This Special Permit is requested for A Ground Sign that exceeds the maximum square footage and height as allowed by the Zoning Bylaw. Section 6.6D2 - Special Permit Application for Ground Sign - points 1-6: 1. Use of Structure- The tenant signage will consist of a signboard approximately 9'-5" wide and 8'-0" tall fastened to the sign structure. The bottom of this signboard will be 4'-6" above ground level to provide visual clearance under the sign for parking and keep sign above the picket fence around the property. There will also be 10 inch high post-mounted letters fastened to the Ground Sign structure above the signboard. The Ground Sign will be used to advertise the businesses located in the 1211 Osgood Street Retail building. 2. Specific Site- The specific site and location of the Ground Sign is appropriate because it will be easily seen by vehicles travelling to and from the Retail Center along Osgood Street. 3. Nuisance or Serious Hazard - There will be no nuisance or serious hazard to vehicles or pedestrians because the bottom of the Ground Sign is 4'-6" off the ground, and will not block the views of vehicles pulling in and out of the Retail Center site. The two (2) supporting legs of the Ground Sign will not significantly block views. Pedestrians will also be able to see under and around this sign as they walk to and from their parked cars. 4. Adequate and appropriate facilities - Support structure including a concrete foundation, tube steel frame, will be supplied. Electrical power for exterior lighting the sign at night, and landscaping will also be provided as a part of the construction of the self-supporting Ground Sign. S. Harmony with the Zoning Bylaw - The Ground Sign is in harmony with the purpose and intent of the Zoning Bylaw because it meets the definition of a Ground Sign (6.3.8). The sign will also, 'beset back a minimum often(10)feet from all property/fines and a minimum of forty(40)feet from all residential districts or structures"(6.6A6)and will be a single, self-supported sign (6.6D3). The sign will not have distracting elements and will be easily and quickly read (6.6H Efficient Communication, 5). Other signs for businesses along Osgood Street, and in other G-B zones in North Andover are of similar sizes if not larger (6.6H Environmental Relationship, 1)see attached photographs. The Ground Sign lighting will be from single fixtures mounted on both sides of the sign above the sign board and will be of an appropriate brightness level (6.6H Environmental Relationship, 2). The Gound Sign will not obscure views of the Retail Center, will be constructed of similar materials, colors, and architectural details and will match the scale of the Retail Center building (6.6H Building Relationship, 1, 2 and 3). A flower planter will also be provided at the base of the sign (6.6H Landscaping, Buffering, Lighting, 1). 6. Specific Reference and Response for Special Permit- A Special Permit is required and requested for Zoning Bylaw Section 6.6D2, "One(1)permanent ground sign of not more than twenty-five(25)square feet in area and extending not more than eight(8)feet above ground level. Larger or taller signs may be allowed by Special Permit of the Board of Appea15, if said Board determines that the particular sign will not be incongruous with the district in which it is to be located nor injurious to traffic and safety conditions therein." This sign will not be incongruous to the district in which it is located because it is a similar size. The sign will also match the architecture of the Retail Building. A majority of the existing signs on other sites do not match the architecture of their related buildings as well as this proposed Ground Sign. This sign addresses safety issues in a way that is more in tune with the Zoning Bylaw, while some existing signs on other properties do not allow for visual clearance at the base of the sign. In addition, a Special Permit is requested to allow this sign because the specific Zoning Bylaw requirements for maximum height and maximum square footage of a Ground Sign, do not allow enough space to clearly and adequately display the names of the Retail Center tenants. Also, this sign will be visible from a greater distance than a smaller sign would be. This will allow drivers to plan and initiate their turns safely into the property. Use of Structure- The tenant signage will consist of a signboard approximately 9'-5" wide and 8'-0" tall fastened to the sign structure. The bottom of this signboard will be 4'-6" above ground level to provide visual clearance under the sign for parking and keep sign above the picket fence around the property. There will also be 10 inch high post-mounted letters fastened to the Ground Sign structure above the signboard. The Ground Sign will be used to advertise the businesses located in the 1211 Osgood Street Retail building. 2. Specific Site - The specific site and location of the Ground Sign is appropriate because it will be easily seen by vehicles travelling to and from the Retail Center along Osgood Street. 