Obligations _ and Conditions Set Forth in the AUL Opinion. If applicable, obligations and/or conditions to be undertaken and/or maintained at the Property to maintain a condition of No Significant Risk as set forth in the AUL Opinion shall include the following: (i) A Soil Management Plan("Plan") must be prepared by an LSP prior to the commencement of an activity that is likely to disturb soil located greater than 8 feet below ground surface. The Plan should describe appropriate soil management, characterization, storage, transport, and disposal,procedures in Workers who may come in contact with the soil should be appropriately trained on the requirements of the Plan, and the Plan must remain available on-site throughout the course of the project; tJ (ii) A Health and Safety Plan("Plan") must be prepared and implemented prior to the commencement of an activity that may result in the disturbance of soil located greater than 8 feet below ground surface. The Plan should be prepared by a Certified Industrial Hygienist or other qualified individual appropriately trained in worker health and safety procedures and requirements. The Plan should specify the type of personal protection, engineering controls, and environmental monitoring necessary to prevent worker and other potential receptor exposures to soil through ingestion, dermal contact, and inhalation. Workers who may come in contact with the soil should be appropriately trained on the requirements of the Plan, and the Plan must remain available on-site throughout the course of the project; and (iii) The soil located greater than 8 feet below ground surface, Elevation 29.00 feet,must remain at depth and may not be relocated,unless such activity is first evaluated by an LSP who renders an Opinion which states that such activity poses no greater risk of harm to health, safety,public welfare, or the environment and ensure that a condition of No Significant Risk is maintained. 4. Proposed Changes in Activities and Uses. Any proposed changes in activities and uses at the Property which may result in higher levels of exposure to oil and/or hazardous material than currently exist shall be evaluated by an LSP who shall render an Opinion, in accordance with 310 CMR 40.1080 et seq., as to whether the proposed changes will present a significant risk of harm to health, safety,public welfare or the environment. Any and all requirements set forth in the Opinion to meet the objective of this Notice shall be satisfied before any such activity or use is commenced. 5. Violation of a Response Action Outcome. This'Opinion,provides'a brief description and history of the site: In addition,the permitted activities and uses at the site as derived from a Wthod'3 Risk Assessment considering both current and future risk,as well as the associated obligations and conditions,are discussed. j 1.0 Site Description The Mobil5tation is located on a 21,600 square foot property in a commercially zoned area of North Andover. A site locus plan is included as Figure 1. The-site-currently consists of four dispenser islands and a one-story concrete block building,which houses a convenience store. There are two entrances to the property on the south side site on Massachusetts Avenue. Currently,there are gasoline underground storage tanks (UST)located on the southeast portion of the site and one used oil UST. The majority of the site is paved,with landscaped areas along:the.southern,western,and eastern portions of the site. The land area located to the north/northeast-of the station building is covered with gravel. The station is served by underground natural gas,telephone lines andmurucipal water and sanitary sewer,and overhead electric lines. There is one storm/sewer catch basin located downgradient of the site,on Massachusetts Avenue. 2.0 Site History According.to the North Andover Town Clerk's office,Mr.John Cahill owned the property from 1943 to 1962. In 1962,the site was purchased by Union011 Company and operated as an active gasoline/diesel fuel station: Mobil-purchased'tl e-site from Union Oil Company in 1967 and continued its operation as an active fuel station. The Town of North Andover records indicate that as of 1962,the site was pormitted to store up to 16,000 gallons of gasoline underground. In 1973,the permit was upgraded to n allow storage of an additional 4,000 gallons of gasoline. �-+ Im1983,three gasoline underground storage tanks (UST)were installed. In`5eptember 1990, one 550-gallon steel used oil UST and one 550-gallon steel-fuel oil UST were removed from the site. At this time,a new 1;000-gallon fiberglass used oil tank was installed. During the construction activities,the gasoline USTs on-site at that time were replaced with the current USTs (one 10,000-gallon,one 8,000-gallon,and 6,000-gallon tank). Soil samples were collected from the location of the a tank pits and contained detectable levels of total petroleum hydrocarbons (TPH). The condition was reported to the Massachusetts Department of Environmental Protection a (MADEP) and in response,the site was listed as a Confirmed Disposal Site on July 15, 1990,and assigned site number 3-3246. On April 15,1993,a Waiver of Approvals was granted to Mobil by the MADEP for the site. Upon Mobil's acceptance of the Waiver of DApprovals,and the site was classified as a'Pier H site. This classification became effective on April 15,1993. The waiver expired on April 15,1998,and Tier II extension n requests have been submitted annually to the MADEP since that time. In October 1996,Mobil rebuilt the station,which included the installation of a new foundation for the service station building and closure of a.Metropolitan District Commission(MDC) trap. In February 2002,after a thorough review of the project files,CDM discovered that during previous drilling activities conducted by Groundwater and Environmental Services, Inc. (GES) on June 5,2000,there were concentrations in exceedence of RCS-2 standards for Polynuclear Hydrocarbons (PAHs) in the soil samples collected. CDM reported this condition to the MADEP. On April 2,2002,the MADEP issued a Notice of Responsibility to Mobil and assigned RTN 3-21527 to the site for this release. 