The Board of Appeals held a regular meeting on Tuesday evening, July 9,
1996 upon the petition of Mobil Oil Corporation requesting VARIANCES
from the requirements of Section 7, Paragraph 7.1, 7.3 and Table 2 of
the Zoning By Laws so as to provide relief from lot dimension area
requirement of 25,000 sq. ft. to 21, 600 sq. ft. for a relief of 3,400
sq. ft., the front setback relief of 18', and a side setback relief of
18.8'in GB Zoning District. Variance needed for dimensional
requirements for the construction of a new gas station/food mart
facility and a new canopy.
The following members were present and voting: Walter Soule, Robert
Ford, Scott Karpinski, Ellen McIntyre, and Joseph Faris.
The hearing was advertised in the North Andover Citizen on 6/26/96 &
7/3/96. All abutters were notified my regular mail.
Upon 'a motion made by, Robert Ford seconded by Joseph Faris, the Board
voted to GRANT relief from lot demension area requirement of 25,000 sq.
ft. to 21, 600 sq. ft. a relief of 3,400 sq. ft., the front setback
relief of 18', and a side setback relief of 18.6'in GB Zoning District.
Variance needed for dimensional requirements for the construction of a
new gas station/food mart facility and a new canopy. Voting members in
favor of the petition were: Walter Soule, Robert Ford, Scott Karpinski,
Joseph Faris, and Ellen McIntyre.
The petitioner has satisfied the provisions of Section 10, Paragraph
10.4 of the Zoning Bylaw and that the granting of these variances will
not adversely affect the neighborhood or derogate from the intent and
purpose of the Zoning By law.
Note: The granting of the Variance and Special Permit as requested by
the applicant does not necessarily ensure the granting of a Building
permit as the applicant must abide by all applicable local, state and
federal building codes and regulations, prior to the issuance of a
building permit as required by the Building Commissioner.

Dear Mr. Long:
The Board of Appeals held a .public hearing on Tuesday evening, April 8 ,
1986 upon the application of Mobil Oil Corp. The hearing was advertised
in the North Andover Citizen on March 20 and March 27, 1986 , and all abutters
were notifed by regular mail. The following members were present and voting:
Frank Serio, Jr. , Chairman , Alfred Frizelle , Vice-chairman, Walter Soule ,
William Sullivan and Raymond Vivenzio.
The petitioner seeks variances from the requirements of Section 7. 3 and
Section 6. 6 (5) (d) and Table 2 of the Zoning By Laws so as to permit the
construction of a new canopy and pumps within the 25 ' setback and relocate
Mobil logo-price sign to within 101_ of front and side setbacks , and install-
ation of a new low level area light within the 25 ' setback requirement,
front and side yards on the premises at 12 Massachusetts Avenue .
Motion made by Mr. Frizelle and seconded by Mr. Soule to GRANT these two
variances subject to the following conditions :
1 . No signs. on side , front, rear or roof of canopy.
2 . Lights , either surface or recessed , on canopy must have
light showing down .
3• A barrier be built abutting sidewalk to prevent parking
on sidewalk.
Vote was unanimous .
Petitioner seeks these variances in order for station operator to provide
quicker and speedier service in order to keep up with the competition in
the area.

SUBJECT:Traffic and Safety Survey (Sams Mobil)
The results of the Survey are as follows:
I spoke to -nay Manager (Paul Mercier) to inquire of the busiest hours of operation of which
he replied the busiest times for traffic are from 0700-0900 AM primarily Monday through Friday
and 11 :30 through 1 :00PM and the third busiest time is between 3:30 PM to 5:30 PM.
I observed parking to be limited within the establishment and at busy times vehicles were
waiting on Mass Avenue until the next available refueling station is available creating a
Traffic Hazard. There were also no signs indicating which pump to use when driving into the
establishment from Mass. Ave. This matter should be addressed during restructuring.
Since the installation of a stop sign on the off ramp from 495 South onto Mass Ave,.Traffic
seemQ9 to have reduced in speed. Also due tb.frequent use it is reccommerlded that stop
signs be installed at the establishment for patrons to stop and use caution prior to entering
the roadway of Mass. Avenue.
Observed was field of view to be obstructed by a stockade fence and shrubbery causing vehicles
to drive out onto the roadway for clear vision when turning East onto Mass Ave.
Mercier reports an estimated total amount of vehicles entering the premises for fuel, cigarettes
and lottery tickets to be about 300 vehicles.
The majority of vehicles and traffic flow upon observations went in the direction toward the
city of Lawrence which includes customers of Sams Mobil.
During peak hours of 11 :30 through 1 :00 PM I observed as much as five vehicles waiting to enter
Mass Ave from the business.
There is a six foot stockade fence preceded by a guard rail which abuts the rear of the service
station. The shawsheen River flows behind the property. This offers easy access and concealment
in event a crime against the property should transpire.

Please be advised that coming before the Board of appeals at the next meeting scheduled for July 9, 1996 is
an application for an appeal at the Mobil Gas station located at 12_Massachusetts Avenue. The appeal request is to
alter the existing structure of a now present gas station business to further accommodate a 24 hour convenience
store.
Your input to providing issues of safety and traffic would be most appreciated by the Zoning Board of
Appeals.
Please send any information or concerns to the Zoning Board of Appeals Secretary at 146 Main Street,
North Andover before our Board meeting on July 9, 1996 in order for the Board to be fully informed of your
