This office assisted the owner in determining a plan of action to restore the wetland and install measures to protect that wetland in the future. Restoration activities were performed in the spring of 2000 however the enforcement order was never lifted. Enclosed is an as built plan of the area showing how the area was repaired. I was on site during the restoration activities and determined that there had not been as much filling as originally determined by this office and the commissions agent. When excavating the new fill material that had been pushed over the bank I instructed the operator of the machine where to stop,which I determined was the base of the old fill which had been placed on the site in the past. It was readily apparent where the new fill had been placed in relation to where the historic fill had been placed as evidenced by buried vegetation. The site has been in its present state since those restoration activities were performed and no new violations have been observed. Just prior to the writing of this letter I asked that the owner of the property remove the trash which had found its way to the slope or in the wetlands. I would like to request that the commission place this matter on the agenda so we can discuss the lifting of the enforcement order.