3.0 Site Investigations In September 1990, IT completed a Phase I Limited Investigation. During this investigation,petroleum impacted soil was encountered in the tank pit of the excavated USTs. IT subsequently supervised the installation of three groundwater-monitoring wells (OW-1,OW-2,and OW-3). During the investigation,two existing monitoring wells (MW-1 and MW-2)were encountered on the site. Groundwater samples have been collected from wells OW-1,OW-2,OW-3,MW-1,and MW-2(Figure 2) and the asamples have been analyzed for volatile petroleum hydrocarbons (VPH) since 1990. In January 1995,five Geoprobe borings (GP-1 through GP-5)were advanced at the site D (Figure 2). Soil samples were collected and analyzed for petroleum constituents. In the fall of 1996,the Mobil Station was renovated. During the reconstruction activities,a new building foundation was installed and a Metropolitan District Commission(MDC) n grease trap,a fuel oil UST,and a used oil UST were closed. Soil samples collected from Uthe excavation for the new foundation and the MDC were screened using a photoionization detector (PID). PID readings were below instrument detection limits of 1 ppm, therefore,no samples were submitted to the laboratory for analysis. a Approximately 60 cubic yards of soil associated with the excavation,installation of all monitoring wells,and the removal of the MDC grease trap,were removed from the site. Soil samples were collected from the boreholes and submitted to the laboratory for VPH and extractable petroleum hydrocarbons (EPH) analysis. GES installed groundwater monitoring wells in boreholes GES-1 and GES-2. From January through June 2000,GES initiated Phase II activities and advanced nine a additional soil borings (SB-2,SB-3,SB-4,GES-3 through GES-8) on the site and in Massachusetts Avenue (Figure 2). Monitoring wells were installed in boreholes GES-3 through GES-8. Groundwater sampling and gauging of wells MW-1,OW-3,GES-1 through GES-8 have been conducted at the site since March 1998. The samples have been analyzed for VPH and EPH. aDuring the October 2001 sampling event,groundwater samples collected from wells GES-2,GES-3,and GES-6 were analyzed for lead due to their location in the vicinity of aformer used oil tanks. In April 2002,CDM installed two additional groundwater-monitoring wells (CDM-1 and a CDM-2) on the adjacent property located at 30 Massachusetts Avenue,North Andover (Figure 2). Soil samples were collected from the boreholes,field screened using the PID, and submitted to the laboratory for VPH and EPH analysis. Groundwater samples were a collected from wells CDM-1 and CDM-2 during sampling events in May,August,and November 2002,and February 2003. n In September 2002,CDM submitted the Phase II CSA to the MADEP. This CSA u addressed both RTN 3-3266 and 3-21527. a In December 2002,CDM advanced nine additional soil borings(CDM-SB-3 through CDM-SB-11) on the northern portion of the Mobil property (Figure 2). These borings were advanced and soil samples collected for EPH analysis. This investigation was a conducted to determine the extent of impact from the PAH Upper Concentration Limit (UCL) standard exceedence located in the vicinity of well GES-4. D4.0 Reason for Activity and Use Limitation A Method 3 Risk characterization was completed to characterize human health risks posed by the organic and inorganic materials impacting soil and groundwater samples Q collected during Phase II field investigations. A"hot spot" appeared in the vicinity of well GES-4,as the concentration of benzo(b)fluoranthene detected at this location at a a depth of 10 to 12 feet below ground surface was in exceedence of the UCL established by the MADEP. Recent investigations conducted in December 2002 confirmed the presence of PAHs in the subsurface. The most recent field investigation in the vicinity of this well indicated that PAHs do exist in that area,however,the UCL exceedence is an isolated sample. Since the soil in the "hot spot" is located beneath the asphalt pavement and is considered inaccessible,the soil category is considered to be S-3. The risk assessment a Q a aconcluded that a significant risk is associated with the residential scenario for soil in the "hot spot" area. The AUL will be necessary for soils at the site to prevent residential use Qof the property unless the soil is remediated. 