The North Andover Board of Appeals held a public hearing at its regular meeting on Tuesday,April 14,2009,at 7:30
PM in the Town Hall top floor meeting room, 120 Main Street,North Andover,MA upon the application of Bonny
Realty Trust,Amy F. Constantino,Trustee,70 Pine Ridge Road,North Andover for premises at: 12 Bonny Lane
(Map 62,Parcel 41),North Andover requesting that decision 2007-013 be modified in order to allow the proposed
single family dwelling to be moved slightly closer to Bonny Lane. Said premise affected is property with frontage on
the East side of Bormy Lane within the R-1 zoning district.
The following voting members were present: Ellen P.McIntyre,Joseph D.LaGrasse,Richard J.Byers,Albert P.
Manzi,III,and Richard M.Vaillancourt. The following non-voting members were present: Thomas D.Ippolito,
Daniel S.Braese,and Michael P.Liporto.
Upon a motion by Richard J.Byers and 2nd by Richard M Vaillancourt,the Board found that the request to re-locate
the proposed single family dwelling closer to the front lot line rather than the 2007-013 Variance decision's Site Plan
location is a minor modification and that this modification does not alter the intention of Variance decision 2007-013.
Voting in favor: Ellen P.McIntyre,Joseph D.LaGrasse,Richard J.Byers,Albert P.Manzi III,and Richard M.
Vaillancourt.
Upon a motion by Joseph D.LaGrasse and 2nd by Ellen P.McIntyre,the Board voted to GRANT Bonny Realty
Trust's request to modify Variance 2007-013 to locate the single family dwelling closer to the front lot line than the
setback shown on the 2007 Site Plan.
1. The modified Site Plan dated 3/17/09 herein referenced shall be recorded at the Essex North registry
of Deeds and filed with the Board of Appeals.
In all other respects,the originaldecision remains in full force and effect as modified hereby r:
