Starr, Health Re: Beaver complaint at 12 Carriage Chase Please be advised that on May 16, 2002, acting on a complaint, an inspection of beaver activity at 12 Carriage Chase was performed by Board of Health staff. It was determined that there IS a public health threat at the site from the beaver dam located downstream of the culvert under the road. The dam is located on Town property. At the time of the inspection there was sufficient water flowing over the dam to prevent immediate flooding; the issue revolves around the need to maintain the water flow. A representative from DPW should come to the Health Department office and complete an application for a ten-da r pp y emergency permit to address the problem with Conservation guidance. Elias, President, North Andover Country Club Dear Sirs, I again want to update you on the situation at 12 Carriage Chase. First, I can report that we had not noticed any joy-riders or unusual activity since my last letter up until someone drove around our circle yesterday afternoon. Whether this unusually long period without trouble can be attributed to my sign or simply to luck is hard to know but I am pleased to say that we had no one driving over our bridge and disturbing us for weeks, the longest such period that I can remember. Second, I want to thank you all for our help in this matter to date. The last I knew Y Y p was that Mr. Elias and I had a very productive meeting and he borrowed my map to present the matter to a meeting of the Board of the North Andover Country Club. I have not heard from him or of any results from that meeting. Mr. Nicetta called me around the end of May and said that he was still working on the issue. Third, I am going to be away from North Andover for the majority of the summer. Your best bet to reach me, should there be anything that cannot wait for my return, is at my Nantucket address or phone number above. Elias, President, North Andover Country Club Dear Sirs, It has been almost half a year since I last wrote to you about vandalism, privacy and property rights at my home at 12 Carriage Chase. I wanted to again update you on the situation, make a few observations, and ask that we work together a bit more on a permanent solution - our mutual goal, I'm sure. ,.First,:1:can.report tliat:we did:got notice-any"problenis��over,the-summer-and-vt-had::,- . not noticed-anyone driving up our dr iveway�urinvited until Noon 10/24/99 when a Honda Accord, Mass. plate 142-LLE, was parked.directly in the middle of the `right of way',. still on my property but off the pavement of the driveway. I left a j polite message on my card on their windshield saying, as best I can recall, "You are parked on my land. Please read the sign at the start of my driveway. Walkers are welcome. Paul Stewart". The car was gone the next time I drove by. I'm not - ot sure whether to ascribe this reduction in �o riders to sign or � y y gn to luck but I am pleased with the result in any case. The text of the `right of way' statement in my deed reads: A right of way to the Inhabitants of the Town of North Andover and to the North Andover Country Club Corp., its successors and assigns for the right to use a 50' wide right of way for all purposes for which rights of way are presently used in the Town of North Andover over Purgatory Lane across the Northerly portion of Lot A as shown on Plan No. 9984; see Deed recorded with the Registry at Book 2049, Page 178; A copy of part of Plan No. 9984 is attached. It shows a double squiggly dotted line labeled "existing right of way" possibly representing Purgatory Lane or the 'right of way' across part of my land. RECEIVED NOV IR1999 BUILDING DEPT. {,`�. r' ' ' 'v � Page 2 of I had a surveyor, Mr. Scott Giles, come and survey and stake my property and confirm that the stone wall running along North of my driveway is actually my boundary. I then took a 50' tape measure and measured the distance from the stone wall to my driveway. I found several places where the squiggly lines touch the boundary and it is more than 50' from the stone wall to the closest part of my driveway. In short, I observe that the cleared and paved area of my driveway corresponds neither to the `right of way' word description nor to the squiggly lines on Plan No. 9984. There is clearly a `right of way' and there is clearly my paved driveway but they are not in the same place along their length. I also observe that the stone wall and therefore the `right of way' appears to lie within 100' of the wetlands close to my driveway in some places. I understand that Mr. Nicetta also told Mr. Elias that the North Andover Country Club (NACC)'s `right of way' was unusable to pass over my property to the NACC due to the wetlands and stream that cut across it closer to the country club. Further, I have followed the path labeled existing right of way on Plan No. 9984 which is clear in the woods departing from my property by the bridge and proceeding as shown on the Plan. This path crosses a stream as it nears the NACC and forks. One leg is blocked by trees and debris presumably from the NACC and leads right onto the golf course. The other leg proceeds up over the hills skirting the golf course, across at least one more stream, and eventually to Dale Street. At Dale Street there is a locked gate blocking the path and a "No Tresspassing" sign. As for "Purgatory Lane" I happened to be at Smolak' F h s arm the other da and I g rY � PP Y was looking at his big public map of his farm beside his store. I noticed Purgatory Lane is labeled on his map as being on the opposite side of Dale Street. I went across Dale Street and saw a sign saying `Purgatory Lane' pointing down a dirt road with a gate across it. It seems that the `right of way' across my property bars me from gating my driveway but does not affect others from gating or blocking their parts of the same path or lane. Further, I wonder if the same `right of way to the Inhabitants of the Town of North Andover and to the North Andover Country Club' which allows people to use m driveway is reciprocal and would allow me to drive through the Y Y P gh woods to either the NACC or to Dale Street (and possibly to go further to Purgatory Lane by Smolak's)? .:_ � . .. - � .. 