5.0 Permitted Activities and Uses i. Commercial and/or industrial uses and activities associated therewith, including,but not limited to,pedestrian and/or vehicular traffic,landscaping and routine maintenance of landscaped areas,which do not cause and/or result in the disturbance and/or relocation of soil located greater than 8 feet below ground surface,Elevation 29.00 feet; aii. Short-term(three months or less)underground utility and/or construction activities including but not limited to,excavation(including emergency repair of n underground utility lines),which are likely to disturb soil located greater than 8 feet Ubelow ground surface,provided that such activities are conducted in accordance with Obligations/Condition(i)and (ii) in Section 7 of this Activity and Use a Limitation Opinion("Opinion'),the soil management procedures of the Massachusetts Contingency Plan (MCP) cite at 310 CMR 40.0030, and all applicable worker health and safety practices pursuant to 310 CMR 40.0018; iii. The application was submitted by Ms. Monique Hawkins, Mobil Oil Corp. , One Technology Park Drive, Westford, MA 01886. The Massachusetts Contingency Plan (310 CMR 40. 00, the "MCP".) establishes procedures for assessing and cleaning up sites where there has been.'-,a release of -oil or hazardous materials. The MCP.requires .that six specific reports be submitted to the Department during the response action process. The Department must approve each of he reports before the next phase -of work can be conducted (310 CMR 40. 536) . The MCP also allows those condu ting response actions at NON-PRIORITY DISPOSAL SITES to apply to the Department for a waiver of required approvals (310 CMR 40. 537) . When a waiver is granted, remedial response actions mist still meet all the requirements of M.G.L. c. 21E and tha MCP, including submittal of documents to the Department. Howeve , no Department approvals of reports, plans, or other documents we' ll be required as long as the waiver remains in effect. A waiver of approvals will expe ite the performance of a remedial response action. At this time, the Department is focussing its limited resources on t e disposal sites which present the greatest and most immediate threats to public health and the environment. These are generally sites classified as PRIORITY, based on specific criteria in the MCP (310 CMR 40. 544) . At non-priority sites, contamination does not currently threaten public health or the environment, bu�, may at some time in the future if no action is taken. Simons yes 2 12 Massachusetts Avenue (Mobil Oil) Site Plan Review- Special Permit The Planning Board herein approves the Special Permit/Site Plan Review for the construction of a 1200 sq. ft. one story building to be used as a convenience store located in the General Business Zoning District. The existing service bays of the,service station will be removed. This Special Permit was requested by Mobil Oil Corporation c/o Tyree Engineering; 9 Otis Street, Westborough, MA 01581. This application was filed with the Planning Office on July 29, 1996. The Planning Board makes the following findings as required by the Zoning Bylaw Section 8.3 and 10.3: FINDLNGS OF FACT: 1. The specific site is an appropriate`location`for-the project as it is zoned for general business and is currently the site of a service station. 2. The use, as developed, will not adversely affect the neighborhood as sufficient buffer zones have been created to shield the use from adjacent properties. 3. There will be no nuisance or serious hazard to vehicles or pedestrians; 4.' The landscaping plan approved as a partof-this plan meets the requirements of Section 8.4 of the Zoning Bylaw with review by the Planning Board; 5. The site drainage system is designed in accordance with the Town Bylaw requirements subject to the conditions of this decision; 6. The applicant has met the requirements of the Town for Site Plan Review as stated in Section, 8:3 of the Zoning Bylaw; 7. Adequate and appropriate facilities will be provided for the proper operation of the proposed use. Finally, the Planning Board finds that this project generally complies with the Town of North Andover Zoning Bylaw requirements as listed in Section 8:35 but requires conditions in order to be fully in compliance. INTRODUCTION This report provides an analysis of the existing and proposed site drainage associated with the re-development of a Mobil Oil gas station and convenience store. The study establishes and compares pre- and post- development peak rates of storm runoff for the 10, 25 and 100-year design storms. Drainage impacts of the proposed development and measures to mitigate any adverse environmental affects are addressed in this report. 2. METHODOLOGY This report examines the site under existing and proposed conditions for the 10, 25 and 100-year storm events. TR-55, Urban Hydrology for Small —Watersheds—(Massachusetts Department of Public Works-Highway -Design— Manual/USDA-Soil Desigri- Manual/USDA-Soil --- Conservation Service) was used to estimate peak rates of runoff. See Supplement A for runoff calculation worksheets. The rainfall intensities were determined from the USDA-Soil Conservation Service rainfall distribution tables. 3. EXISTING CONDITIONS The site is located on Massachusetts Avenue in Andover, Massachusetts. The property is triangular in shape and is bound on its three sides by Massachusetts Avenue, the Shawsheen River, and the Lawrence Savings Bank. The site is currently developed with a 1500 square foot Mobil service station, a gasoline pump island with two multi-hosed dispensers, a canopy over the pump island, parking, and other facilities relating to the gas station. The site is surrounded by a six foot high wooden fence along the river and savings bank sides. The area around the service station is paved with bituminous concrete. The area beyond the wooden fence along the Shawsheen River is undeveloped. 