NELSON, DIRECTOR May 3, 1988 Mr. Daniel Long, Town Clerk Town Office Building North Andover, MA 01845 Re: Channel Building Flagship Drive Dear Mr. Long: The North Andover Planning Board held a public hearing on Thursday evening, April 28, 1988 at 8:15 p.m. in the Town Office Meeting Room upon the application of Channel Building Company, Inc. P.O. Box 522/23 Main St. , Andover. The hearing was duly advertised in the Lawrence Eagle Tribune on April 4 and April 11, 1988. The following members were present: Erich W. Nitzsche, Chairman; John Simons, Clerk; Paul Hedstrom and Mike Leary. The petitioner seeks a modification to a previous special permit under Section 8.3. 1 Para. 2 of the North Andover Zoning Bylaw. The purpose of the Site Plan Review is to review the proposal to contact a 32,000 square foot, one and one half story facility on 5.79 acres in an Industrial-1 (I-1) Zoning District on the south west side of 125 Flagship Drive. The purpose of this modification is to address the following: 1. Allow for an enlarged Lot A to be utilized for the site. The old lot contained 5.01 acres, the new lot contains 5.79 acres and was filed in the Registry of Deeds Office under plan #11046, Form A plan signed by the Board of 2/8/88. 2. Allow for other adjustments made to the site plan related to the enlarged lot. The Board stated that the only change to this plan was the enlarged lot which actually exists as a Lot of record. The Board incorporated all of the material contained in the original application with this submission. John Simons closed the public hearing. The North Andover Planning Board has voted to approve - subject to the following conditions: 1. In accordance with the North Andover Fire Department's request of July 13, 1987 _ Note eleven conditions: a. An automatic detection and ..suppression. sys_tem must be installed. . These systems must be connected to the municipal fire alarm system through a master fire alarm box. The developer must contact the Fire Chief for the requirements for these systems prior to installation. y t Channel Building Flagship Drive b. Material Safety Data sheets must be submitted to the Fire Department prior to occupancy. c. Permits will be required for all flammable storage according to M.G.L. Chap. 148 and all flammable storage shall be in accordance with N.F.P.A. 30. d. Welding operations must be in accordance with N.F.P.A. 51B. e. The Paint Shop, in particular the spray booth area must be in accordance with N.F.P.A. 33. f. The intended purpose for the gas ovens should be given to the Fire Department and the intended fuel to be used so stated. g. An additional fire hydrant is needed at the west corner of the building. h. A 360° Fire Department access must be maintained especially after the proposed expansion takes place. i. The wire mesh between the stock room, carpenter ship and the drive bay is unacceptable. A safer redesign of this area is needed. j . Underground storage of fuel tanks will be in compliance with Fire Department Regulations and no permit will be issued if the Conservation Commission finds the lot unsuitable for such tanks. k. No open burning is permitted except in compliance with the Fire Department's Regulations during open burning season. 2. There will no on-site sanitary leaching system. The facility will be connected to the North Andover Public Sewer System. 3. The North Andover Conservation Commission Order of Conditions will be strictly adhered to in all aspects and the compliance of such shall be part of this special permit. 4. Binder coat of pavement shall be placed on all means to be used by motor vehicles prior to occupancy. 5. Any modification to these plans shall be reviewed by the North Andover Planning Board. 6. The landscape plan (drawing L4-1) of submitted plans will be completed within one year of initial construction. RECEIVED MAY 3 12006 May 19, 2006 NORTH ANDOVER CONSERVATION COMMISSION Ms. Pam Merrill Conservation Commission 400 Osgood Street North Andover, MA 01845 Re: Restoration Area– 125 Flagship Drive Dear Pam: As you know, our office has been assisting Mr. Stephen E. Foster, Dutton & Garfield, Inc., with the work conducted to correct an ongoing drainage problem that existed on Flagship Drive. An Enforcement Order was issued January 19, 2006 that allowed exploratory digging to occur to try to find the problem. On February 16, 2006 the exploratory digging commenced and the cause of the drainage problem was discovered. The problem was corrected and the area was backfilled and stabilized. A second Enforcement Order was issued on April 26, 2006 that would serve as a mechanism to complete ,certain_restoration activities .within the. Buffer Zone associated ;to the adjacent Bordering Vegetate Wetland.. , The; Enforcement..Order also required a wetland scientist to monitor the restored area for one growing season to ensure survivability, health and vigor and soil stabilization. Reports are required to be submitted to the Conservation Department for review. On Wednesday, May,18, 2006, the restoration area was planted in accordance with the approved restoration plan submitted by our office.