3 ,: ". � '. �, _ . . � � _ , .. . , .. - > �. • �, Pa e 3 of Well, these are the issues before us: 1. I've had serious trouble, as described in previous letters, with people using my driveway, trouble which has abated somewhat but which is still a worry to me. 2. There is a `right of way' described in my deed that prevents me from taking some of the steps I might otherwise take to protect myself from this trouble. 3. I see that the `right of way' described in words in my deed and pictured on Plan No. 9984 is not the same as my driveway. 4. I see that the `right of way' is blocked by many large trees on my property within 100' of wetlands such that no vehicular passage is currently possible. 5. 1 see that the `right of way' and Purgatory Lane are both blocked and gated off in many places and are no longer a passable `right of way to the Inhabitants of the Town of North Andover' for any length in either direction other than on the parts of my property where the `right of way' and my driveway happen to coincide. I believe that the Town, the NACC, and I should work out a binding written understanding of the reality of this particular `right of way' and the mutual rights and responsibilities of each party therein. I am open to suggestions for a solution but I am not willing to leave things as they are. My suggestion for a solution is that we all agree to legally dissolve the useless and impassable `right of way' in my deed and rely on normal neighborliness and town/citizen relations to allow passage when and if necessary over my driveway. The reason I kept it this long is that I was waiting to bear from you as to the direction you wish the easement matter to go. You may recall that I told you that I would bring this matter to the attention of the Board of Governors of the North Andover Country Club on an informational basis only and that no action could or would be taken until such time as I had heard from you as to what exactly you wanted the Club to do. I informed the Governors of this matter and of the meeting I had with you; I told them we would wait until we heard from you. The consensus was that the Club would like to cooperate with a neighbor, but no specific request was yet on the table. It appears that this condition still pertains. Elias4 , President, North Andover Country Club APOf, 130 O N i cn i ne Dear Sirs, 6661 A'GW I just wanted to update you on the situation at 12 Carriage Chase. uring the past few days I have had several "joy-riders" and two visitors the likes of which I had not seen before. I have also put up a homemade sign on my gate (see last page). The gate has remained open. 5/12/99 9:47AM black "king cab" pickup truck sounded the bridge alarm and drove up to my house. In addition to the driver there were a couple of workers in the extra seat seat. The truck turned around and drove away. My wife was still asleep, having been working late the night before, and the alarm woke her up. 5/15/99 in the afternoon a red convertible with license plates "KATWMN" sounded the bridge alarm, drove up to my house, turned around, and drove away. 5/19/99 at around Noon I was working on dismantling the beaver dam down-river from my bridge (I hold an up-to-date permit to keep that area of river clear of beaver dams which I am happy to display to anyone who is interested). I was clearing the dam closest to my house when a man walked up and introduced himself as "Jim" or "John" (as best as I can recall, I was startled to have someone j approach me and I was a bit wary at the time). Pointing to the dam I was dismantling he expressed his hatred of beavers and asked how I felt about them. I said I love the animals but dislike the result of their new dams. He said, "Too bad someone doesn't just get them with a .22". I said I understood that that was not allowed at this time. He asked how the neighbors near the dam felt about the darn beavers and I said that most neighbors in the direction he was indicating were uphill and were not affected much. He mentioned that Jim Rice was having a really terrible time with beavers flooding his house and I agreed that I had heard that, too. He asked about my taking down the dam and I said that Mr. David Rand had gotten me a permit. He said "Too bad Rand got the authorities involved". At that point we walked upstream 30 yards to the site of the other dam I keep clear. On the way he expressed disgust for a "Town Forest" sign on a tree nearby. When Page 2 of 4 we got to the second dam I was surprised to see another man breaking up that dam with a shovel. I could also look up to my driveway and see a black full-sized pick- up truck parked on the bridge. "Jim" introduced me to George (I'm sure because "Jim" kept referring to him that way) and said, "We'll help you with this" (breaking up the dam). Both "Jim" and George worked on hauling out sticks from that dam. After a few minutes of working on this dam (it is small, a few dozen sticks at any given time), "Jim" said, "Well, we'll just come by and help you with these dams every once in a while. At that point, I had had enough of these strange men. I said, No, I don't need any help. It is illegal for anyone to break up these dams without a permit. Further, you have driven up my driveway and parked on my private property. I have already contacted the police about people driving up my driveway and doing illegal things". "Jim" said, pointing at some of my neighbors, "Isn't this a `common drive'?" and I said, "No, this entire driveway is my private property and, as I have said, I have already spoken to the police about watching for people driving