the bottom of the former UST grave at a depth of approximately b — 8 feet below the ground surface. Clean fill was then used to fill the remaining space within the UST grave all the way up to the ground surface in the AUL Area However, CSE was unable to observe backfilling of the UST grave, therefore, we have conservatively assumed that petroleinn-contamination still remains doectly beneath the bituminous pavement as if the USTs stiff exist in the AUL Area. The foilowing descriptions of Permitted Activities and Uses, Activities and Uses Inconsistent with the AUL Opinion, and Obligations and Conditions replace and supercede those contained in the Original AUL. Response actions have included (a) Disposal Site Investigation to determine the extent of petroleum contamination (i.e., extent in soil, groundwater, surface water, and sediment) associated with an overfill of one 10,000 fuel/diesel fuel oil underground storage tank (UST) (See Response Action Outcome for further information); and (b) Method 3 Risk Characterization to determine exposure pathways, exposure points, and chemicals of potential concern at the Disposal Site (Sec Risk Characterization for further information). Exhibit B (i.e., Sketch Plan) and the Plait of Land (Registered in Essex County North Registry of Deeds/Lind Registration Office on Plan 13046) shows the portion of the property/Disposal Site area subject to this Activity and Use Limitation, hereinafter referred to as the AUL Area. The investigation detected residual petroleum contaminated soil (PCS), contaminated groundwater, and light non aqueous phase 'liquid of fuel/diesel fuel oil greater than 1/2 inch located around the four USTs. Nevertheless, this contamination remains controlled (i.e., movement is limited) with minimum impact, if any, to the closely adjacent stream. The .Risk Characterization indicates that there is potential for infiltration of petroleum vapors from the AUL Area to any future buildings which could potentially be constructed over the AUL Area in the foreseeable future. Preventing the infiltration of vapors into any future buildings constructed over the AUL Area is essential to maintain a condition of "No Significant Risk" at this portion of the property. Also, construction workers (i.e., working at the AULArea in a trench for a period greater than 30 days) could be at risk (i.e., via inhalation of the petroleum vapors) at the AUL Area. Therefore, the Notice of Activity and Use Limitation requires precautions to preventirestrict exposure to potential petroleum vapors associated with the AUL Area. 1. The following Site Activities and Uses shall be Permitted on the AUL Area: (i) Any and all activities and uses not expressly prohibited under Paragraph 2, below; and (ii) Such other activities and uses which, in the Opinion of an Licensed Site Professional (LSP), shall present no greater risk of harm to health, safety, public welfare, or the environment than the activities and uses set forth in this paragraph. 2. A Brief history follows: On August 27, 1998 at a regularly scheduled meeting an application was approved for the installation of a tight tank for this site conditioned on the approval of D.E.P. D.E.P. approved the application for a tight tank on October 14, 1998. Shortly after this approval was granted sewer was installed on route 114 passing in front of my property. This was a forced line. I had been given permission to tie into the sewer when the line was brought to the new development on Boston Hill. I waited hoping to tie into sewer. The Boston Hill development has been stalled for years. We have been pumping our tank every two -three weeks and see no sign of above ground seepage. I again inquired in July with the DPW as to when sewer would be available and was told that realistically it would be at least a couple of years. I then asked my contractor to proceed with the installation of the tight tank. The permit was not granted because the approval was more than two years old. The testing was performed on May 26, 1998 and witnessed by Susan Ford from your office. Our testing did not yield a suitable location on the site for the installation of a new soil adsorption system. The testing was limited to the east side of the existing building. (See the attached sketch for test pit locations) Our site investigation did not yield any alternate locations for testing due to presence of high groundwater, ledge and bordering vegetated wetlands on the remainder of the property. Currently, there is a proposed sewer force main along Route 114 being reviewed by the State for the adjacent property to the south. We intend to connect to this sewer and would like to propose using tight tanks to store effluent in the interim. Tight tanks would be designed in accordance with 310 CMR 15.260, pumped on a regular basis and would be discontinued from use within 30 days after a sewer connection was available. An Innovative Alternative system was not considered feasible since the percolation rate was greater than 90 min./in. We are requesting your recommendation for our proposed solution. If tight tanks are an acceptable course of action please let us know so that we may proceed with design plans. We would then submit the tight tank design plans for your review and approval. As required by Title 5 we will be submitting to DEP for a variance for use of tight tanks after we receive your approval. Please contact me at your earliest convenience to discuss this project. The DEP received a report entitled 21-E Site Assessment, dated June, 1990, and prepared by Andover Environmental Associates, Inc., which indicates that a release of diesel fuel occurred at the subject property. The term "release" refers to both a recent, sudden spill of oil and/or hazardous material or "historical" oil and/or hazardous material contamination that is identified through some level of investigation. Based upon the information available, the Department has reason to believe that the subject property or portion(s) thereof is a disposal site as defined in the Massachusetts Oil and Hazardous Material Release Prevention and Response Act, M.G.L. c. 21E, and the Massachusetts Contingency Plan, 310 CMR 40.0000 (the MCP) and that all the.necessary and required response actions have not been taken such that a level of No Significant Risk exists or has been achieved in compliance with M.G.L. c. 21E and the MCP. For purposes of this notice, the terms and phrases used herein shall have the meaning ascribed to them by the MCP unless the text clearly indicates otherwise. STATUTORY LIABILITIES The following is provided to advise you of your statutory liabilities for completing response actions at the subject site. It is a summary of the liability provisions from M.G.L. c. 21E. Please refer to the statute for a complete description of the liability provisions. This liability is "strict", meaning it is not based on fault, but solely on your status as an owner, operator, generator, transporter or disposer. It is also joint and several, meaning that you may be liable for all response action costs incurred at the site, regardless of the existence of any other liable parties. The MCP requires responsible parties to take necessary response actions at properties where there is or has been a release or threat of release of oil and/or hazardous material. If you do not take the necessary response actions, or fail to perform them in an appropriate and timely manner, the Department is authorized by M.G.L. c. 21E to have the work performed by its contractors. You may be liable for up to three (3) times all response action costs incurred by the Department. Response action costs include, without limitation, the cost of direct hours spent by Department employees arranging for response actions or overseeing work performed by persons other than the Department or their contractors, expenses incurred by the Department in support of those direct hours, and payments to the Department's contractors. (For more detail on cost liability, see 310 CMR 40.1200.) The Department may also assess interest on costs incurred at the rate of twelve percent (12%), compounded annually. To secure payment of this debt, the Commonwealth may place liens on all of your property in the Commonwealth. To recover the debt, the Commonwealth may foreclose on these liens or the Attorney General may bring legal action against you. Information available to the Department indicates that all of the response actions necessary to achieve a level of No Significant Risk at the subject site were not taken and/or completed as of October 1, 1993. Therefore, additional response actions must now be conducted in accordance with M.G.L. c. 21E and the revised MCP, 310 CMR 40.0000. The MCP allows the Department to establish and enforce reasonable Interim Deadlines consistent with M.G.L. c. 21E in order to establish timeframes for responsible parties to perform response actions at disposal sites for which notification of a release/ threat of release was received prior to October 1, 1993, and for which additional response actions pursuant to the MCP are required after October 1, 1993. In light of this, you are hereby notified that, at a minimum, the necessary response actions at the subject site must be conducted within the following Interim Deadlines: (1.) Property located at 1175 Turnpike Street (Map 107c Lot 12). We are proposing to utilize a tight tank to store effluent for the site for the following reasons: 1. The existing system is currently in failure. 2. Lack of suitable soils on-site, official and unofficial soil testing (see attached) did not yield an area suitable for construction of a soil absorption area. 3. Percolation rates were greater than 90 min/in, therefore an Innovative/Alternative system was not considered a feasible option. 4. Currently, there is a proposed sewer force main along Route 114 being reviewed by the State. If sewer were to become available the owner would discontinue use of the tight tank and connect to the sewer within 30 days in accordance with 310 CMR 15.260(5) The minimum required storage volume is 6,500 gallons based on the design flow which was determined to be 1298 gal/day. The design flow was calculated using 150 gal/day for each service bay and 75 gal/day per 1,000 square feet of office space in accordance with Title 5. We expect the actual flow to be significantly lower than the design flow which will allow for less frequent pumping than the required 5 day minimum storage. The proposed tank will be installed in front of the existing building, will be accessible 24 hours per day and will have a visual and audible alarm to prevent overfilling. We have also enclosed a draft copy of the Operation & Maintenance Plan and a letter from Currier Septic & Drain regarding a contract to dispose of waste from the site. In accordance with 310 CMR 15.260 we are seeking local approval of the design. Once we have the local approval we will be submitting to MDEP for the required approval (BRP WP 64a) to install a tight tank.