—Four Red-osier.Dogwood, Cornus sericea, and Four Highbush`Blueberry(kaccinium corymbosum), were planted and the-area was seeded with New England Conservation/Wildlife Mix, (see.attached,photographs showing the restoration area). We shall continue to monitor the restoration area as required by the Enforcement Order. The North Andover Conservation Department is in receipt of a restoration planting plan, entitled, "Restoration Detail: 125 Flagship Drive" prepared by The Neve-Morin Group, Inc., which details proposed restoration activities within the Buffer Zone to the adjacent Bordering - Vegetated Wetland (BVW) This plan has been reviewed-and-is hereby approved with the- following conditions: :• At least 48 hours prior to the commencement of the restoration work, the Conservation Department shall be contacted to ensure temporary erosion controls are functioning as intended. :• A wetland scientist shall inspect the plantings and seed mixes upon completion, and subsequently submit an inventory report to the Conservation Department. In August of 2005 the North Andover Department of Public Works used high pressure water jetting to try to flush out the existing drainage system that was not flowing during storm events. During the water jetting procedure the water began to bubble out of the ground approximately 5 feet from the existing headwall where it was designed to flow to. It was evident that the system was not functioning as designed. We received an Enforcement Order dated January 19, 2006 that allowed exploratory digging in order to identify the cause of the ongoing drainage problem. The Order required erosion controls be installed, a wetland scientist or professional engineer oversee the work, a dewatering detail be submitted for review and approval, a pre-construction meeting and that the site be stabilized upon completion. i On Thursday, February 16, 2006, the erosion controls were installed and the pre-construction meeting took place. Prior to the pre-construction meeting we submitted the required dewatering detail as well as a list of emergency contact information for the wetland scientist and contractor performing the work. Following the pre-construction meeting we began digging in the area of ° the suspected blockage. It did not take long to uncover the crushed reinforced concrete pipe (RCP) and filled fieldstone headwall. We were able to obtain a small section of 12 inch ADS pipe, a rubber coupling and a plastic flared end section to repair to problem. Once the small section of pipe was added to the RCP we strapped on the flared end section and re-built the fieldstone headwall using the same stones. Erosion controls were placed in the wetland resource area to protect the resource area from the sediment that has been lodged in the pipe since it became damaged. Exploration is required in order to investigate the cause of the poor drainage at the(former)cul-de-sac/Chemineer driveway intersection, It appears that the existing drainage system may be clogged with silt based on discussions with NADPW personnel and field observations. In order to better understand what the problem may be,a more detailed exploration is necessary. Drainage Exploration Methodology: • Install erosion controls to protect resource areas during exploration. • Excavate,using a rubber tired backhoe, upslope of the existing headwall to see if the culvert is clogged. • Dewatering as needed to hay bale enclosure. • Stabilize all disturbed areas per NACC agent. Following the exploration a detailed report shall be prepared and sent to the conservation commission detailing the cause of the drainage problem. It is our hope that the problem will be minor enough that it could be handled under an Enforcement Order. Our goal is to find out what is causing the current drainage problem. We know that the problem lies somewhere between the catch basins and the headwall. An Enforcement Order would provide us with a mechanism that would allow the exploration to commence.