up here to do illegal things". At that point, the two guys put their shovel in the back of the truck and left. I finished up with the dam and went back to my house to clean up. Later in the day I was walking down my driveway and I happened to notice that the large dam upstream of my bridge had been disturbed. I walked over and could see where two places had been dug down about a foot deep through the dam (the dam is 4 feet high and 6 feet thick and has since been repaired by the beavers so no permanent harm was done). My assumption is that the two guys first worked on that dam and then moved to the ones downstream where they found me. 5/22/99 3PM the bridge alarm went off and the red convertible drove up with the KATWMN plates, the same one as a week ago. The car drove up to my house and started to turn around. Expecting a friend, I walked out. I noticed the same license plate and walked over to talk to the driver. There were two women in the car. I said, "I noticed that you drove up here last week and now you have driven up again." The driver said, "Yes, I just drive by the swamp." I said, "Well, this is private property and I have a sign about that at the entrance." The driver said, "Oh, I didn't see any sign and we're just bird-watching." I said, "Well, I would like you to leave your car on the street and walk down the driveway if you wish. You are welcome to birdwatch but this is my driveway and this is private property." They looked upset and drove away. Note that in this case this same driver had driven up my driveway RIGHT TO MY HOUSE the week before and now she chose to do it again. She could have turned around somewhere along the driveway but she chose to drive all the way up to my house again (and have me happen to notice her a second time). i Page 3 of 4 I felt bad for the rest of the day that I had had acted so coldly towards these women who were just out enjoying nature, an activity my whole family enjoys as well. If others didn't do illegal things on the driveway and if these women were less intrusive then I would like them enjoying nature around my property. 5/22/99 8:30PM a silverish sedan with a few college-aged kids peering out the windows set off the bridge alarm and drove up by my house. They quickly turned around and drove away. 5/22/99 10:45PM the bridge alarm went off once. I walked out to see who was there and there was no one either by the bridge or anywhere on the driveway. I assume someone drove up and turned around by the bridge and drove away. So, some vandalism, some joy-riders, and some nice bird-watchers whose day (and mine) was ruined. Not great ways to derive quiet enjoyment of my property but certainly demonstrative of the problem we face. No recent incidents of littering or other bad behavior. Thanks to you all for your active interest in finding a solution. I am currently operating as follows: 1. If anyone stays on my driveway long enough so I think that it will be effective, I will call the police. 2. If anyone drives up to my house and I am fast enough, I will speak to them. 3. I have the sign up on the gate but the gate remains open. 4. I'm waiting to hear from Messrs. Nicetta and Elias on suggestions for solutions (once we have some suggestions on the table then perhaps we should meet to work things out and do whatever paperwork is necessary?). Let's hope the current trend (3 alarms on Saturday) abates! I have one question for you all: when my deed says, "right of way for all purposes for which rights of way presently may be used in North Andover over Purgatory Lane", what exactly does that mean? Is there a town document that details what that means? Does it mean that you could build a building on the right-of-way? Does it mean that passing over is OK but parking is not? Does it mean that heavy driveway-crushing trucks are allowed passage at any time? Where does it say what this means? Just wondering. Thanks again! Sinc ely, Paul P. Mr. Nicetta told me that you had written as well to the North Andover Country Club. I am President of the Club and was looking for the letter over the past several weeks. It did not arrive at the Club. I took a ride to your house recently to obtain your name so that we could talk about your problem and how the Club could help resolve it. I left my card with your son. Not having heard from you, I asked Mr. Nicetta to forward a copy of your letter to me, which he did. That is how I was able to identify your name and obtain your e-mail number. You make reference to an easement which the Club has over your land or your driveway. What I'd like to do is to set a time and date convenient to you to meet to review the matter. Officer Patnaude stopped by to talk with Lora last Friday and an officer on a motorcycle stopped by to chat with me on Saturday evening. In addition, Mr. Robert Nicetta, North Andover Building Commissioner, has contacted and visited with us to offer his assistance and has kept us informed of his efforts on our behalf. I We very much appreciate your help in this matter. We have felt somewhat powerless to do anything about the problems outlined in my letter of the 26th because of the easement issue and because many of the problems occur in the part of the driveway away from our house, the part possibly affected by the easement. I i . very much appreciate your offer to help manage the improper behavior there. Let me tell you that there is a magnetic sensor on the driveway at the stone bridge close to our house. That sensor sounds a buzzer in our house when a car or motorcycle drives over the bridge. This is how we know that someone is driving up to our house and gives us about 20 seconds to come to the front of the house to see the car drive up. Part of the problem from our point of view is a joy-rider coming over the bridge at I IPM or midnight will ring the buzzer and light up our I house with their headlights and wake everyone up with a start.
