Dear Mr. Long:
The Board of Appeals held a public hearing on Monday evening,
May 9 , 1983 upon the application of Anne Marie Christou. The
hearing was advertised in the North Andover Citizen on April 21
and 28, 1983 and all abutters were notified by regular mail.
The following members were present and voting: Frank Serio, Jr. ,
Chairman; Alfred E. Frizelle , Esq. , Vice Chairman; Richard J.
Trepanier, Esq. , Clerk; Augustine W. Nickerson; and Raymond A.
Vivenzio.

The petitioner seeks a variance from the provisions of Section 7,
Paragraph 7. 3 and Table 2 of the Zoning By Law to allow relief
from the rear setback requirement to allow the continued use of
a deck which does not meet the rear setback requirement on premises
located at ' 124 Adams Avenue.
The petitioner testified through counsel that the premises were
recently purchased and the violation was discovered when the
plot plan was drawn.
Upon a motion made by Mr. Frizelle and seconded by Mr. Trepanier,
the Board voted unanimously to grant the variance subject to the
condition that the deck remain open and that there be no further
construction, additions , or alteration to the deck, except those
necessary for normal repair.
The Board finds that each of the provisions of Section 10 . 4 of the
Zoning By Law have been satisfied. In particular, the Board finds
that a literal enforcement of the Zoning By Law would create a
hardship to the petitioner.

The principal points upon which I base my application are as follows :

Hardship because I cannot obtain clear title to residence since the wood
porch is 18.7 feet from the rear yard boundary. The porch is a necessary
fire exit for 2nd floor and cannot be removed.

Sec. 1 APPLICATION FORM
Every application for action by the Board shall be made on a form
approved by the Board. -These forms shall be furnished by the clerk
upon request. Any communication purporting to be an application
shall be treated as mere notice of intention to seek relief until
such time as it is made on the official application form. All in-
formation called for by the form shall be furnished by the applicant
in the manner therein prescribed.
Every application shall be submitted with a list of "Parties in
Interest" which list shall include the petitioner, abutters , owners
of land directly opposite on any public or private street or way,
and abutters to the abutters within three hundred feet of the property
line of the petitioner as they appear on the most recent applicable
tax list, notwithstanding that the land of any such owner is located
in another city or town, the Planning Board of the city or town, and
the Planning Board of every abutting city or town.
* Every application shall be submitted with an application charge cost
in the amount of $25.00. In addition , the petitioner shall be respon-
sible for any and all costs involved in bringing the petition before
the Board. Such costs shall include mailing and publication , but
are not necessarily limited to these.

Gentlemen:
The records of the Building Dept. show that a
building permit was issued to Pasquale Marotto on 7/20/73
for a dwelling with a 2-car garage under. The plot plan
submitted with the application does not show a rear porch.
Said porch has been added since that time without benefit
of a building permit.
