Said AUL Opinion replaces and supersedes any AUL Opinion contained or referenced in the Original AUL. Site Activities and Uses The following descriptions of Permitted Activities and Uses, Activities and Uses Inconsistent with the AUL Opinion, and Obligations and Conditions replace and supersede those contained in the Original AUL. I - Permitted Activities AW Uses. During`the ;initial investigation and price m filing the RAO; LNAPL,Iess thmt''h„'was observed in monitoring wells MW3 at ” MW4: " Figure 2` in Appeaf><lix B of the "RAO shows die"former locations of'moniboring wells MW3" and MW4, which' also 3` -happen .to be where UST1#4,was -located. On "August 22,. 2001, -CSE requested that rite contractor lift`UST #4 so that CSE'' could observe the uxn clition of groundwaoer in this vicinity of the disposal site. Although CSE did not observe LNAPL on top of the water table beneath UST#4, CSE did observe a petroleum sheen in this location. Shortly after this observation an ignition source (iv- pre%utre washer) ignited petroleum vapors that had accumulated in the excavation causing a `flash' (i.e., vapors caught on fire}. The Rash started a fire which burned UST #l, a former gasoline UST located at the disposal site. The North Andover Fire Department (NAFD) responded to this fire. The NAFD watched the fire and allowed the fiberglass UST#1 to burn making sire the other USTs did not also catch fire. Once the fire was under control the NAFD dowsed the remaining fire with some water. A short while later the contractor removed the remaining portions of the UST and backfilled the excavation at the disposal site. Therefore, the petroleuun-contaminated soil or pea stow that was once located above and along the sidewall areas of the removed USTs was placed on the bottom of the former UST grave at a depth of approximately 6 - 8 feet below the Found surface. Clean fill was then used to fill the rertaining space within the UST grave all the way tip to the ground surface in the AUL Area However, CSE was unable to observe: backfilling of the UST grave, therefore, we have conservatively assumed that petroleum -contamination still remains directly beneath the bituminous pavement as if the USTs spill wag in the AUL Area. The following descriptions of Permitted Activities and Uses, Activities and Uses Inconsistent with the AUL Opinion, and Obligations and Conditions replace and supercede those contained in the Original AUL. A condition ofNo Significant Risk to health, safety, public welfare or the environment exists for any foreseeable period of time so long as any of the following activities and uses occur within the AUL Arta: i) Activities and uses including, but not limited to, vehicular parking, pedestrian and vehicular traffic which do not compromise the structural integrity of the pavement and/or petroleum conte soil and groundwater located beneath the pavement; ii) Small cracks through the bituminous pavement are allowed as long the soil and groundwater beneath the pavement is not accessible or allows for direct contract with soil and grosundwater; iii) Excavation associated with emergency or short tern (30 days or lass) underground utility and/or constiuc ion work, :provided it is conducted in accordance with a Sod and Groundwater Management Plan and a Health andSafetyPlatt in accordance with Obligations (i) and (ii) of this Notice; iv) Activities ,and:uses;which am:hot identified by this Notice as being inconsistent with maintaining.a conditiorr�of No.Significant Risk; and Activities and uses not expressly prohibited by this notice of AUL; and v):� .