1 The area of the site from the building forward drains into Massachusetts Avenue and enters the storm drain system through an existing inlet. The remainder of the site drains into the Shawsheen River. These are referred to as Drainage Areas 2 and 1, respectively. See the attached Drainage Plan. Runoff Quantities A stormwater analysis was performed to calculate pre-development runoff rates for the 10, 25 and 100-year storm events using the USDA-SCS TR-55 Method. This methodology is recommended in the Massachusetts DPW Highway Design Manual previously referenced. The pre-development peak rates of runoff are resented in Table 1. Refer to Supplement A for S p � pp calculations.) PROPOSED CONDITIONS Under proposed conditions, the existing building will be demolished and a new 1200 square foot building constructed further back on the site. An additional pump island and canopy will be installed adjacent to the existing pump island. The existing pavement will be patched as required. Where possible, existing pavement will be removed and replaced with landscaping. There will be no work beyond the existing limits of development. The drainage pattern for the site will remain essentially unchanged from the existing to the developed condition. Runoff Quantities The stormwater analysis for proposed conditions was performed for the 10, 25 and 100-year storm events using the USDA-SCS TR-55 method. The post-development runoff rates are listed in Table 2. CONCLUSIONS The proposed development will result in a slight decrease of the peak rate of runoff from the pre-development condition for the 10, 25 and 100-year storm events under the post-development condition. A comparison of pre- development and post-development conditions are presented in Table 3. Page-3- NECESSARY RESPONSE ACTIONS The subject site shall not be deemed to have had all the necessary and required response actions taken unless and until all substantial hazards presented by the site have been eliminated and a level of No Significant Risk exists or has been achieved in compliance with M.G.L. c. 21E and the MCP. In addition, the MCP requires persons undertaking response actions at disposal sites to perform Immediate Response Actions (IRAs) in response to "sudden releases", Imminent Hazards and Substantial Release Migration. Such persons must continue to evaluate the need for IRAs and notify the Department immediately if such a need exists. The Department has determined that the following response actions are necessary at the subject site: Initial site investigation activities in accordance with 310 CMR 40.0405 are necessary. In addition, unless an RAO is submitted earlier, a completed Tier Classification Submittal pursuant to 310 CMR 40.05 10, and, if appropriate, a completed Tier I Permit Application pursuant to 310 CMR 40.0700, must be submitted to DEP within one year of the initial date notice of a release is provided to the Department pursuant to 310 CMR 40.0300 or from the date the Department issues a Notice of Responsibility(NOR),whichever occurs earlier. The Department encourages parties with liabilities.under M.G.L. c. 21E to take prompt action in response to releases and threats of release of oil and/or hazardous material. By taking prompt action,you may significantly lower your assessment and cleanup costs and avoid the imposition of, or reduce the amount of, certain permit and annual compliance fees for response actions payable under 310 CMR 4.00. This investigation has confirmed that a release of oil and/or hazardous materials has occurred at this location. Therefore, the Department has identified it as a confirmed disposal site. The Department has also determined that this site is a non-priority disposal site (as defined by M.G.L. c. 21E, Section 2) . M.G.L. c. 21E, Section 3A (f) (3) requires ,that, if , feasible, permanent solutions be implemented at disposal sites. If a ;permanent solution is not feasible, then a temporary solution must be implemented, and a plan for achieving a permanent solution must be developed. This site has also been granted a Waiver of Approvals by DEP. Waiver sites are non-priority disposal sites which'. have been granted a Waiver of Approvals by the Department, pursuant to 310 CMR 40.537. This waiver allows the person granted it to conduct remedial response actions at the disposal site without prior Department approval of these actions. M.G.L. c. 21E and the Massachusetts Contingency Plan provide several opportunities for public notice of and involvement in decisions regarding response actions at disposal sites, including: ° The Chief Municipal Official and Board of Health of the community in which the site is located will be provided with notices of the results of investigations, plans for remedial responses, and field work involving the use of heavy, construction equipment and/or protective clothing (310 CMR 40.202) . ° Upon receipt of a petition from ten or more residents of the municipality in which the disposal site is located, or of a municipality potentially affected by a disposal site, a plan for involving the public in decisions regarding response actions at the site will be prepared and presented at a public meeting. This plan will be revised based on comments received, and will be implemented over the course of the response action (310 CMR 40.203) . To date, DEP' s Northeast Region has classified 933 hazardous waste sites . Of those, 141 are priority disposal sites and 792 are non-priority. Priority sites are those which pose the greatest potential threat to public health or the environment and are a primary focus of agency resources . Non- priority sites are considered less serious .