3. Nuisance or Serious Hazard - There will be no nuisance or serious hazard to vehicles or pedestrians because the bottom of the Ground Sign is 4'-6" off the ground, and will not block the views of vehicles pulling in and out of the Retail Center site. The two (2) supporting legs of the Ground Sign will not significantly block views. Pedestrians will also be able to see under and around this sign as they walk to and from their parked cars. 4. Adequate and appropriate facilities - Support structure including a concrete foundation, tube steel frame, will be supplied. Electrical power for exterior lighting the sign at night, and landscaping will also be provided as a part of the construction of the self-supporting Ground Sign. S. Harmony with the Zoning Bylaw - The Ground Sign is in harmony with the purpose and intent of the Zoning Bylaw because it meets the definition of a Ground Sign (6,3.8). The sign will also, 'be set back a minimum of ten(10)feet from all property lines and a minimum of forty(40)feet from all residential districts or structures"(6.6A6)and will be a single, self-supported sign (6.6D3). The sign will not have distracting elements and will be easily and quickly read (6.6HEffcient Communication, S). Other signs for businesses along Osgood Street, and in other G-B zones in North Andover are of similar sizes if not larger (6.6H Environmental Relationship, 1)see attached photographs. The Ground Sign lighting will be from single fixtures mounted on both sides of the sign above the sign board and will be of an appropriate brightness level (6.6H Environmental Relationship, 2). The Gound Sign will not obscure views of the Retail Center, will be constructed of similar materials, colors, and architectural details and will match the scale of the Retail Center building (6.6H Building Relationship, 1, 2 and 3). A flower planter will also be provided at the base of the sign (6.6H Landscaping, Buffering, Lighting, 1). 6. Specific Reference and Response for Special Permit- A Special Permit is required and requested for Zoning Bylaw Section 6.6D21 "One(1)permanent ground sign of not more than twenty-five(25)square feet in area and extending not more than eight(8)feet above ground level. Larger or taller signs may be allowed by Special Permit of the Board of Appealsl if said Board determines that the particular sign will not be incongruous with the district In which it is to be located nor injurious to traffic and safety conditions therein." This sign will not be incongruous to the district in which it is located because it is a similar size. The sign will also match the architecture of the Retail Building. A majority of the existing signs on other sites do not match the architecture of their related buildings as well as this proposed Ground Sign. This sign addresses safety issues in a way that is more in tune with the Zoning Bylaw, while some existing signs on other properties do not allow for visual clearance at the base of the sign. In addition, a Special Permit is requested to allow this sign because the specific Zoning Bylaw requirements for maximum height and maximum square footage of a Ground Sign, do not allow enough space to clearly and adequately display the names of the Retail Center tenants. Also, this sign will be visible from a greater distance than a smaller sign would be. This will allow drivers to plan and initiate their turns safely into the property. The hearing was advertised in the North Andover Citizen on January 12 and 19 , 1984 and all abutters were notified by regular mail. The following members were present and voting: Frank Serio, Jr. , Chairman;- Alfred E. Frizelle , Esq. , Vice Chairman; and Associate Members Walter F. Soule; :Maurice S. Foulds ; and Raymond A. Vivenzio, Esq. The petitioner seeks a variance from the. provisions of Section 7 , Paragraph 7. 3 and Table 2 of the Zoning By Law so as to permit the construction of an addition to the front side of a building , which will not meet the front- setback requirements on premises located at 1211 Osgood Street and known as Aqua Dream Pools , Inc. The petitioner testified that a 1969 variance allowed the construction of an addition to the previous owner and he now proposes to construct another addition which is necessary for him to display goods which he proposes to sell in the near future as an added feature to his existing swimming pool business , thereby expanding his business . Denial of the variance would not enable him to become competetive or to continue employing his staff. No opposition was voiced at the hearing. Upon a motion made by Mr. Frizelle and seconded by sir. Foulds , the Board voted unanimously to grant the variance as requested. As part of the conditions of approval we were to obtain final approval from MassHighway for the access and egress drives to Rte 125 state highway. We have with our engineers Andover Engineering and Transportation Engineering and Construction responded to requests by MassHighway to revise the access/egress scheme approved by the planning board. Attached are seven copies of a proposed revision to the access and egress plans for the proposed 1211 Osgood Street plaza as requested by MI-ID. Parking supply remains unchanged with this reconfiguration. We are submitting this revision for consideration by your board to amend our order of conditions to reflect these changes. The revised plan displays changes to the ingress/egress to and from the site, as requested by Mass Highway. Prior to the issuance of a Building Permit, a revised plan must be stamped and signed by a Registered Professional Engineer. A mylar of the site plans must be submitted to the Planning Board for endorsement. In addition, a copy of the MassHighway permit shall be submitted approving the modified ingress/egress lanes.
